Unfortunately the order is a temporary freeze on evictions. The governor has no control over the landlord. The landlord is in their right to charge a late fee plus back rent, not saying it's morally right though, but I'm sure they have bills to pay too. Unfortunately, unless she pays the missed rent and fees she'll be evicted anyways once the no eviction period is over.

Yes it's true I'm here in Brooklyn dealing with squatters two of them undocumented.l took 9 months to get rid of all but one this undocumented squatter. And the eviction was supposed to be February 29th we couldn't get the Marshalls in time to evict him when moratorium on evictions came on March 20th. In New York City.. I asked why didn't he move out on the 29th? And the squatter told me he didn't know he was supposed to move out also February 29th.also. in so many keeps saying no comprendo no comprendo.. he was right there in court with me February 3rd along with the other squatters that he was supposed to move out also everybody. But he played this waiting game and won another five months of free rent and free electricity.. electric bill alone cost me $2,700 the cops say if I turn off electricity which I'm paying for I would get arrested..So I'm stuck with him for two and a half half years what this horrible New York housing court laws but you don't protect the people who do the right thing but those who manipulate and lie even ungrateful undocumented people I can't believe they have all this privilege

So, unfortunately it takes money to be able to live, to eat. This pandemic is affecting all of us "regular" Americans who are unable to work and aren't rich. Something some people dont take into account is the fact that most of these landlords aren't some millionaire real estate extraordinaire and they have bills to pay as well. Many inherited properties they rent out. But most still pay for the property and if they dont pay the mortgage then they all lose the home. Alot of landlords solely rely on rentals to be able to feed themselves and their families. This is not fair all around. In this case, there seems to have been an underlying problem to begin with where she was already behind even before the crisis. Even if thats not the case, there are people who are still working and getting huge bonuses like double pay along with getting that money from the government and those people should have no problem paying their rent and should pay it. The documents they are talking about is proof you have been let go of your job or had hrs reduced as well as proof you are financially unable to pay the rent. If she had money stacked up in her bank(not saying she did) she could and should pay what she can. If she got her stim money, she should pay what she can of her rent. Its what that handout was for. My entire stim went to rent and were just barely getting by. But i know if we didn't pay what we could, our landlord wouldnt be able to feed their kids either.

The governors action puts a temporary hold on evictions, not the back rent and late fees. Once the eviction period is over, the back rent and fees will be do or you get evicted anyways!

Because Phoenix literally has been open like if nothing has happened.. there’s work every where, so many places stayed open and yes some closed but very little.. ppl that were laid off or decided to stay home did just that.. they didn’t look for other means of income they basically didn’t want to work with the “excuse” Noone is hiring.. they did nothing.. no one was forced to stay home they were actually encouraged to go out, it was as if this virus literally went around Arizona.. Yeah.. Texan here. I missed May rent, and they've already been to my door. I was a 1099 employee before the lockdown, so I can't get unemployment. I've been filling out applications and doing tiny jobs online for 2 months with nothing hopeful in sight. My cat and I are about to be eating dandelions in the Texas sun for lord knows how long. The longer you're homeless, the less hope you have. Ugh

If you are a smart landlord you should have money saved away to use to pay all necessary bills if your tenant is unable to pay the rent or if the property is empty. Also especially in these troubling times the landlord should be willing to negotiate ways to pay because in most cases (depending on where you are) it is more costly to find a new tenant than to work with the one you already have.

One of my properties is paid off in full and another is around 60% paid off. Id personally offer half off for 2-3 months if needed but also realize many air b n b and others over leveraged their situations and are getting bailouts

Casey - the order does nothing but forestall the inevitable. 120 days? That’s 3 mos, which is the time most places need to show poor payment history to evict a tenant. Then late fees, damage deposit, and back rent , because these big landlords can afford to sue the tenants. But now try getting a new rental property. You have no references, in fact you have defaulted on your last rental agreement.

Kushner has already electronically filed eviction notices while asking Deush bank to let him forgo his mortgage payment because of COV19. While a landlord in NY with 200 tenants sent each one a letter notifying that until the the state opens up full time that he would wait on their rent with no late fees and charges. Unfortunately too few landlords out there like him.

Well if you think about it it all makes perfect sense. When everyone is so much in debt they can't pay it back then the new cashless system rolls out to save the day. You accept and your debt is wiped clean but no more physical money and all transactions are now controlled. Many at that point won't care and will take it but as you well know everything comes at a cost.

My grampa was a landlord back in the depression era. He was White, but his tenants were Black. Not even once could he bring himself to throw his tenants onto the streets. He knew that if somebody lives on the streets, it's easy for them to be murdered. Yup. I was evicted. I was being charged $10.20 a day for every day I was late. I am an independent art teacher and cannot work. Within two weeks my apartment complex started eviction process. Now I'm homeless living place to place. I can only imagine how horrible it would be to have family and no place to go. Our government has got to stop playing blue and red and get us financial help. So scary

landlord have make payment to bank as well. I say renter should make an effort to pay their rent. Minimize your unnecessary amenity such as your internet, cable. Job like food delivery service is in high demand.

My guess is, if you closely examine the finances of most Americans, they are in debt, buying items such as cell phones, new clothing, a new car, eating out 5 plus times a week. Then add rent on top of that? Americans love to impress. Look at our illustrious leader! A personal financial crisis is not the fault of the government, nor the pandemic. Blame falls squarely on the person owing money. It’s all a matter of priorities. You accomplish what is important. Set goals. Get out of debt. Buy real property. Grow your own food. Have a well. Make your own power. These 6 “to dos” make this pandemic no different than any other day. I am concerned about conflict being created by the president. Not very presidential.

Carlos Murphy you are definitely a responsible folk w money out there. My husband and I got out of debts more than five years ago. We paid off everything, saved you six months emergency funds and put a lot into retirement funds. We finally bought our first home two years ago in California. At this time I do understand compassionately that many are out of jobs and can’t afford rents/foods. I said this is not government or pandemic fault that ppl are this way at this time, mainly it’s their own fault for living way above their means. I will get ppl telling me ‘well living cost is high w low wage’...I have a better story for ppl, my husband didn’t make a lot when he started his job form bottom. Even w college degree, he started way below and when I got a him, it took me couple years to get his finances in place. Paid off his debts and started saving. We have to work insanely hard that time but we are happy now bc of that priority for our goals. We give back 15% of our total incomes into foundations we support on a monthly basis. This being said, I can’t agree w ppl when their excuses all are bc of this that. I wholeheartedly agree w you.

So much truth! As a landlord myself I see why this is an issue. People do not realize that Landlords are people too and the bank does not care if my tenant pays the rent. They want their money the first of every month.

might be a good idea instead of having people show up to protest the eviction how about everyone show up and donate some money towards the rent? I would rather give someone some money if I have it then force someone to serve another for free it would be a win win for everyone including the givers of the money as there is more happiness in giving then receiving as per Jesus words.

Something to remember about landlords. Their apartments are not considered a job. Yet many use them as such and try to make money off of their apartments. If done right there is very little money in apartments because, by most laws, tenants are only required to pay what is needed to pay the taxes and fees of apartments. Nothing more. Yet most apartments are hundreds, and depending on where you live, thousands of dollars more than what's needed. Raising the cost of living. If these slum lords can make money off of the tenant then the landlord better have managed their money right because now it is time to pay the piper not time to jack up the rent on people.

@@l.austin2371 all mortgages have NOT been frozen, only Federal loans for first time buyers which comprises less than 50% of all mortgage loans. The other 50% of homeowners will not have that break. I feel for the tenants who can't pay because of the shutdown, but there are other people who haven't been working or paying regardless of the virus and will abuse this relief program.

Not surprised. It is AZ. The laws are written by and made to advantage capital. For example there are no price gouging laws. People can be fired “at will” a/k/a for no reason at all. It is a bidnessman’s state.
