You agree to it when you purchase the house. I purchased a house in an HOA and the covenants were clear. I have no empathy for them. Having it for 10 years means they've been in violation for that time.

@@dtxgmoneyThat is the part that people don't get. People don't buy house and then later find out some HOA take over; they buy a home agreeing to a covenant with the HOA and fellow neighbors. Rules are rules and if they don't like it they can buy somewhere without an HOA. Not sure how this is even worthy of being in the news.

Some new busybody to the area must have spotted the gazebo while on patrol, they like nothing more than making trouble for everyone else, I'm surprised they did not check out their t+cs as everyone knows you need permission to do more than breath in a hoa.

A bit late but... There is a Nevada State Law that states: If an HOA takes no action for 90 days on any “unauthorized” structure etc. The change is approved de facto. Surprised the mediator did not mention this...

Not sure how this gazebo devalues the neighbors' homes or the community overall. Seems to me that this was probably instigated by a neighbor not liking what these folks have in their backyard or (for whatever reason) just not liking them.

The HOA before it didn’t have boardmember, so who stuck their nose over the fence line, committing, visual trespass !!! In to Private Property.

What the heck is a visual trespass? There is no such thing. It's obvious that Gazebo is visible from the street since it goes above the yard fence.

@@diegolara4202 Unlawful surveillance , Private property, owner writes and freedoms beyond the jurisdiction of an HOA. HOA cannot override constitutional rights and freedoms as they do not hold any political or government positions , board members are not required to have any vacations more than a soup can ! Whether it is in public view or not. Especially if it is a non-threatening , hazardous or offensive sign, structure or other while on private property and not obstructing any public road or pathway.

@@Moonbatcrazy nothing you said made any sense. If anything is visible from the public street then it is not a violation to look at it. Just simply looking towards someone used from public view is not a violation. You just made things up and made no sense at all.

Visual trespass in some HOA neighborhoods is walking or driving with eyes open . I was told not to look at others homes and lots I was admiring a shade cloth in neighbors carport and wanted to put up one but informed no and don’t look at other neighbors property .

Once it’s visible from the front street, You are in the red zone. Maybe these people should ask HOA to relocate the gazebo so it is not street visible. HOA are really strict on how the street look as it was built.

Pretty standard in hoa rules, you need approval for any structure or landscaping. Doesn't matter if it's 10 years ago.

Standard today but most likely was an amendment to the HOA rules. The gazebo was prob considered a temporary structure back when they put it up and didn’t need approval and i bet now is called out explicitly as needing approval.

It does matter. A man had a horse trailer for 13 years and had 13 yrs of photos to prove it for each one of his daughter's birthdays. Just so happen a board member came to give him a notice for weeds that weren't even on his property and looked in the backyard when the man's daughter came to the fence from the backyard. The trailer wasn't visible from the street and the bylaws stated that it wasn't supposed to be there. They started fining him for it. He took them to court and won bc they had never enforced it and the pictures proved it. He sold his house a few months later. They can't start implementing rules if theyre not doing it from the very beginning..
