Last vehicle I sold was 14 years old, over 150k miles. Couple showed up in a Uber, cash in hand. They started the car and he looked under the hood, I don’t recall him checking any of the fluids, she checked for engine light. All they wanted to know was how the sunroof worked and how to hook up the Bluetooth. Lol 🤣😂 No test drive.

I did not test dive my last 7 vehicles and I’ve been fine but I also gotten them from the dealership new and used so I always had a warranty but thankfully I’ve never needed to use it.

I guessed - after 60 seconds, when the "chain" issue was mentioned - that the plaintiff was a fool. Then he admitted that he never even rode it before buying it. I started my own used car lot last year in October. I am amazed at how many people want to hand me thousands of dollars without ever test driving the car or even looking under the hood. I'm a professional mechanic so this seems so ridiculous to me but I guess too many people just don't know anything about cars. I will not sell someone a car without them test driving it and I always suggest that they take it to a shop or have a friend with mechanical experience give them a second opinion as well. Almost no one does that one though. I can't find every issue with a used car and I sure don't want to sell someone a problem. But it seems as if more people than I would have ever expected just rely on good luck.

@@1967davethewaveI watched an episode of the peoples court yesterday. The used car dealership was being sued for a lemon car. The manager of the car dealership told the judge that about half the people that purchase cars from him do not test drive the cars. The judge basically told him that she didn’t think that was correct and he was lying. I figured he was probably being truthful and your comment just verified that. What is wrong with people?!?

The man didn't want to drive it, he just wanted to buy it. The wife thought driving it would be a good idea. At least one of them had some sense!

@@1967davethewave 30yo kid I worked with didn't know where his dip stick, power steering, brake fluid, washer fluids went, thus, they were all empty. As I'm sure the radiator was as well. I keep all of those items in the trunk of my car. I filled him up and he left knowing how to do it himself. ❤😂 BTW, I'm a 64F.

That is bizarre…wouldn’t you want to feel how comfortable the seat is at the very least? Next time, bring a mechanic with you to check out the bike. Or make a stipulation on the bill of sale, that the sale is contingent upon an inspection by a licensed mechanic.

@@JohnnyEnrico What are you on about? It isn't a "as is" sale if you make a contract which has conditions like "sale is contingent upon an inspection by a licensed mechanic". You confused about what the minimum conditions required by State law are of a vehicle sale are ie the "as is" laws - vs a private contract between two parties which adds mutually agreed upon matters which takes this outside the "as is" minimum conditions. If two parties agree upon such a contract its basic contract law at play not the specifc rules around as is sales. It pretty basic logic and law and not sure why you're struggling to understand this.

Anyone that was ever an actual bike rider like myself would have took 5 min and tightened the chain before a 40 mile drive....I bet it blew off on the way home...nothing wrong at sale but a loose chain...if you can't or are ignorant to how to Tighten the chain on your own bike you have no good reason to be trying to ride it

The biggest issue was that there was EPOXY holding together one of the cases. That means there as prior damage that had been repaired. The only issue is whether this was hidden damage or not and plaintiff can't prove that. Maybe it was an old repair and defendant was not involved since he was SECOND owner not first owner.

As soon as the plaintiff said he had seen that the chain was lose, he had lost his case, it's an AS IS sale and he bought it knowing the chain was lose so should have had it tightened immediately before riding it 40 miles to his home. Had he had a mechanic look at it before he paid for it, he could have saved himself a lot of time and money, but I bet the mechanic would have said 'the chain is lose, don't ride it until it is tightened' and nothing more and the plaintiff would have driven it home anyway...

The plaintiff should have argued that the defendant was deceitful and hid damage that he should have disclosed. You can’t claim the bike is good condition while you know that there is major damage that is hidden. Problem is he would need to prove that the defendant knew and therefore it was fraud. The mechanic could have testified that it looked like a recent repair or something to establish the defendant knew there was major damage.

If you're going to own a bike especially a high horsepower sport bike they always are chain driven and the chain stretches with use and the sprocket wear . The both need to be maintained .The chain needs to be aligned, tightend according to specs, lubed and sprockets should be inspected and replaced if the teeth are sharp. A dry chain can heat up and break too

Never buy a bike that's sat unused for over 6 months. The pipes carb up, too much oil settling happens, the gasoline needs to be changed, oils need to be flushed or you will have big problems.

Another thing that I will never understand on many of these cases is people buy an old used as is vehicle and they don't have a mechanic check it out beforehand but the next day they will take it to a mechanic when it has problems? If you can afford to take it to a mechanic the next day why not do it before you buy the vehicle to save yourself money and a huge headache? The plaintiff says oh well it would have been a big job it takes hours to take the motorcycle apart... okay then that's what has to be done in order for you to be sure that you're buying a decent reliable vehicle if you don't want to go through that inconvenience don't buy it!

The defendant's demeanor gave me the impression that he knew everything about that bike's condition and got away with a scam. The plaintiff did not exercise his due diligence and got what he paid for by going the cheap route.
