I don't think that in an ideal world, that should be the case. The idea is that everybody has legal rights, but most people aren't aware of them. The lawyer is providing a service, sort of like a consultation, wherein the person becomes aware of where they stand legally. But as Amish said, the problem with the legal system in India is such that either the person gets no support at all from the legal system, or things go completely out of their control. Both of these are undesirable outcomes. Ideally, both spouses should know where they stand legally, so that both can protect their rights to live a good life. We, as a society, have a long long way to go till we reach such a state.

False. We don’t even want to intervene. It’s not our business. Agree for a mutual consent divorce or reconcile. If the parties aren’t cooperative for either, we are constrained to create grounds on the instructions of the clients.We believe whatever the client has to say as these are matrimonial facts without concrete proofs. We don’t file cases on our own whim and caprice mister. When the marriage is broken down that is when we intervene, otherwise please carry on with your married life. On many occasions the parties are not willing to keep aside petty issues and reconcile.

Exactly that's why older generation resolve the dispute with in family. No outsiders was allowed in internal matter.

Lawyers don't get paid any salary. So they will try to drag the cases for more time. The judges also are not in a hurry to finish the cases.

Good analysis by Amish. Moral of the story. Never go to lawyers for fixing marital problems. They are incompatible to solve marital problems. Any lawyer reading this comment don't take it to heart. Your profession is a bad omen for material issues.

No that's is just one side. I have seen cases where the troubled wives get a good maintenance amount from the troubling husband and they get remarried into a happy life. All these happens only because of good handling of the case by an expert advocate.

Instead of going to your lawyer friend, go to a marriage counselor. A lawyer has no background to fix a marriage. Fixing a marriage is not a legal thing.

@@soumyapawar8125 Soumya ji, that may be true in number of cases ( and it is saddening ), but none of those things are enforceable on a woman in the eyes of law. No civilized man would force his spouse to do any of those things, yet he can be destroyed by a mere accusation of the same. there are govt bodies / entities dedicated to ensure that the man is prosecuted guilty or otherwise... again, on basis of a mere accusation... can you list one govt body/ dept dedicated to protecting men from such monstrous women ?

Sure there are always false accusations against men but that doesn't dismiss the rights of those women who have the courage to get out of abusive situations and take action. Only a very small percentage of women these rights are made for put them to use. Otherwise a culture of tolerance and sacrifice encouraged in toxic Indian society.

But the law must be unbiased and unassuming. currently men are assumed guilty as charged, until proven innocent. this is the problem. civilized men can not get this fear out of their heads, if this continues how can two people ever live peacefully in a marriage, knowing one of them is always under the protection of biased laws.

Hi Sachin, you do such great work.. I love to see your explanations after every video. However one difficulty I have in sharing these videos with my not-so-fluent-in-English friends is that the explanations themselves are difficult to comprehend! 😅 For example, they would have to refer to a dictionary to see the meaning of 'fabricated' Perhaps you could substitute such words with simpler words like "made-up stories" Or, with your consent, I'll reply every time with alternate explanations myself..

This is exactly what happened in our case. Was a very minor issue. Our bhabhi's lawyer drafted a shocking complaint at CAW cell after which we decided that reconciliation is not possible.

Many money minded Lawyers dont have any background of relationship science and relationship counselling they handle the situation badly ...I wish modi and Amish must introduce pre marriage counselling for families to sustain and also premarital agreement as book written by Amish ...we need to start a movement for this in India .

Putting CCTV camera won't help, recently a high court dictated that since the recording was made without the wife's consent, it is inadmissible. This ruling came for a call recording, but Footage from CCTV camera will probably be subject to the same ruling. Just don't marry.

this is very true, my mams got married few years back And there was an understanding with his wife's father that she will leave her current govt. school job and move to the city and find a job most likely in private school in patna, Her father got her ready that she can take few months leave then join again at her job and my uncle will probably adjust and understand then - long story short that didn't happen. She got into fight with my uncle and left for her father's place who filed a dowry/harassment case to intimidate my uncle's family , my uncle, granduncle, grandaunt where in lock up for a day and have to attend multiple sessions, later on the girls father tried to reach out to my father to help settle this issue, but now my uncle's family is not interested at all. my uncle is now okay with staying separated or getting a divorce. one thing it's missing in the video is that police doesn't minds humiliating you in front of your house, and considering like 100 of my uncle's relatives live in the same colony it was mortifying for his family.

Very well said bro but in the end what most lawyers and officers dont somehow get is the fact that one day they will have to give an account to a higher being. Ive also seen lawyers dying terrible violent deaths.

Most lawyers are unethical and they complicate and delay cases. Most take up too many cases and don't know the matter and are not prepared enough. Just keep taking adjournment where the lawyers of opposite parties are more cooperative towards each other rather than their clients

And u didnt tell what serious allegations are levelled in complaint by the wife....most prominent are unnatural sex, impotence, rape attempt on father in law or brother in law, forced abortion, domestic violence, dowry etc this is pure legal extortion. Anti Men laws in India make it impossible for men to seperate peacefully with wife. Either live with her unjust demands or give ur life savings as alimony

I n my entire family including married sisters, uncle staying in different city fighting this false cases of 498A, 323, 504, 506, 34 ipc n sec 12 dv act extorting huge sum inspite she being IT employee earning way more than me has shown unemployed n courts n law r designed to support women n no one listens to men

If you are at a point where a 3rd person, an outsider has to interfere to reconcile or negotiate or whatever, then your marriage is already in shackles. Do yourself a favor and don't stretch it to the point where it gets this ugly. Get some space, get some time away from each other, see if you can still make it work, if not, just get off the boat, it's not going where you would want it to go.

Women are truly brutal and cruel. They dont care about a man's pain actually. I recently watched videos on this youtube channel "Toxic Dating Coach - Mindful Attraction". In the comments I was shocked to see how easy going women are to a man's pain. They are absolutely nonchalant and irrational. Just look at Depp & Amber Herd case. How cruel she is.

Well, if there need to be an open discussion, you can involve parents from both sides. If one side is too adamant then there is no point to the marriage anyway. A lawyer need not be involved in such discussions. If someone does want a divorce, then it's all fair game.

But because of Caw officers it backfires even if it is a harrassing wife and of course marriage is broken and also in other cases marriage is broken. First of all Wives shouldn't go to police at any cost and even if marriage doesn't work later take the divorce mutually and not this way. There are many ways something bad could happen but that does not mean you go and do bad first. Yes a lawyer will definitely suggest that but you must know this atleast. There is a line between being careful and playing who's better.

First of all government or judiciary is being unfair here, for not allowing a lawyer in the CAW hearing with the husband. In any other country, lawyers are needed to be present during any hearing or interogation etc.. inorder to protect his rights. There is no justice for men in this InJustice system.

Basically lawyers spoil it and make it a one way road for both parties. Poor guy is threatened for false / exaggerated clauses against him. Thereafter, he decides if this is what my wife wants then lets end it.

I love this video...he wonderfully explained how it's not completely anybody's fault. Imagine going to the police explaining how your husband doesn't beat you rather he uses narscistic ways to harass you, mentally torture, what you'll gonna do about it. He will has his way even with the minor beating or some other form of assault and mind you there are numerous ways he can literally assault you and you won't be able to tell anyone or do anything. I understand why lawyers feel the need to exaggerate (excluding the bogus ones). At the same time i also know for sure some women's ability to amplify issues for there personal gain, i mean we are all aware of amber heards of this world by now. The thing with law system is, as i understand, it takes on issues at a point of time 'oh he did that, but it was so minor why did you react that way' all the while completely ignoring the actions over the course of time. If somebody does something minor but everyday, it going to be amplified for the person at the receiving end of it. I think the system needs to change so that women can get resort even for minor issues as well, like counseling or something before full blown complaint. Also its not just in marriage dispute but in almost every issue, a person might feel the need to sugarcoat in fear that people might not believe them. This world is definitely no fairytale!

Hire a lawyer who takes full payment in advance rather than someone who charges a little every hearing. Remember it's a win-win situation for you and your lawyer. They get paid at once and prefer to finish case early instead of unnecessarily extending! A lawyer can make or break your case.

I frankly cannot agree with this lawyer's justification of why the lawyer is correct in this behavior; he could just have told her about the entire process at the beginning instead of breaking the marriage to scam her with money. Not only that, he is actually violating the law by lying to the court and encouraging her to do the same.

@Jedi Kickass not really, sometimes people are so unhappy or even genuinely suffering in marriages that they actually bless you for helping them get out of it. Not all cases are the same. In rare cases divorce actually gives unhappy people relief.
