That trooper has ZERO authority to do ANYTHING he did in that video. He cannot stop them without cause, he cannot steal his key, he cannot make up a crime after he realizes hes fucked up, he cannot compel them to cooperate with his investigation. Taking his key constitutes illegal detainment and a violation of his 4th amendment rights. This is an airtight lawsuit.

No, if the officer believes he saw a violation, he probable cause to pull them over. Next, the officer has discretion in how he handles the vehicles that could take off. The fact that there was only one officer but multiple bikes, which could leave the scene rapidly, makes the officer taking the keys a reasonable seizure under the 4th Amend. Further, qualified immunity protects public officials in their discretionary choices regarding their duties, so any case will almost certainly be dismissed.

Qualified immunity only protects the officer, it does not protect the state from any lawsuit resulting from the actions of the officer. This is an airtight civil rights violation suit.

That cop in the first video if I were to grade him he would get an F for displaying a hostle demanor throughout the encounter, abusing his power, and violating the biker's 4th ammendment rights. Also he failed to explain what the reason why the Biker was being arrested for. Clearly it shows that the Biker didn't violate any laws and he was obeying what the officer told him to shut off the bike, but then the cop became hostle and took the keys away from the bike. I hope the biker sues the hell out of the Police Department for allowing a corrupt cop to act like this.

I understand what you are saying about the Claustrophobia but here's my (limited knowledge) take on that, is it possible that while riding the constant flow of air over the face prevents it from being triggered and when the guy stops it can start up? Second point, Whatever the cause and regardless of the riders behaviour the cops actions were, frankly, idiotic. He made a potentially easy situation much worse with his behaviour.

nope, when you are pulled over you are at least detained and in most states functionally under arrest for the violation are you being cited for. It has been upheld every time it's been challenged that an officer can take your keys

NOT ONE SINGLE TIME! and since you don't even know the basics of what a detainment and arrest are I'm going to bet I have significantly more legal experience than you do, given it was my job. Nothing here came close to a 1983 violation, so good luck trying to get him on the Brady list.

When you are stopped for a traffic violation whether civil or criminal you are NOT free to go. you are effectively under arrest or at the very least detained and the officer has every legal right to take your keys to prevent you from fleeing. Again as I've said many times, NOT ONCE has a single challenge to this practice been successful in the courts .If you believe otherwise show us the code or the case law. 2) When you are part of a group of riders being stopped for traffic violations and one of them flees yes you WILL be questioned and they WILL detain you pending investigation. They have every right to do so and because your buddy fled that makes you a flight risk as well. This is no different than being caught as a passenger in a car that is stolen or being part of a robbery that went down bad and someone got shot. It's called principal accessory. 3) you are free to exercise your 5th amendment rights, that guy should have done exactly that instead of running his mouth and acting like a child. He would have probably walked away with a minor ticket instead of being hauled away in the back of a police car for disobeying a lawful order or obstruction, both of which he could be charged with given his actions.

There is no Federal nor State law that stipulate or prohibit a rescue vehicle of any size legally registered to be utilized on the road of any other state beside the state in which the vehicle was registered. Europe is loaded with toll roads even in places where it makes no sense. If it's not toll roads it's speed cameras. You pay more in taxes there than here and what you get in return including health care on the public plan is actually worse for everything else except the most basic requirements. Even food and fuel is more expensive. In Asia most highways are toll roads, you again are speed limited, and the costs of good and services can be extremely high unless you are in places like Vietnam. Then the roads are crowded and chaotic in the cities and poorly maintained in the rural areas. in fact in all the places I have been you are either paying for access, paying more for fuel, or simply "taxed" by the police for whatever they believe you did. All throughout central and south america they will demand a bribe. and thats not even getting into what happens if you speak out against the government in many so called "free" countries like Britain or Germany, where simply using the wrong pronoun is now a hate crime punishable by prison time. Where in most countries you are NOT presumed innocent until proven guilty and certainly not able to use a firearm to defend yourself. So again please tell us all how being a tourist in other countries while hating this one so much has granted you profound insight.

That guy is an idiot. The trooper may have been aggressive but he has every legal right to take your keys when stopping you. If you have a problem, take your video evidence to court and argue it there. Arguing it like a child and throwing a temper tantrum gets you nowhere except a ride to jail. btw dropping the names of other officers is a sure way to not only ruin any good relations you have with the officers but they'll go extra hard on you for making them look bad.
