I'm a victim of DV of my husband I gave my statement to the police we still lived together in our house so the police charges him a common assault we have hearing this coming august 10 2021 the police give me a subpoena to attend the hearing and I want to drop the charges to my husband Because I don't want him to have a criminal record because I loved him and respect him as my husband what would I do in the hearing time or what would I suppose to do in court?

Honestly i'm suprised a seen a lawyer post this, thats great and good advice as well kudos. But bow about we not have someone arrested for something if you didn't mean it or if you just happened to of just been mad at them. Calling the cops is for serious matters only so if its not serious don't do it, ever. I've actually seen this alot and i mean alot in my 30 odd years of life. The other person significant other gets mad has them arrested, or they "want to teach them a lesson", Although to be fair i have also seen this happen with people that most certainly should be arrested its much rarer but it happens. Either way here's some good advice 1: If you do have someone arrested for domestic violence make sure you never want to be in a relationship with them again before calling the police (as only a fool would be with someone who had them arrested, except in the case of actual abusers they will always since they don't have alot of choices and they did all that work building trust and such.) 2: Only call police if its something serious like say your life was threatened or you've been hit, and again be sure that's what you want because theirs no takey backsys, the state will almost always pick the charges up even if you try to drop them. And trust me Prosecutors are use to this kind of thing and can and will manipulate you into helping them whether you like it or not. And you may also be charged with making a false testimony, or later on contempt of court or even failing a summons when they try to make you testify and you refuse. even more reason not to get police involved if its not needed. 3: If you do call the police don't lie and make stuff up, (for instance i have seen where someone had pushed the other and the report said they struck (hit) the other, meaning that case could potentially be a assault instead of a domestic dispute.), Also don't answer false questions that police will attempt to get you too do. (ex; P: you said you were arguing and it got heated? U: yes P: did they hit you? U: No we just yelled at each other but i thought i was they would kill me, i have never seen them that angry before, P: Did they grab you? U: No, but i thought they would i was really afraid and they had grabbed the phone like they would throw it, P: So you were scared because they threatened to kill you, and then they threw the phone at you? U: No they didn't throw the phone at me i thought they would, and yes i was scared they would kill me.

I just had a baby, and suffer from post partum depression as well as a surgery I’m on pain meds, can I use this as defense? Or do I call the cops to retract my statement?

I would not recommend talking to the police/prosecutor before talking with a defense attorney. If you "retract" your statement outright, they might charge you with making a false report in the first place. That would be a bad thing. The defense attorney can learn about the facts of the case and give you direction on how to proceed. Thanks for your good question.

I was involved in domestic violence disputes in 2 diff counties. Although I didn’t want to press charges, the 2 diff counties charged the other person anyway. I want the charges dropped but feel helpless because the charges are not from me directly. One county has told me they will drop the charges if I send them a statement. I haven’t spoken with the other; there is a detective pursuing charges through an attorney. I have two questions: What should I write in my statement and how do I handle the situation with the other county?

I would consult with his criminal defense attorney to help you develop options. Remember, the prosecutor has absolute authority to charge, or not charge, an individual for a crime. The attorney will help you identify the people in power who must be persuaded. Good luck!

I need help! My boyfriend has been wrongfully charged with domestic violence when really it’s an addictions issue so any time I did call the police they didn’t know what to charge him with (short version trumped up 2nd degree assault) some how he has multiple cases against him because the police told me legally you can be high all you want and he lived there and the only way to get him out of the house was to file a protective order. I never checked jail time on the documents... I checked seek help or counseling... this case has been going on for over a year and I’ve never showed up during any of his court cases... I had been taking care of my sick father on home hospice till his death ... and after that moved and I’m a single mom in the middle of selling one house and living in another... during another one of his black outs he showed up again not knowing what he’s doing high and has used drugs in my house! The police told me the only way to stop him from coming in the house was to get a protective order and they trumped up 2nd degree assault on him. During all of these incidences I called an ambulance for him and have had him psych evaluated, and he almost lost his life! He was on a ventilator and pulled through.... long story short the last time he did this he broke my daughters tv ( she’s 16) I filed a protective order but wasn’t aware I HAD TO BE AT HIS COURT DATE.... the judge didn’t tell me this either... the summons or subpoena probably got lost in the mail due to me loosing my dad and moving and now they want to put ME in jail ( I haven’t had any legal problems of my own for 14 years ( I’m in recovery myself) I’ve helped him in his recovery over the course of our 3 year relationship... but the police keep saying I have to file my own protective order if he shows up regardless of the fact that the judge herself put him on a strict stay away order and not even his Pretrial officer knew this! I’ve had to bend the truth and practice “tough love” and not let him back home till all this is over ( we do want to reconcile ) we do love each other and as long as he is not using he’s a great man! Yesterday in court the states attorney asked for 20 years (the rest of his life) in prison for a misdemeanor! They asked for a body attachment on ME AND THE JUDGE GRANTED IT! I need to know what to do ... I haven’t committed any crime, and I’ve called the states attorney before and no one was able to speak to me! My question is should I turn myself in and explain why I didn’t show up in court? Or should I wait till they give him a court date? I cannot be caught off guard and get arrested as I’m responsible for my minor child and my dog and both my homes! This is unprecedented and NEVER happens this way a body attachment on a victim is rare but it happened! Now he’s facing 20 years for something he didn’t do and I have a body attachment on ME! I paid for his legal defense a year ago because he never laid a hand on me but the police insisted he be charged with second degree assault because they were “ tired of paper work” etc it’s a mess! ANY GOOD ADVICE IS APPRECIATED !

It depends who is looking, but I’d say any arrest would affect job searches. Expungement does destroy arrest records.

I have a question sir. I got into a heated argument with my mom. I pulled her hair to get her out of my way she was provoking me. My intentions were not to cause harm. But I was so mad. The lawyer will get access to all the reports and evidence, which will help them assess the case a advise you on possible defenses. Make sure you are complying with any protective court orders. Hello, I called the police and my husband got arrested, third degree assault misdemeanor, me and my kid got so upset and guilty so I dropped the case. He is a police officer, he was suspended for 30 days. The case was pending for pandemic. They took away his gun, his shield. He has order of protection. Now my question is after dismissal ,the order of protection go away automatically or if I want to keep it it’s going to effect his job? Can he lose his job? Or it’s not going to effect his job?

I have no idea whether this situation will affect your husband's job, or not. That is an administrate decision made by his employer. Protective orders are usually distinct from the criminal case itself. The order should state how long it will remain in effect.

Only the prosecutor can officially "drop" charges. The victim may make their wishes known to the prosecutor, but the final decision is up to the government.

The lady told me that the DA was not going to press charges against my wife. Her first court hearing is in about 30 days So I dont know if that is true or not. Does the DA do that?

Yes, they can. I usually see a letter sent from the DA stating they are refusing charges. But a phone call is appropriate, as well.

Hello sir, my boyfriend and I got into it a while back someone seen us and called the police. We had been drinking that night and I ended up getting mad at my boyfriend. I talked to the police and added untrue information on the police report. He was already on probation and they are charging him with aggravated assault. I talked to the DA and asked him to drop the charges and i let him know about false statements. I wrote and sent an affidavit telling the truth of what happened, but it’s not going to be used in court. You need to hire a lawyer for yourself. If you made false statements to the police, that may be a crime you committed. I'd also talk to his attorney to see what their strategy is. But again, you may need a lawyer.

I just had my roommates arrested for ripping off my necklace out of anger. Impossible to tell since I don't have access the evidence, statements, prosecutor, or judge handling the case. Your roommate should hire a qualified criminal defense attorney to help him defend this case. The complaining witness contacted my attorney and offered her assistance to aid my defense but my attorney informed me that any help given would help the prosecution. Jesse: I have no idea whether you'll go to jail in this case. However, if your girlfriend is changing her story as you described, then your criminal defense attorney will have success impeaching her testimony, which has the potential to discredit her allegations against you. Thanks for your question. All prosecutor offices have different ways for victims to request non-prosecution. I'd say the best thing is to call the prosecutor's office, tell them you want to make the request, and ask them what the process is. That way you'll be doing it "their way."

The best person to discuss your strategy would be your husband's criminal defense attorney. If your husband cannot afford to hire his own attorney, the court will appoint one to represent him. Once the appointment is made, you'll know who the attorney is. Make sure your husband speaks to NO ONE, including you, about the case. He can speak ONLY to his defense attorney.

If you "recant" your statement you may be criminally liable for making a false report. In other words, the recantation might get your husband out of jail but may put you into jail. You must hire your own defense attorney for advice on this issue. Good luck.

Why did you call the police on her? Once you call the police, all bets are off. You'll need to discuss this with her criminal defense attorney and see how you might be able to help her. Sorry this is happening.

Hello what if the alleged victim is not cooperating with prosecutors extremely and told them they are on the defenses side.The alleged victim did not attend the preliminary exam nor the first trial date.The prosecutor asked for an adjournment the judge say she would grant one continance.The prosecutor said she wanted to see if the defendant forfeited his right to cross exam the alleged victim and she also stated she had three voicemails for the defense that where exculpatory or at least impeachment in nature .So my question is then when djourned trial date comes and the alleged victim still does not appear and there are no other independent witnesses and the victim was subpoenaed each time what could be a likelihood of a dismissal of charges also the judge said she was only granting. that one adjournment.

The prosecutor has total control over whether to dismiss a case. There may be other ways to prove a case besides using a live witness. Only you defense attorney can accurately answer your question since they have access to the evidence and they can discern what evidence might be admissible in court. Also, if the witness does not obey the subpoena, they can be arrested and held in jail until they are called as a witness.

Simply give the lawyer their name and allow them to handle it. You, on the other hand, should NOT be talking to the witness about their testimony. That negativity affects their credibility. There are many anger management programs he could take advantage of. I would recommend he participate in a program to help him learn how to re-direct his anger. The important thing is that you are safe. As far as dropping charges, since you are the victim, you will need to discuss your wishes with the prosecutor handling the case. If your boyfriend has a lawyer defending him, that lawyer should be in a good position to help you identify who the prosecutor is. Ultimately, the prosecutor will decide whether to continue with the case against your boyfriend. But telling the prosecutor how you feel is a good first step. Discharge came from my stepmother who I don't live with but live on the same land. Well one day we had an argument and it kept escalating throughout the day and we've always had arguments but this one was pretty bad and inside of their house it got heated and she said certain things and I jumped over a counter and booked up at her I never touched her at all and she proceeded to run into her room and called the police I then got in my car and went down my road and part just so I could calm down and get away from the situation, that's when five cop cars roll down the hill coming to get me. There was no investigation on scene it was an immediate Assumption of guilt and I was immediately arrested taken to jail for a night and was discharged on my own accord and given a court date. I proceeded to go to court I did not have a lawyer at the time I talked to a public defender told him the story and he proceeded to tell me that I can still be charged with domestic violence because I showed an intent or threat to harm. My stepmother and me since I have gotten over and have a great relationship now and she wants this to be completely dropped and is willing to even go to the court and testify for that and has also called the court to tell them and they told her to come to court with me but my public defender says that even with that it probably won't do much and that I most likely will have to go for a deferred prosecution basically telling me that I'm going to be found guilty and they're not trying to help me. My question is how can I get them to drop these charges and leave me alone because I didn't do anything and the victim knows that and wants to have it all drop will her being on my side or present at court help me at all?

He backed up and him and my aunt went inside the house. My aunt was already calling the police, and I wasn't thinking clearly I was yelling give me my keys and punching the door. I broke the door. Then my uncle came back out pointing the gun at me. He pistol whipped me when I was talking to my aunt and him, because I called her a bitch. I got arrested on burglary and domestic violence. I was told it will probably be reduced or dropped, but I never threatened anyone verbaly or touched anyone at all, or made gestures. My uncle pointed a gun at me because I was yelling. He Hit me and said it was defense, but it was really cause I called his wife a bitch. Technically I broke the door, but only after I was threatened with a gun and my keys were taken. What should I do. I'm a retired Marine so I was very loud, but I don't think I deserve these charges.

Hello ! After seeing your video , I would like to drop the charges too! I had an interview with the victim advocate and then a states attorney came out and gave me a subpoena and I told her I wanted to sign the affidavit for non prosecution and she said well it’s in the states hands now. You can’t do anything about it. I told her . I really don’t want to be apart of this case. All my boyfriend needs is anger management classes and we can go to couples counseling. I don’t know who the prosecutor is for our case but I hired him a defense lawyer/attorney and he told me not to contact the states attorneys office as it may make it difficult to drop the charges. I never called the states attorneys office or anything. I just really want these charges dropped or the case dismissed. My boyfriend isn’t a bad person at all. He just let his anger get to him and we are good now. I just want to fix our relationship. We both love eachother and we were both yelling at eachother when everything happened. This strategy takes a long time to implement. At least 6 months to a year. Consequently, your BF in jail is a serous impediment. He needs to bond out of jail so meaningful steps can be taken toward reconciliation, mitigation, and behavior modification. Trying to accomplish these steps while he’s in jail seems much too impractical.

It just seems odd to me that how can they represent on my husband's behalf professionally without police report at that date? @@RhodaCrosby Discovery information, like reports, often come piecemeal from the prosecutor. A few now, some more later. That is a common thing. Since I don't know what their standard practice is, it's difficult to speculate on whether it's normal or not. Just keep trying.

Hello Sir, so I have contacted by prosecutor who has assigned to our case last week and asked "what do I want from this" I made it myself clear: press no charges, dismiss the case and could've sent my affidavit through email to the prosecutor. I recanted my statement after i received a police report beforehand, I made a call to deputy to fix on police report which originally filed but he said he can only add whatever i want to fix on as suppplement so i did it and then forwarded police report to his defense attorney.
