If you've ever been hit by a car as a pedestrian I know damn well a little never happened to me again. Like I'm pretty damn confident you couldn't hit me on an open Tarmac If you tried. That thing not killing me absolutely made me stronger

I remember this video. Car Jacker took the victim's utility truck and rammed him.

So, I responded defensively with deadly force and I call 911 ("win the race to call 911"). Can I legally hang up on the operator, even if they tell me to stay on the line, so I can call my lawyer?
@alexa.44023 ай бұрын
Probably best not to, a lawyer can wait - if police shows up before you can call your lawyer just refuse to make any statements to them (make sure to verbally invoke that) until you call your lawyer for a consultation. Hanging up on a dispatcher is *usually* not a crime or anything like that, but it may be a detriment in court. FYI I'm just another guy on the Internet, so don't quote me :D

You have no legal obligation to stay on the 911 call.

Two factors I have to consider in this carjacking scenario (if it were a personal vehicle): 1. Is a loved one still in the vehicle (no brainer) 2. do I have other firearms still in the vehicle. A firearm is the one piece of personal property (an object) I am willing to defend.

I agree with your assessment however it wasn’t just a truck I have a company truck but it’s full of my own tools thousands of dollars worth. Not justifying it just for context so you know.

6:54 good point. "Maybe aught to be a police officer so the standard can be lower than normal citizen¯\_(ツ)_/¯." Reasonable suspicion of commision of a felony wifh certification and with training, and a badge all together is a lower bar than what is expected of normal people particularly considering they dont even have to have an obligation to know if what their enforcing is legal. Which[ being a normal person luther a tv cop in "shameless" said " Do you know what comes before civic duty? Personal responsibility"]] might i add is a requirement BEFORE going to become a cop. Step 1 to become a cop is easy. Step 0. Was actually your fathers' and mothers' job.

He was a little vague on the legality of the use of deadly force against a fleeing felon stopped from committing a forcible felony.

Because the application is a little vague in the real world.

So let the criminal steal your car then call police who receive thousands of stolen vehicle reports. Seems kind of hopeless.
@ASPextra3 ай бұрын
You can stop a car theft with ordinary force, but not with deadly. You have insurance for a reason.
@papimaximus953 ай бұрын
@@ASPextra "You have insurance for a reason." Just a friendly reminder to be more understanding/compassionate. Not everyone has theft insurance (i.e., Comprehensive Coverage). In many states, only Liability Coverage is required. The additional coverage can be quite expensive especially for popular makes/models. For a good number of Americans, those extra dollars are a non-starter. Losing their vehicle can be a devastating financial event as it is more than just a deductible. HOWEVER, that still does not change the legal fact about how much force is appropriate.
@bannedfromasptwice3 ай бұрын
I agree. People work for what they have and no one has the right to take it. People have the right to defend their stuff. Insurance is slow and finds every way not to pay, will raise rates or drop someone for making a claim, and won't get the thing back. I'd have a very hard time convicting someone who shot at a thief.

Papi, if you don't have money to insure your car, you sure as HELL don't have money to hire the criminal defense attorney to defend the rest of your life. So my advice stands.
