If he's gonna be punching cars while moving then he shouldn't expect much sympathy from police. They can argue that punching a car while moving can make you lose your balance. I would never dream of punching a car while riding my ebike.

I drive a lbw van. I “picked up” a cyclist just after I let home today. He was riding quite swiftly, between 20 and 25mph. He seemed to be going the same way as me so I was happy to shadow him as the road was busy. I shadowed him for two miles before I deemed it safe to overtake him, safe being 6ft in my book. He was aware that I was there and probably realised I was holding back because of the length of my van. It cost me probably less than a minute in total lost time but better I lose a minute than lose him a lifetime.

@@dappa9996 Cars kill people, bicycles rarely if ever do. They are not required to follow the laws that cars are; for bicycles it is guidance, like how if a pedestrian crosses when it is safe to a cyclist can do the same Of course there are plenty of cyclists that aren't safe about it but then that only leads to trouble if both car and cyclist aren't safe about it. Put your ego to the side mate. Maybe it might be a slight inconvenience for you, which you can easily make up, for them there's far more on the line

Yes. Victim-blaming at its finest on display. I expect she has no road awareness anyway (from what we've already seen, also with all those decals blocking vision through the rear windows. She just has no concern at all for his safety. With that attitude, the Guinness rugby shirt, and obvious lack of driving nous, she ought to have been breathalysed. It is well known that police officers are recruited for low IQ too - just to follow orders unquestioningly. I wonder why she felt it okay to park on double yellows and then conduct a conversation in the road instead of on the pavement. Actually, the cyclist was almost as bad but edges slightly ahead on his moral high horse. Whenever there is an accident I believe the accident is meant to be reported immediately to the police for them to attend. And usually it is stipulated on the insurance policy to notify them too. So her refusing to give her details shows contempt for the law no matter what her godforsaken point was she was trying to make. It's because of these types of road users that everyone's insurance premiums go up. She wouldn't have driven like that in a driving test or she'd have failed by major faults. It's time she should have her license revoked and ordered to take a re-test.

Definitely not an accident. When you intentionally try and punch a moving vehicle that takes a degree of thought and planning. The resulting loss of balance from doing so and consequently falling of the bike is purely your own making. Anyone knows that a lateral punch will transfer your centre of gravity (not recommended on a bike) Nothing about this is accidental and the injuries and damages incurred are of his own making. The police came to the right conclusion.

I'm extremely confident she is an Ex-Police Officer. It's precisely why no action has been taken against her. I'm sorry to say. That when a Police Officer finds themselves in the wrong. It's often the standard procedure for their colleagues to close ranks and protect them. It's an unwritten code of the profession. Officer's who risk not complying with that code. Risk being alienated from their colleagues. The IOPC is also complicit in this unwritten code. And as a body that investigates the conduct of the Police, it's a joke. As there's that's actually very little about it that's independent of the Police. Given that the majority of complaints made to the IOPC are actually investigated by the Professional Standards Departments of the actual Police Forces the complaints are made against. With only very minimal oversight by the IOPC. In other words. It was almost certainly also Cheshire Police who investigated and ruled on his IOPC complaint against Cheshire Police. He rightfully succeeded in his insurance claim. Because that's the one part of this whole affair. Over which this Ex-Police Officer and her ex-colleagues at Cheshire Police had no influence or power over. He still has an option left available. If he's willing to finance it. He could seek a private prosecution of endangerment and assault against the woman. There's extremely little her ex-colleagues could do to protect her against that. She'd be on her own. As private prosecutions are conducted and decided upon entirely by a Magistrate. I'm not a lawyer. But with the evidence he has. I think he'd stand a good chance of succeeding in a private prosecution.

Huh? But when did the roadrager assault the woman? All this is, is criminal damage from deliberately slamming into the car after she overtakes the roadrager and he's like "My blocking of the road failed! Revenge!!" You can't assault a car, only a person. If you deliberately slam your bike into a car and damage it, that's called criminal damage, or sometimes vandalism depending on your local jurisdiction.

Karens and muppets everywhere my wife would say. Ex policemen are the worst for calling their old mates on the force and getting it smoothed out under the table so-to-speak. There is a very powerful unwritten rule within the force where they will go to great lengths to defend their associates, even at the risk of being seen as wrong, or showing bias. This type of behaviour has to stop, in the real world when you make a mistake, regardless of who you are, or have been, we should all be prepared to admit that mistake and make amends.
@lunarfusilier1

The root issue here is the car driver’s sense of superiority over the cyclist. The police comment that the cyclist should stay out of the way is just plain wrong. Fortunately the highway code has updated to address the fallacy that there is a hierarchy of road users. The car driver was absolutely in the wrong because she failed to show proper consideration for a more vulnerable road user. The lack of action by the police in this case is a serious failure. We all have a duty to protect each other on the roads.

The cyclist sped up to race past the car instead of slowing down or move over and not be dumb by risking what could have been a much more horrible chain reaction of accident by other motorists coming up the road. . Now that we pointed out the cyclists faults and options, lets start with one main thing not mentioned... HOW could the car driver have recorded cyclist on impact unless she had phone in hand whilst driving ??? but in reality all she had if there was dashcam would have been the cyclist using the road he was allowed to in front of her and the cam would show her veering over towards the pavement before getting by and being clear of the cyclist. . That’s why I have started following your channel, someone with common sense and a fair analysis from both points of view. Late reply but as a hgv driver and car driver I have always disliked some cyclists attitude, that is, until recently I decided I would cycle to work, what an eye opener, I’m way more patient and allow more than the minimum safe distance, however I also try to make it easier for traffic to get around me. An example would be when there’s no way they could get around me safely rather than forcing them to sit behind me at 15mph ish, I will nip onto the path to allow traffic to safely pass then move back to the road, unless of course there are pedestrians. SOME cyclists cause themselves issues, MOST car drivers cause everyone issues and the occasional HGV driver should not be driving a HGV. Nobody is infallible however we should all work together to ensure every road user gets to their destination safely.

My friend got pushed (deliberately) over on his bike by a person starting to cross a road as he cycled through a green light. Turns out the person mistook the lights for being red and decided to take violent revenge. When their mistake was pointed out, they sort of apologised and hurried off. While my friend let it go initially as he wasn't particularly hurt and his bike was ok, but after he checked his backpack, he realised his laptop had been damaged and so decided to report it at a nearby police station. The officer at the desk told him it was an assault and that they would be taking action. But then he saw the guy who had pushed him over in uniform in a room behind the desk. He informed the officer at the desk and he left to speak to the man my friend had just identified. A few minutes later he returned and told my friend that he'd made a mistake, and that this didn't class as an assault, but rather a traffic offence. I'm sure that woman is a former police officer as the actions from the police in the face of clear evidence don't make sense. …unless they are protecting someone. It happens. I give cyclists plenty of space when driving, and when on twisty country lanes, I hang well back, tootling along until safe to go past. The Highway Code backs them up. How ever, Ive just been knocked down on a tow path, by a speeding cyclist, not for the first time. Turning his head and yelling, the cyclist told me I was in the ‘f**king’ way and I should read the ‘f**king Highway Code. It’s a tow path, the Highway Code doesn’t apply, CRT’s rules say pedestrians have priority and you should all move at a speed that works for all and share the space. So my point is, rules are there for everyone, not just when it suits you and the Highway Code is not a blanket rule over everywhere.

Both are actions taken from a position of power, and this is why sociopaths have such a greed for power, and try getting to such a position at any price. To a sociopath, power is the road to always getting what they want. You bet 100% that this "accident" was done on purpose. Whenever a sociopath feels that they can hurt another person, whether it is emotionally or physically, regardless of whether the other person ever did anything to them, their secret anger issues come out, and the only reason she needed to deliberately strike the cyclist is the fact that she can. This rage was only aggravated by her sense of entitlement to think that she would have a right to claim the cyclist's place on the broad lane. But I have seen enough examples of rage where there wasn't even have a hint of provocation. It happens all too often, and too often it is sold off as "normal" when in fact, it isn't. Sociopathy is a *disorder*, and nobody should need be governed, commanded, or otherwise harassed by a disordered individual.

Cycle lanes are for the convenience of cyclists not car drivers, just as bus lanes are for the convenience of bus users. This cycle lanes is clearly intended to allow cyclists to safely pass stationary traffic, not to force the cyclist over to the edge of the road so that drivers can close-pass them. If the cyclist had been in the cycle lane then clearly this driver and no doubt many others would have done exactly that. The cyclist was quite right to maintain a defensive position on the road and the driver is 100% responsible for the confrontation. I would say that this is a clear case of reckless driving and assault with a motor vehicle. I should point out that I am not a cyclist, I am a commercial vehicle driver but I can still see the need for vulnerable road users to act in a way that keeps them as safe as possible. Once the confrontation occurred, the cyclist would have been wise to drop back and prevent the collision but that does not imply any fault on their part for the incident.

Insurance settles all the time. If one side is a bellend company and flat out refuses to pay despite the video proving it was criminal damage and the bellend roadrager deliberately slammed his bike into the car, there's not much your own insurance can do other than go to court, which costs a lot. So whenever court costs would outstrip the unfairness of the settlement, they settle. And a roadrager scratching one panel on a car like that, isn't very expensive. The problem is the police refusing to charge the cyclist with criminal damage, despite it clearly being an intentional crash because he felt his divine right to block the road had been infringed by the driver. Also for the cyclist. The next victim he decides to slam into may not be as levelheaded and decide to make some highspeed introductions between the bellend cyclist's head and the pavement to see if that can beat some common sense into him. It's that sort of entitled criminal behaviour how people really get hurt on the road, so the cyclist should be charged to unlearn this behaviour.

Thanks Ashley for the way that you have presented this video. Regarding the collision, whilst the cyclist could have arguably taken action that might have avoided the collision it doesn't change the fact that car driver knocked the cyclist off his bike. The highway code now lays out a clear duty of care that different road users have owe each other. By taking a primary position on the road, as you say, the cyclist was doing nothing wrong. I'm a cyclist too, and I often feel intimidated by close passes, cyclists have an aversion to them and this case illustrates clearly how close passes can turn into collisions. It hardly delays motor vehicle drivers to wait for a gap before overtaking - that's on a clear road - but this happened in slow moving traffic (thankfully), so the motorist wouldn't have been delayed. I too can't understand why no action was taken by the Police, the cyclist not just had the incident on camera, but presumably had witnesses too.

If a cyclist is close enough to touch your car in any form while you are overtaking them, you are overtaking them too closely. Its that simple. As a cyclist myself the only thing i might do differently here is take up and even more primary position - any less than fully in the middle of a lane of traffic and some drivers think they can bully their way past you. I'm a driver and I have known for well over 40 years that a cyclist, as a road user, has the right to use the entire carriageway. All of it. It's in the Highway Code and was taught to schoolchildren as young as 6 as part of Cycling Proficiency (is that even a thing nowadays?). There has never been an obligation to cringe into the gutter to allow cars to overtake, because of the possibility of having to avoid raised ironworks / drains / detritus. That being said, if their speed is impeding the flow of traffic, they should move to the left of the carriageway to allow overtaking (and that overtaking is only to be done by the driver when safe and not requiring encroachment back into the carriageway, crowding the cyclist into the kerb). Also in the Highway Code. Note "should move". Not "must move". Because their use of the road in a safe manner for themselves and others, avoiding hazards and obstacles, etc., outweighs the desire of someone behind who wants to travel faster. Just like any other road user. Mrs ex-Copper has no excuse for not knowing what was in the code (and still is) when she passed her test.

@@kenbrown2808No. You come across as selfish and self entitled because a bike is legally on the road and your journey might take an extra minute. You have explained your entitlement very well. Kudos

3:34 _"As soon as I knew you were being difficult and not using the bike lane"_ That makes it premeditated. She is admitting she already had an aggrievance before anything happened.

Car shouldn't have been overtaking as there wasn't enough room between the car in front of the cyclist and the cyclist for her to overtake into and she had to go into the lane for turning right. She realised this and came over pushing the cyclist. All she had to do was wait or drop back but she didn't, she's just another impatient "get out of my way" car driver. A few seconds and she would have been through the junction and been able to overtake safely.
