Hi Steve, great content! Just a quick question, we do not need to do ANYTHING if we have a Mavic Mini? (Except not flying in unauthorized or controlled airspace)
@SteveCoutts4 жыл бұрын
Thanks. The Canadian RPAS (remotely piloted aircraft systems) regulations apply to drones from 250g up to an including 25kg, hence the Mini does not fall under those regulations. There is one general rule that applies to all RPAS and the gist of it is do not put people or aircraft in danger. Other laws like you can't fly in a national or provincial park still apply as well as local laws and/or bylaws, which may restrict where you can fly. But yes, you don't need a license and you don't have to adhere to the other RPAS regulations like maintaining flight and maintenance logs. Of course, I am not a lawyer nor an authority on this subject matter so I would take the time to read the drone safety laws federally (www.tc.gc.ca/en/services/aviation/drone-safety.html) as well as locally. Cheers!

No. Those were the rules at the time, which have changed, but even so, it's not quite that simple. "Outside the rules" is Transport Canada's words, not mine, but it does make it sound like you can do what you want but that is not their intention. You would still have to follow the drone regulations for a similar sized drone and you would need the same authorization in your home country for what you wanted to do in Canada. And, applying for an SFOC doesn't mean you're going to get one. I believe rules changed last year that would require a foreign operator to pass the Canadian RPAS exam for >= 250g sized drones. Sub-250g may get an exemption but it's not entirely clear. Best bet is to contact Transport Canada if in doubt. Cheers!

Great summary of the new rules. Well done. 🙌 One big issue is that many drone owners - and many people thinking about or actually buying a drone - have no idea that these rules are in place. Transport Canada, the drone manufacturers and retailers (including online retailers) need to cooperate and collaborate on informing every person *before they buy* of what the requirements are. I was flying the other day with some coworkers and every one of them said they are going to buy a drone. I tried explaining the certification process to them so they know what they’re really getting themselves into. It’s certainly not for the average joe who just wants to fly and shoot for fun.

Hoping you're the man with the answer to that one 😁👍. Oh, and thanks for such a great video!
@SteveCoutts Жыл бұрын
Thanks for the comment Jorg! I pretty much exclusively fly sub-250g now so that particular rule doesn't apply to me. If you're following the rules to the letter technically you shouldn't be flying the air 2S below 0º Celsius because it's outside of the spec for the aircraft. However, I am sure many Canadians fly it beyond specifications. If I was flying a larger drone I would probably do the same. It's Canada. Winter is long, cold but aesthetically one of the best times to fly. The prime objective with the Canadian drone laws is to protect people, property and aircraft. If you are flying responsibly, being mindful of those objectives and otherwise within the rules, I seriously doubt you will run in to any trouble. Of course though, that is a choice you need to make on your own. If you do plan to fly in colder temperatures be very cautious. I recommend keeping the drone nearby, fly gently and keep a close eye on the battery. Cold temperatures and batteries do not mix so battery life can be very unpredictable. Always leave extra room for error and make sure you update your home point continuously if you're moving around. Winter flying is fun and rewarding but it does carry extra risk. Fly safe! Cheers!

Thanks! As a "foreign operator" you would need to apply for a Special Flight Operations Certificate (SFOC) regardless of you flying recreationally or some other purpose. Kind of a hassle I know but if you want to fly on the up-and-up that is the process. Good luck! 😀

I'm from Germany and bought a drone here in Canada. I've learned and passed my basic exam with 74%, but I didn't realize that I also need to have a drone certificate in my home country 😅. So I had to repeat all the paperwork and test again for the EU laws. Luckily that was way easier than here in Canada, so I did that exam on the same day, without extra studying. I'm just waiting for my drone to be registered in Germany, to then apply for the SFOC. Definitely my fault that I didn't do my research correctly, but I wished everything would be a little bit simpler and easier to understand. Can't imagine how difficult it is to get the advanced permit.

Thanks for sharing your experience. The rules for foreign operators changed a year or so ago and it did get more complicated. Good for you for navigating it and getting it done. For Canadians, the path of least resistance is to fly a sub-250g drone. You don't have to register your drone or write a test and really only one rule applies, which is basically "don't be stupid". When I made the video, non-citizens only option for flight in Canada was an SFOC. Now "foreign operators" need the Basic RPAS (or Advanced) certificate to fly plus an SFOC. That's a lot. Is this something required for your job? You think there would be certain exemptions for certain commercial activities, especially for companies operating on both sides of the border. I passed my basic RPAS but when the sub-250g Mini came along I started flying it, then the Mini 2 and never looked back. I love the near frictionless flying that sub-250g provides. Welcome to Canada ...the country that prides itself on over regulation and nonsense laws. There are other new rules that make it impossible to fly anywhere without breaking some rule or other. The regulators that allowed this nonsense to come into force should be prosecuted; no citizen should ever be put in a position where he is breaking a law through no fault of his own. And the fines...you don't get those for drunk driving...wtf
@SteveCoutts3 жыл бұрын
If the rules are causing you too much friction, go sub-250g and the only rule that applies is 900.06, which states "No person shall operate a remotely piloted aircraft system in such a reckless or negligent manner as to endanger or be likely to endanger aviation safety or the safety of any person." Of course, there may be some local restrictions in larger cities but generally sub-250g is as frictionless as it gets. Cheers!

the government: Oh you just made some hard-earned money? There's a tax for that. And you also happen to have a hobby? Well, you have to complete a course and apply for a license. And yes, there's a fee for that, which means there's also a tax for the fee.

Can i upload drone footage from mini 2 to a KZbin channel i am planning to create. I dont have license or its not registered since its under 250g. The footage may contain flying over moving traffic..Parks etc..
@SteveCoutts3 жыл бұрын
Transport Canada does not distinguish between recreational or commercial flying. So as long as you follow the rules you could upload your content and make money with it, if that's your intention. The only rule that applies to sub-250g drones is regulation CAR 900.06, which states "no person shall operate a remotely piloted aircraft system in such a reckless or negligent manner as to endanger or be likely to endanger aviation safety or the safety of any person". National and Provincial Parks are pretty much 100% no fly zones for drones, period. Doesn't matter if it's sub-250g. Flying over moving traffic may be ok but if you're in a larger city centre their may be specific bylaws forbidding it so it's best to check local laws too. Good luck! Cheers!

Hi Ronald. In your case you would be considered a "foreign operator" and there are specific requirements for that. You can read all about it here - tc.canada.ca/en/aviation/drone-safety/drone-pilot-licensing/get-permission-special-drone-operations#foreign. I read it over quickly and it seems like you do need to acquire a Canadian drone pilot certificate and possibly a SFOC (Special Flight Operations Certificate) too. On top of that, you must also have the same authorization to fly in your home country. Seems really complicated. If you have any questions I suggest contacting Transport Canada directly to make sure you do things correctly. Good luck!

Sadly, you CANNOT fly in Banff National Park or any national or provincial park, even with a sub-250g drone like the Mini 2. cold weather drone flying outside of the manufacturers guidelines is ok IF you can demonstrate it is still safe to do so and all normal regulations are still observed with the exception of the temperature ... so when you log your cold weather flight make sure to include a review of flight performance and any regulations NOT adhered to ... and what safety precautions were implemented or circumvented ... essentially prove in your log it was a safe flight below manufacturers specified limits but within operational flight safety and regulations otherwise.

Have you ever been questioned by any authority while flying your drones? I have just got a mini 2, and it seems like I am exempt from alot of these except the 122M height restriction, although it's not very clear on that. But I guess I can fly over bystanders and within 30M?Line of sight is another one, it can be 400M away at 120M and it is literally impossible to see so is this breaking the rules technically? Obviously the one that makes the most sense is stay out of controlled airspace, which is a no brainer. Just wondering if you have ever had to prove yourself to any authority, I would hope that as long as your flying safe and with common sense the law will leave you alone, but I would rather be prepared then pay a 1000$ fine for flying something that weights less then a bird.
@SteveCoutts2 жыл бұрын
I have never been questioned by any authority while flying. Technically the RPAS (drone) regulations only apply to drones 250g up to and including 25kg, so the Mini 2 does NOT fall under these regulations. However, one rule applies to all RPAS - 900.06. This rule states "no person shall operate a remotely piloted aircraft system in such a reckless or negligent manner as to endanger or be likely to endanger aviation safety or the safety of any person". So even though technically you could fly your Mini 2 without worrying about line of sight or altitude restrictions, by doing so you may break the spirit of 900.06 and be subject to fines should you be quizzed by authorities. That being said though, I have yet to hear of a drone pilot in Canada being fined for negligent behaviour. Provincial and National Parks are a BIG exception though. I have read about fines being levied against drone pilots for flying in Banff National Park. These parks are strictly no fly zones. Honestly, if you fly your Mini 2 respectfully and with common sense you will probably never have an issue. Cheers!
