The prosecutor has an attitude on her. She has to win every little argument, & get hers jabs in to show that she’s right and everyone else is wrong. The judge would give his ruling & she would immediately start gaslighting him.

For the text messages, I’m afraid the weaker examples are shown. What’s left out from the clip is the strong evidence that supports prosecution’s position that this is his phone. On the full court recording there are several messages where the person texting calls the other one “ma” and the other person responds “son”. The argument that a phone registered on the defendant’s name was also commonly used by others was quite bizarre and unreasonable behavior, but anyway after these texts it’s completely refuted.

I watched some of the trial, and have been following this case for a minute, and I remember when the news first came out of sak and juvy being shot. I think he did it, the stippling pattern imo was the most incriminating thing for the case. The phone records seem like it could really nail melly, but the prosecution has left so much reasonable doubt on the table that they've basically made a the phone evidence obsolete. They've really fumbled the bag week 2.
@viTuxk
@viTuxk Жыл бұрын
Yes your right about the messages but that is well after the murder, not to mention that phone was hot potato there were others using it, that make it very hard to prove that it’s only mellys phone. What prosecutors fail to say is that there is no fingerprints from melly on anything from the vehicle initially, then convenient enough just weeks ago they ran tests again and his prints are there.

The prosecutor is even lying to the judge!!! She is not a reliable source of information, period! Of course they found his DNA 2 and 4 years later on the door handle. The opening statement from the defense attorney is still burning in my mind.. The fact a completely different set of officers from the sheriff's department had to redue the case is completely mond boggling. I feel for this jury because this is a lot. There is so much on the internet about this it's crazy. In court it was stated they are still investigating to this day i mean 🤔🤔🤔 WTF!

But the prosecution had all this time and got no actual hard evidence. All of their arguments and “evidence” are based on context and likelihood. Literally the best thing they have is a text, a song, & phone records. And DNA that they suddenly happened to find on something that they didn’t find before. 1 month before trial… like these are not things that at the very least would get him the death penalty. There’s an insane amount of (legally/in court) reasonable doubt in this case so far. Even if we “know” or think this happened that is not enough at all to reach conviction much less a death penalty. In the court of law it always has to be *proven beyond reasonable doubt.*

The prosecution has had couple issues and so hasn’t the defense, it’s funny didn’t mention the judge telling the defense he don’t want him going on and on over same subject to spend all day on same thing few days ago, also the judge did tell the defense that he sees the phone as Melly since he’s texting his mom , calling his mom , pics , messages Gf , etc. The defense has fought for months to keep these phone records out of court for a reason the phone is key evidence and the bullet holes inside the car is key evidence, there no way the bullets outside made them holes in back passenger seat from how the grouping of holes are in the seat. It’s either someone reached over and shot close range or driver turned around and shot at close range making that grouping of holes. Most people who has firearm knowledge knows the bullets outside can’t make them holes in back passenger seat etc. This trail is really going pick up for State and Defense in upcoming weeks. If you think about it, they been talking code throughout the messages this whole time. What if “Ma get me a Glock 45 or 19 ” (MEANING HE HAS THE MURDER WEAPON and wants to give her the gun) She then reply’s what’s wrong I got your 45. He then says “I don’t want no illegal gun” (MEANING HE has a gun that he just killed somebody with. “Ill pay you”, “When you get down her”(Meaning he’ll give her the gun”) “I’m waiting for track to send me 1000$” (Since he was dropped off or picked up by track, he must’ve been the one handing it over”

Keen observation. The problem is that would be a custom or personal code that, even if decrypted correctly, couldn't be proven since there's no reference set to validate it. That being said, that's a really good theory that I'd assume the investigators missed. Not sure what they did to find the gun, but putting pressure on his mom might have given them some useful information if you're right.

I'm for the DP when appropriate. For instance, the murder was witnessed by someone who is strongly believable. BUT, this new law is terrible!!! The jury's opinion is supposed to be the truth so if they can't agree in full then life without parole is more appropriate. Just IMO.

@konstantinos4529
@konstantinos4529 Жыл бұрын
To prove a murder (or any crime) you need to prove the elements of it. Motive is not one of the elements of murder. However, if the motive is participation to a gang, then they prove the aggravating factor to justify the death penalty. Which I don’t fully understand as in most States, multiple counts (here two counts of degree 1) is already a capital aggravating factor
