I tend to disagree with solo 1/8 is not illegal that's the minimal size that one can sub divide ...also you can't sub divide agricultural land without change of use to commercial or residential

You are correct Peter. My comment was not a blanket one. I stated hat MOST were illegal. You may see my response to someone else in later comments below. To be clear; 1. Agricultural land CAN be subdivided WITHOUT Change of User. The requirement for change of use is typically based on the sizes of the subdivided portions and the resultant DENSITY of plots created from their mother-parcel. Density of plots will have material implications on requires access-road sizes, public or common space allocations and most critically, waste and sewer treatment and management requirements. This Chang of User threshold/requirement is also County SPECIFIC, meaning it varies from county to county. For example, in SOME parts of Laikipia County, one can subdivide Agricultural land into plots as small as 1/2 (half) acre and in some cases, even smaller. However, if subdividing Agricultural land into more than 7 portions, one is required by the County Government LAND USE POLICY, to change user, regardless of the resultant plot sizes. This is important to know, because we now have 47 County governments, each of which have autonomous constitutional purview over land-use and land density policies and guidelines. 2. Whether or not a land seller has produced the 1/8ths legally, is a matter of due diligence by the purchaser. Just because I offer you an Agriculturally designated 1/8th plot that has a legitimate Freehold title deed, does not mean that I produced it legally, or in line with the specific County's prevailing policy. I could simply have bribed the county authority for the requisite COMPLIANCE CERTIFICATE, so that I can produce the 1/8th without the rigor and the cost in time and capital that comes with the change of user procedures. This is unfortunately what is predominantly happening in our property market today.

Chris, no need for undue panick. My comment on the illegality of 1/8ths, was contextual and qualified. I stated that most 1/8ths we see offered by land sellers in Kenya are illegal, because most have not been produced in line with the prescribed due processes and county-specific land use policies.
