she kicked the door in, the police went in because she invited them in her/their place. if she moved out because of a domestic issue and still have stuff there she is entitled to it. i think the question is when does a person no longer have rights to access a property when they leave on a domestic issue [ because they had a argument, fight or just need some cool off time , maybe gone for a couple of days ] WHEN do we lose our rights to come back in or enter the home ? Same day, 3 days or a week later, or a month WHEN ? she should have gotten a court order to retrieve her belongings

@@tudorjason I do not want to federalize police, but many occupations have national data bases. Medical, trucking, etc. Make it mandatory to report any activity, a point system ensues. Automatic checks and investigations by both fed and state, unpaid leave while under investigation. Permanent loss of creds..nationally under certain conditions. This is one of those conditions.

That'll be the day.....this is what will happen 1) The DA, only after huge public pressure, will call a grand jury to have them decide whether to criminally charge the cops. DA's will always use a grand jury to avoid charging the police because in a grand jury, the DA has total control over how the case is presented and what evidence is submitted to the jury. They’re named in the lawsuit. There will be a hearing to rule if they wilfully violated his rights. If the court rules they did, their qualified immunity is gone and they can be sued personally. The courts almost always rule in the pigs favor though. It’s rare, but sometimes they don’t.

I've seen vids of judges and lawyers exam single lines and words to determine if QI exists. It's sickening, they had no business on his lawn...anything done when the ex broke the door should be handled as criminal activity.

TIP: You need a good quality deadbolt (grade 1 or 2) WITH 3" or 3.5" screws in the strike plate and hinges. Otherwise most doors can easily be kicked in. Obviously keep your doors locked at ALL times. And never open your door to a stranger, including the police.

If you let the police investigate themselves it always ends up like this “ we investigated the situation and found we had done nothing wrong“ This type of stuff needs to go in front of a civilian review board to see if wrongdoing was done. Then take it to the justice department of the United States and file a complaint

That as a home invasion. The homeowner could have reasonably assumed that there were dangerous criminals on the other side of the door and opened fire. This was incredibly irresponsible legal advice from the girl cop.
