I remember I once took a seminar with this guy co-taught--a mess itself because of the multifarious topics--but perhaps the lot of us just weren't smart enough. Now that I look back, and light of this talk, I think that maybe Josh was just too smart.--I can't but be impressed by the ease with which he teases out and engages philosophical issues within political and legal practice. And, as always, I admire the no bullshit intellectual posture that isn't overbearing. Thank you for posting this--it repays careful attention! I hope he's still healthy.

Would he suggest that we should consider some binaries irreconcilable? ...which necessarily means the Court could not resolve them? What does this do to the Court's jurisdiction?

The only problem with reforms is frequently the reforms turn out to be worse than the problem. After a decade, Citizens United is a non-issue except, to the radicaly progressive.
