Now that all the Bellwether trials have concluded, the Judge( who is also a veteran herself) Has ordered trials of 500 veterans at once This is a massive ordeal since now all these cases have to be prepared for trial and I Think 3m doesn't have the man power to handle this herculean task Hopefully a settlement will come out this year. . Finally after waiting years.

That 500 is only the first wave. Another 500 cases have also been remanded. I don't think it's so much the manpower, but whether 3M wants to gamble on favorable verdicts and appeals.

Unsure at the moment. A lot of that depends on where the cases go after the bellwether, and whether Judge Rodgers resolved them in the MDL or they are resolved in the bankruptcy court.

Approximately how long will it take for any updates if your case was transitioned from Administrative docket to the Active docket? Is this the 500 cases Judge Rogers sent to the diff federal courts? If so, could my case actually go to an actual jury?

If you are in the initial 500, it is possible. Check with your lawyer.

What is the likelihood of actually earning anything significant in regards to compensation? Also how does it work for National Guard? We only have DD214’s for Title 10 orders. We can supply documentation of orders not Title 10 but will that suffice?

You can use other documents to show National Guard Service and describe when you used the earplugs. As for how much in compensation, it is going to depend if 3M wants to settle, and how much money they put up.

I receive VA compensation for tinnitus, I served in the Marine Corps from 04/08. Did I have to be in combat to qualify?

Not necessarily. You have to show that you used the specific type of earplug to file a claim.

Due to having a clearance, and orders going overseas for deployments that were data masked... My DD 214 is inaccurate, thank God I still had my official passport... So I was able to show being in Columbia and Turkey. I did scan my passport and send it to my lawyer. And let them know that my DD-214 was inaccurate. All of my orders that I have, show "data masked".

Interesting. I think the purpose of the DD-214 is to show that you served during the time that the earplugs were distributed to service members.

currently still serving, (reservist) , service connected tinnitus since last year . used these in training in 2011-12..no deployments no hearing loss I replied to one of these adds about the 3m lawsuit in November and haven't heard from them since...just looked at agreement they take 40% can i drop them and have you represent? wonder if i will even get anything out of this

Do you have your records showing your tinnitus? It is certain worth pursuing. Some states do allow 40% of the settlement. As to how much you will get, it is going to depend on how much money 3M puts up.

At this point, it depends on the proof that goes in at trial, and how the jury reacts to that proof.

Great video, thank you for the update. If 3M settles and the 300,000+ gets a settlement, will everyone get the same amount? Or will a vets case that had exposure from training, combat, and artillery (and is diagnosed with tinnitus or hearing loss) get more than a veteran that just had training with the faulty earplugs? There is likely going to be a sliding scale based on the percentage of hearing loss and existence of tinnitus. There may need to be an aspect of proof as well.
