Ok, NOW you have something to take to the Cops: They asked for you to contact them to make arrangements TO PAY. Up to this point, they've only sent you warnings and notices of fines with no information on how to pay them. Those were empty threats. NOW, they have crossed the line to Scam, because they want conversations on how to pay. Get this one in front of the cops, and if you have one, put it in front of your lawyer.

IF that property was in any kind of HOA zone, you would most likely be made to pay regular HOA membership fees right from the get-go. No membership fees... Likey no connection to any HOA. Membership fees attached to that place WOULD indicate some kind of "pre-existing contractual relationship". Let them try to collect the fines. You will find out who is doing what.

Eric.....I am a Real Estate Appraiser for 34 years and I can tell you that I have never seen an HOA community with that large of tracts ever. In addition....you would have had to of signed HOA documents in you closing documents and this would have been clear by the closing representative (Title Company, etc.) at that time. Furthermore, your Realtor that you purchased through would have had to explain that the property in encumbered as part of an HOA. If you still have a copy of the Listing it would need to be disclosed in that as well. It all sounds very bogus to me and I would get an attorney and/or the local Sheriff involved and if it is bogus....what they are doing is criminal activity which can be prosecuted. Some people are just rotten to the core and they need to be handled accordingly. Best of luck!

This HOA sounds like bullshite!!!!! There's a neighbor somewhere messing with you. I'd look up the address for the business and I'd be filing some serious complaints on every last one involved. Then there are people who enjoy handling these kinds of idiots their own way,if you know what I mean!! Sometimes you just can't get the law to do what they took an oath to do. That's when things get done with with a certain care that gets the point made & the trouble goes away for good.

If you have not gotten any actual bill from the HOA with an address, or a notice of Leon on your property, you do not have an HIA. Get an attorney and sue this woman. Ask your neighbors if they know anything about a HOA.

You should have received an HOA package when you bought the property, as usually required by state real estate governance. If there is no mention of the property being a part of an HOA, then either the realtor falsified the documents upon the sale, or someone's just harassing you with bogus HOA "violations".

Hire a private investigator to find out who is behind this. Then print a business card with their contact details, advertising ‘adult’ services ( you can get real creative here), and put them in gas stations etc. The perpetrator will find out pretty damn quick what harassment is. The only way to stop is by changing their phone number.

I own 80 acres and a HOA development was built about 5 miles from me and they sent me a letter stating that I needed to trim a hedge row of bushes because when their HOA homeowners drove by they did not like the way it looks and they were going to fine and sue me if I didn't. make a Long story short it ended up in court and the judge asked the HOA to show documents that my property was part of the hoa, of course no, judge asked me how I wanted to handle it and I asked judge to tell HOA members if they didn't like what they are looking at to close their eyes while driving by my property, after a great laugh from the judge and he ordered them pay all my legal costs and to have no further contact with me! So far so good😀 good luck

Step one: Have an attorney go over your property records and find an exemption to the alleged HOA covenant. Solve that issue once and for all. Step 2: Once protected from the HOA, paint barn pink with purple polka-dots. Step 3: File a police report for harassing communications.

Aye, review your real estate documents on your property purchase, specifically the Property Title Search, which is supposed to report any encumbrances against the property, like HOA dues, liens, etc.. Best of luck with your neighbors. Also, double check that escrow does not include any HOA dues.

Sounds like a group of neighbors want you out so they can have a close friend buy your property. If you haven’t signed a HOA agreement at time of settlement then I wouldn’t think you have one. Take Margaret to court and sue her for harassment. You could also call the title company that preformed the settlement and ask them what’s up with this HOA bull crap.The title company should be able to produce any if any HOA paperwork. One more thought comes to mind , if you can call the realtor and see the listing on your house has an HOA listed.

GREAT, they ( whoever "they "is) must present a document with your signature that says you signed up for the HOA. Since they are fining you based their CCR's, they will need to bring a copy of the CCR's dated the day you bought the property, not dated any day past that. This document must be an original, not a photocopy, and your signature must be obviously original. There are ways to determine the difference between a handwritten original and a photo or other copy. Failure to do that, and a few other details, will put them in a bad light in the eyes of the court. AS TO THE TOWN COUNCIL ... when and how are they elected. beat them at the polls, as in, find more people who have been harmed or damaged by the town council and run to replace them.

I believe there are lawyers that specialize in HOAs. The attorney can verify that the HOA is bogus, and send a Cease and Desist letter to stop the harassment. If that person can't be found, I believe you can put the letter in the classifieds in your local newspaper (hardcopy and electronic). I agree with you that this harassment needs to stop. But this individual may escalate and do damage to your person and property. I suggest that you not do anything further in response to these people and do some research and let an attorney work on this. I know you shouldn't have to do anything, but this situation is getting worse not better.

@@lorilozano1884unfortunately, most of the lawyers that specialize in HOA law represent HOAs. Your title company should be able to tell you if you are in an HOA or the county records should reflect what they claim. Also, I believe the ccr has to be recorded when an HOA is created.

My fathers neighborhood has a similar issue. A "secret" HOA that doesn't actually exist. Funny thing is the complainers always trespass onto his property to use the basketball court, which he's yelled at them before. With your HOA's unprofessionalism, I don't see any legal documents that would actually hold up in court.

I’ve owned homes in Washington, Colorado, California, and Arizona. In those states the Clerk & Recorders Office isn’t required to send out notice of a lien. Unfortunately the person who has received a lien only finds out about it when they go to sell their property, or purchase another. Then you have to disprove the lien, then file a counterclaim in court. It’s really sad what these “neighbors” have done to Erik. Sadly as they say “Good fences make good neighbors”…

Liens are public record. Check the court house records. Any HOA agreement is too. And what HOA? Every piece of correspondence will have the HOA name and location. Like Acme Acres Homeowners Assoc. or something. And the signed HOA agreement would be recorded with ones deed. Sorry, I'm calling BS on this whole thing

Eric, I am absolutely new to this channel so I am somewhat shooting in the dark here. What I would do is to go to the County Recorder's Office and pull up every action that has been recorded on your property for say ten to twenty years. Is there anything anywhere that refers to an HOA? I'm inclined to say that if you find nothing, it's a scam. If there was an HOA, it should be referenced in the Title Report.

@@keith4154 I can't say whether this one is real or not. But HOAs are definitely real here and insanely invasive. HOA = Homeowners Association. They can control EVERYTHING -- even what color you paint the INTERIOR of your house. Only control freaks should even consider living where there is an HOA. First off, make them make their complaint to you in writing and when they simply put the letter in your mailbox they have violated the federal “Mailbox Restrictions” law, which comes with a $5000 fine for individuals or $10,000 for organizations (per offense). Next, document and report the violation(s) to your Post Master and you may even qualify for the whistleblower reward of 10 - 30% of the fine.

I would ask for the so called Hoa Paperwork you signed with your signature as well as a copy of the handbook they keep quoting from. Have them send this and future correspondence by regular mail. I would also investigate their email addresses to see if they are actually local, anyone could pretend to be an HOA. They could be using a drone to check out your property. I find it VERY hard to believe an HOA would be even involved for a property like yours. They are usually in a gated community type atmosphere.

This is just flat sad. I was a Township Trustee for 8 years and before that the President of the Zoning Board of Appeals. We had a book of Ordinances, but we viewed them as guide lines. The ZBA tried to work with the home owners to help them through the process so that they would be successful at what they wanted to achieve. Every thing from set backs, lot size, type of structures, accessory buildings, and septic systems. They are our friends and neighbors and we were elected to serve them!

The easiest way to see if there is actually a “recorded” HOA that was recorded and attaches to your property is go to the title company where you closed the real estate purchase (or realtor that represented you in the purchase) and get an official/recorded HOA documents. If there is not legally filed HOA restrictions (usually recorded in most states ho have a “clerk and recorder), then there is no “binding HOA rules attached to your property.

As far as i can tell being a homeowner myself is that the reason your neighbor is getting fined and cruicified for the track by the township is due to violations of local building and zoning laws. Not shure what the zoning laws are for the township you live in as it wouldn't be too bad of an idea to research them yourself so you know what they are (near bitter lesson learned myself in not doing that), but i'm betting he never got the proper permits in order to clear and break ground to build it. Which in a way is understandable (total BS but understandable) considering that the track being that close to the road could pose a potential safety risk to motorists and the general public that use that road, not to mention there could be potential underground utilities in addition to posing potential environmental risks that it could interefere with or potentially cause. As far as margerette and the fake HOA goes, if you can't find any legal legit documentation or information about any HOA on record anywhere i'd say screw the back and fourth and to just get a decent attorney to review and potentially persue legal action against Karen and her false claims. In the interum record EVERYTHING like you have been and present it to your attorney as the more documented evidence you have the better. Bottom line from what i can tell is that Margerette (Karen) and her fake HOA is nothing more then a hoax, scam, and a fraud to scare you out of the neighborhood and/or to scare and force you into making your property look the way karen wants it to and/or to potentially rob you of money through the use of fake fines and penalties.

Filing for a building permit also alerts the tax assessor to pay a visit. Most likely track is considered an improvement, that is not temporary in nature.

During Title signing the Title Company would have been required to provide you with the complete set of HOA documents so if you don't have any such documents, then you are probably not in an HOA. This whole thing could be a scam!!! If you know the name of the HOA, your attorney could get/sue for documents from the HOA to determine who all the players are that seem to be harassing you. Board members and Directors of the HOA may also be subject to being sued civilly for monetary damages if it is determined they have not been operating within the authorities provided in their governing documents. Be sure to save any emails, texts, or other communications from the HOA as this may help your attorney with their efforts on your behalf. Ask to have your phone number removed from their records and get a no contact order if necessary. Good luck!

Scam in a can for sure, you have no way to contact them, where do they expect you to pay! Any genuine authority would have sent notice by post with letter head and phone number. Take everything they have sent you to police and make an harassment complaint. Good luck. Love the painted trees.

There’s usually free legal representation for things like this. See if you can find them in your area. Ask them to send you a signed copy of the agreement you made with the HOA. If it’s just a paper in the middle of a stack and not initialed it’s not legit. A lawyer would help you with that

Erik, HOAs don’t send informal emails asking for money for fines. All correspondence and documentation is sent through the post office mail. Another sketchy part is that you would be informed during closing that You have an HOA and would sign the appropriate documents for that. Also I’ve never heard of 20 acre or 70 acre lots having HOAs. That’s basically rural farm land, you can do what you want.. I Have and HOA but ours is pretty chill about things, they just want money for landscaping and snow removal

Your remedy is simple. Ask questions, who is claiming they are authorized to administer private property without authority? Attach a fee schedule of 100K for every order they send notice for you to do something. Find out who Margaret is and send her personally a bill for filling her orders, ie clean up etc. Bill Margaret every thirty days and on the 90th day file summary judgement with court, add the court cost to you bill to Margaret. Administrative lien her personal property for the default on the payment of bill. Just saying...

You could also contact the attorney's office that handled your home sale, and bring them the original documents you were provided. They should have kept their own copies to compare, and ask them what they should do about old Margaret and the emails.

Eric the township and the HOA are two distinctly different entities the township most likely can regulate land use, but you still need to investigate to see if the HOA actually exists. It does not sound real. Have you been able to contact an attorney or any entity within the county or state government for assistance? It might be a good idea to do so. Good luck!

My guess is that the developer that is building the subdivision is trying to drive you out via harassment. I'd check the city plat and see what they have planned for the area. You may see the city has plans for your property you don't even know know about.

The neighbor with 70 acres there's not a damn thing the township can do about that because that's not a business he's just letting family and friends in....he's not collecting any money so therefore it's not a business....only way anyone could really say anything is if the owner had his property in a government set aside like a CRP program where the government pays them to to leave the land for wildlife

An HOA would have a letterhead and it wouldn't be sent snail mail not by email. Someone is screwing with you. I'd talk to an attorney. This is getting worse and worse. I'd want to see the bylaws. An attorney would be able to investigate and trace back and find out who the email is from . Then you could go after them for harassment. They'd be the one owing you money or they could go to jail. What are they going to do when the heavy equipment comes.

I know that I am late to the game and you probably already addressed this. However, if you really are in an HOA or are otherwise subject to restrictive covenants, you might want to check with your county's recorder of deeds and see whether any documents relating to an HOA have ever been recorded for your property.

So you've spoken to neighbors about the phony HOA, right? I think I'd want to put cameras up, facing the road, and watch for those who slow down and take a long look at your place. I might put up a big sign that reads "Margaret, please come to the door" or something like that. And you know that there are ways to trace where an email comes from....I'm not tech savvy and can't tell you how....but in the crime shows on tv they do it all the time.

Good for you. After I moved in to my house, I asked the board if I could build a carport on the side of my house. During the previous 20 years in the subdivision, they permitted many outbuildings and carports that ignored the restriction for the subdivision. The most recent organization president lived in the subdivision for a year prior to becoming president. The lot restrictions said the house had to be 20s" from the side of the lot, but your eave was not part of the set back. So, I had a friend that taught architecture at the state university. I asked him, how large could an eve be. I ended up building a 16' eave, which turned out to be a large carport, without exterior supports. When they abondened their law suit, the judge dropped dropped the suit with prejudice. its a great EAVE. Don't give up.......................

I even got a letter for lights on my trees after Christmas that weren’t turned on. I left them up to turn them back on in March in memory of my son who passed away. Lights stayed up. I’m going to use that spray paint technique. Very nice.
