Doesn't matter if Bentley driver was foreign resident or not he's driving on British roads and British road rules should apply to anyone who's driving on them, I bet if it you or I in his country we'd still be prosecuted, so in other words if he hit and killed someone while on his phone he'd get away with it as he's a foreign resident, strange rules

I don't disagree with you, but sadly the amount of red tape and expense involved in pursuing a foreign national is too great. It's the same with parking fines, etc.

It is upsetting to read that foreign residents are not prosecuted. The police should impound the car for reasons of public safety. Disclosure: I am a foreign resident too and the feeling of being above the law is not fair

If you are an EU citizen, you can still get fined, I know, coz I got 2 parking tickets + yellow box fine, when I moved to the UK and had only an EU license at the time.

@@ETr4d3 Not only fined, but also have that fine fully recovered from you if you don't pay it. There are international debt collectors who can chase you up within the EU. This came to existence because lots of Eastern Europeans were coming to the UK, lived here for years during which they gained a good credit score at the banks they had their current/saving accounts at, then decided to move back to their home country, took out massive personal loans and fled with the money and the banks couldn't recover the debt. But that's no longer the case.

@@ETr4d3 yeah, but IN the UK - I received 2 parking tickets on a French plate, never paid them. Actually on one, the parking attendant lied to me saying I had to pay him cash on the spot, with his colleague right next to him. I gave them the old ''you can F right off'' , crumpled the fine in front of his face and laughed at him while leaving. On both tickets I did not commit a parking offence, and had more examples of how parking companies are corrupted.

Used to know of a Canadian diplomat that drink drove all the time, didn't care for laws and knew his diplomatic immunity would mean he can get away with anything really. It shouldn't work like that but it does.

Yeah I do wonder why the Police don't add this to the charge. It's up to an additional £500 penalty and wouldn't impact points so risk banning someone outright. Oddly though on the seatbelt laws, it seems taxi drivers carrying passengers are exempt, not sure of the reasoning on that one.

The Bentley driver was driving holding his phone up to his ear and looking at you and being insulting while moving forward . That he receives no punishment for such grossly dangerous behaviour is reprehensible. His arrogant attitude displays that he has broken the law before and not been held accountable. Truly a tragedy waiting to happen.

There are those who own and drive Bentley Bentayga SUVs. Those people I feel sorry for. It doesn't matter that you are showing off how much money you have that you can afford something like that. It is so ugly, they would be better off just driving a 2004 model Citroen Berlingo with that weird front. At least those you can park anywhere and not worry about scratches.

It is quite easy to prosecute drivers from overseas if the police, border forces and embassies can be bothered to work together. Visitors to this country can quite easily be picked up, either on exiting the country or the next time they enter. All it takes is a little bit of willing.

The Bentley driver probably has diplomatic immunity. Back in the 1970’s diplomats had what I believe were referred to as CD number plates. I also seem to remember that a Bobby on the beat was required to salute if a vehicle with CD number plates drove by.

Further proof that arrogance is often a compensation for personal problems and incompetence. They may have thought that they avoided penalty, little did they know they just made things worse for themselves. The "privacy guy" was hilarious, the other was menacing. Probably the driver - we know it went to a human because they got six points. It might have gone to the registered keeper, or it might have gone to the driver. I suspect that it was probably the driver.

Presuming that it was discontinued because the driver is a foreign resident is one reading. Equally likely that call was made that a prosecution would upset some important, so called ally of the UK. Wonder if foreign residents in his country have prosecutions dropped?

It's not just drivers being distracted. I was cycling today. Slowed down for a road junction. Looked right to make sure the road was clear for me to pull out to the left.... and BANG! A pedestrian walked across the road and directly into me. He had a hoodie on with hood up, earphones in, looking at his phone. Didn't stop to look - just stepped straight out. He came off worst with a bad graze on his shin from my brake rotor. Funny how I ended up apologising to him, even though he was in the wrong - and he knew it. He was just too lost in phone world to be aware of what was going on around him. I saw a driver a bit later on, driving with headphones on. Surely that shouldn't be permitted by law. How can you be fully aware of your surroundings, driving like that? These people are selfish idiots and deserve to be disqualified from driving full stop.

I really wish I'd had a camera a few weeks ago when a driver almost hit me in traffic while I was cycling. She actually held her phone out the window to show Google Maps and told me that this was the reason we almost had a collision! As some kind of mitigation. It would have made a gret video.

Yep, arrogance is the correct word there. There seems to be a slew of people getting away with this offence despite very clear evidence and even a confession. I hope that claiming immunity from the law also means the law doesn't protect you either, but I know this corrupt world well enough to know that's not the case.

2:22 What does it mean 'to nominate the driver"? Nominate for what? I guess you meant to IDENTIFY/NAME. “The person keeping the vehicle shall give such information as to the identity of the driver as he may be required to give”. "Any other person shall if required give any information which it is in his power to give and may lead to the identification of the driver”. Section 172(3) provides that a person who fails to comply with a requirement shall be guilty of an offence. You would think that a person SHOULD KNOW who has access to their vehicle otherwise that it negligence on their part, unless it was stolen.

Stationary phone drivers are still dangerous for many reasons: 1) The people using their phones when stationary are often the same people using them when moving. Being caught whilst stationary is a co-incidence, not a defence. It's easier for me to catch them when stopped, but so many were also seen using their phones when moving. 2) They are entirely unaware of people crossing the road around them. See here where a phone driver almost hits someone in the queue twitter.com/phonekills/status/1491526464520560641?s=20 See this other tweet where a 5 year old child is almost hit by a phone driver who was stationary: x.com/cmdkenyon/status/1724483042046067052?s=20 3) They are entirely unaware of filtering cyclists and motorcyclists, despite the Highway Code requiring us to be aware of this. 4) Phone distraction lasts for a good time after you put the phone away. Even if you're only using the phone in each traffic queue at each junction (which is highly unlikely), then you're constantly topping up your mental distraction and are basically as disabled as a drunk driver. 5) Phone driving is worse than drink driving for distraction rates, and that's why it's part of the #Fatal4 behaviours that police target heavily. 6) Here's a police officer telling you that he has been on the scene for 3 fatal RTCs involving drivers who were stationary whilst using their phones, and then moved off and caused a collision: twitter.com/markandcharlie/status/1604073330751197184?s=20&t=uj8sgu7spu4cTyDqqqds2g 7) Policing phone drivers will help them stop other traffic offences too - it's vanishingly rare that someone only breaks a single traffic law like mobile phone use. I found that the people with expensive cars and foreign nationals always found a way to wiggle out of fine and penalty. What is it with British police they are blatantly breaking the rules. We are all equal under the law or not??? 🤔🤔🤔

Then the law needs to change because they’re effectively getting away with breaking the law and suffering no consequences and it’s unfair to sanction one motorist and not another. Personally I think there should be tougher laws regarding using a mobile phone when driving anyway and it should apply to EVERYONE regardless of nationality.

Foreign residents should be forced to have a UK licence. If visiting for an extended period, before leaving the UK, they should be forced to pay any outstanding fines or penaltys

I bet the Bentley driver had Diplomatic Immunity. The plates weren't DI plates, but a lot of them now avoid using those for security reasons.

The case should not be discontinued. I am assuming that the Registered keeper has told the police who was driving but that they no longer lives in this country or are a non resident. So why not prosecute in his absence? Then if he ever did return there would at the very least be an unpaid fine/arrest waiting for him. Happened to that UK woman that bunked off from Gran Canaria with unpaid fines then wondered why she was arrested and thrown in jail when she returned. We are just such a soft country when it comes to these things. We love to talk a good game but when it comes down to it there is little will to carry things through.

My gut feeling about the silver mini is because he has failed to nominate under section 172 he will still be using his phone be hind the wheel its just the sheer arrogance of this driver make me think so.

The irony is that failure to nominate is easier to prove than phone use, incurs 6 points and a big fine. I don't know how insurance companies treat it -but they probably assume the worst and treat it like running a red light, which they really penalise for

@@SteveLoughran I have read on the net the driver must tell the insurance people of any motoring conviction and also I have been informed that the information is passed on by the police or my be by the courts. A motoring conviction last for 4years or longer depending on how serious the offence is and that could be up to 11 years. I am that guessing the driver of the mini is going top pay a higher rate for the next 4 years. Its the duty of the owner keeper to notify who was driving at the time even if it was not him there is no way out of it.

Why is it so hard to follow up on foreign resident? His car had UK plates, so it has a DVLA registered keeper? If the keeper is UK resident fine them instead. If he's the keeper with a foreign address listed with DVLA, then just seize the car and crush it for non payment or put a marker on his passport and/or he cannot leave the pass thru passport control until fine is paid? If the actual owner of the vehicle won't step in to pay the fine, the vehicle should be crushed imo because they allowed someone to use their vehicle to break the law, the same someone who may be a foreign resident or equally be a UK resident but with no assets with which to pay the fine! Otherwise it's all a big loophole. I MAY AS WELL put a foreign address on DVLA forms as the keeper, and then tell them I'm not even the actual owner. Now I'm free to be unaccounted for my actions and the car is safe from the crusher lol...

driving in an open top car with all windows down ,chrome car and stripes and wants to be not noticed. I have sympathy for people stuck in queues looking at phones so tempting but just say sorry and put your phone down.

That will be a nice ride, I have heard that some people cheat by sitting on their bike whilst on a train. How much is it by train now? about £55 single. It would be great to ride with Mikey and see him in action, hey we could all look out for a Bentley driver on his phone.
