There is enough judicial history that basically resulted in the court accepting ‘all’ the opposing party’s argument if the other party destroys evidence. There was at least one copyright case where the defendant submitted a wiped hard drive to the court as evidence and the prosecution provided evidence that the disk has been wiped and the judge ruled in favor of the prosecution on all counts. The destruction of evidence, if true, can only lead to default ruling of guilt.

NDAs aren't legal binding when you're under an investigation. Also, the penalty for impeding an investigation can range between a simple fine to a heavier penalty. Whatever they're shredding was probably so awful that it was worse than the penalty for destroying evidence. This might need to go to federal if that's the case.

This chick I used to wreck had a dad who was a narcotics detective and he got arrested for obstructing a federal investigation (over him hunting after dark) so yeah, destroying evidence can be super duper double serious. (Must run in the family because her brother came home from school to her cleaning a huge cum stain off the couch and he could see the huge wet spot in her grey yoga pants as she was bent over scrubbing…. I wanted to die)

Fun fact: knowingly destroying evidence relevant to an investigation is officially known as "spoliation of evidence"; and a lot of the time when this happens, the court will have no choice but to assume that the destroyed information would have proven your guilt and rule against you in the case. Normally, our legal system is supposed to be based on "innocent until proven guilty". However, this is used as a way of discouraging such behavior, by negating any benefit the guilty party would gain by removing evidence.

Im keep hearing from people how companies HR always there to protect the company not the people. I guess there needs to be a law that HR would be a 3rd party or even a government-social part of the company. So many times I've heard about people reporting to HR just to find out next day - they are fired. Abuse everywhere, even if you think such things shoudnt ideally happen in todays modern world in western countries and yet in USA all over I hear about this.

@@JessicaSunlight That's the problem here. Ultimately, every HR department works for the company and therefore is subordinate to the management and executives which makes it impossible for HR to stand up against them. It's a clear conflict of interest. That is why unions are so important.

The fact that almost all of us have basically come to the conclusion that whatever is on those files that were shredded had to have *SOMETHING* that made Blizzard say "Yeah we might get in trouble for doing this but I'd rather face the consequences of destroying these rather than facing the consequences of what's IN these." They aren't digging a hole. They're sealing off a liability. Obviously the evidence they destroyed could lead to far worse charges than the current charges plus destroying evidence charges. This is why willfully destroying evidence should be far more severely punished than they are now up to the corporate death penalty for the corporation.

Unfortunately it means such stuff as here can work out, but there IS a good reason for why the baseline is "innocent until proven guilty" and not "guilty until proven innocent". Especially with the precedences it could set, ESPECIALLY with worst case scenarios.

@@undertakernumberone1 wrong. “Innocent until proven guilty” is only ever subject of a criminal suit, when personal freedom or life is at stake. This is a civil lawsuit, and so the subject is “who can provide more evidence in favor of (not) paying the other party”. Thereby stated by Californian law: in a criminal lawsuit all 12 of the jury have to agree on a person’s guilt. In a civil lawsuit the majority has to agree. Furthermore: criminal suits are always against a single person. Civil lawsuits can be from individuals to corporations or groups, and it’s always about monetary compensation.

It actually is, if a party destroys evidence, a judge is legally obligated to not only assume the evidence exists, but that evidence is then automatically considered in the worse possible light. If they still went ahead with it, then that evidence contained a hell of a lot more than what they are being charged for.

Yes, it's called spoliation of evidence. Not only is it illegal, it's also stupid as the court will usually assume that the intentionally destroyed evidence favored the other party.

Blizzard has become an actual WoW raid boss. The boss mechanics are relatively simple. Phase 1: the boss will spawn adds that will attempt to grab yer tits. They will chase you through a series of cubicles. They must be killed in an area of the arena called the "Cosby Suite." Phase 2: the boss will cast the spell "shred evidence" which needs to be interrupted. The boss will attempt to drink from a vat labeled "Chinese semen." You must destroy the vat before it is emptied. Phase 3: the boss will choose one random player and drain all of their gold with the spell "store mount." This spell is uninterruptible and is cast every few seconds. Phase 4: there is no phase 4 because there wasn't enough resources to finish it because the boss spends all of it's time, money, and effort focusing on phase 3.

Well it less go to jail and more the money they have to pay gets higher, 1 million, 2 million, 8 million, 20 million, 70 million, 150 million, 400 million so on. by doing this I go with 150 million dollar fine so far. Edit: like wise they not being sued by a person but the state it self, a state in debt mind you, so Cali might go a lot harsher has this shit show goes on.

@@neon-neku I feel like Bobby is someone who's been the CEO of many companies, and he's canny enough to know all the little loopholes that will mean he won't have to pay a dime, and so I think he'll find a way for the fines to go to the actual company of Activision-Blizzard, and not him personally. Just a hunch lol, -He's definitely someone who's ok with profiting via immoral means, even if it means harming children with gambling or making people redundant, so I really hope he is prosecuted for his part in all of this, though I think he'll probably just get off quite lightly in reality.

I think the better way to put it is that HR is supposed to manage risk due to employees-most corporations do care to the extent that employees can sue over certain legal points-only a rare HR department goes farther than that-Acti/Blizz’s HR can’t even pull off the most basic function HRs-this is worse than even the most cynical HR operations out there.

I don't trust HR as far as I can throw them, but then again thats just my experience. Could be there are good companies out there.

We have a water company in the south of England who have been contaminating rivers because they are unwilling to spend money to fix the infrastructure problems they have. Instead of pushing the company to provide sensible and just environment, you do nothing and patting yourself on the back that you are supporting the devs. You don't. Devs are paid on a monthly basis, not a percentage fee. Whether you buy the game or not, the company IS OBLIGATED BY LAW to pay them. Blizz is not poor, they don't pay employees enough because they feel like they don't have to. As long as you buy their games, you are sending the message to Blizz that you don't care about their practices as long as they feed you games.

Buying Activision products is going to be interpreted as us supporting the company as a whole, regardless of if its only to stand beside the employees that had to go through this shit. However if we don't buy them, it'll most likely be seen as their fault, and so lay offs (which will unfortunately occur anyways most likely) will affect the devs and not the corporate members. Damned if we do, damned if we don't. I'm just saying they aren't completely wrong, but it isn't right either because no matter what we do it'll impact those already affected.

I get your point but like, the diverse team artists that work on the characters of OW and OW2 aren’t part of the awfulness that is going on. They give the characters many different sexualities because THEY as artists WANT to. Games that aren’t going though legal trouble, Respawn with Apex for example, are creating character who also have a broad range of sexualities. It isn’t malicious. It isn’t a sign of rotten corporate insides. And bad things all over the world would still happen if games just had straight characters. So, while I get your point, that doesn’t make your point intelligent.

Blizzard is gambling that the fines from committing this crime will be less than those of the crimes they're hiding by shredding said evidence. Some execs over at Blizzard needs to face real prison time and felony convictions over this.

@@danielbrown5986 Playtime supports the company, not just money. Pirate the game so your playtime isn't tracked and used as a potential aid or resource for the company. I would suggest you sell the game off for some money back and then get a pirated copy if possible. Otherwise, play other Starcraft-like games made by less problematic developers.

Never much cared for Diablo 2. Played is back in like 2012, played the 3 difficulties with Necro and then dropped the game. Reign of Terror mod for grim Dawn, I currently have SIX different chars I'm playing cause its far more fun.
