I think Oblivion is above The Living Tribunal because of what he was able to do and represents. He was able to break the 4th wall and speak to the readers. His mere aspect of himself almost destroyed the entire multiverse which even Eternity couldn't do anything against and was only not able to fully destroy it because Chaosking wasn't Oblivion himself who represents nothingness, which existed before time and space and any version of the multiverse and also outlasts the multiverse, because everything starts and ends with nothing.

The One Above All is an omage to Jack Kirby, not Stan Lee. In fact, when Stan Lee wanted to use Steve Rogers (Captain America) in a new team (The Avengers), Stan had to promise Jack Kirby that Steve would always represent "moral good". So they said Steve Rogers was given a gift to be uncorruptible from the One Above All. To my knowledge that was the first usage of the One Above All.
