Because no one thought of the kinder egg until pretty recently, the law was never really revised. Thankfully it's been looked at and kinder eggs are now legal.

The candy hearts surprised me the most for sure. The thing about the candy hearts is just insane! I mean it’s up to the parents on what they want their kids to eat not the children’s teachers. Personally I think that school may have gone a little too far. It’s not like there is poison in the candy. I mean it’s okay to eat one box of tiny candies on Valentine’s Day. Yes candy may not be the healthiest food choice but one box couldn’t hurt.

Just going to say this, as an early childhood professional. No kid is going to mistake a toy for real food, especially if they know it’s a prize, unless they’re impaired in some way. The concern is more for the fact that very young kids(almost never over the age of four) enjoy the textures and feel of non-edible items when put inside their mouths; swallowing is almost always an accidental outcome, usually after enough saliva builds up. In which case, it’s baffling that a parent would give their toddlers tiny toys to begin with. No incidents with young children choking on kinder egg toy parts, from what I’ve read, have happened as the child was eating the chocolate shell; but later on when playing with the toy. Know your kids; and if they’re still mouthing toys, keep choking hazards away from them.

Actually unless I'm mistaken the snorting smarties was called happy crack and it was a thing about 10+ years ago just about everywhere it was made by crushing Smarties and mixing them with pixie sticks.
