Industry leaders are crying out for more skilled migrants, and the government is kicking out the ones who stepped into this country to best fit the workforce just because they are over 35. The younger graduates are struggling because they don't have the experience required. Some things do not tally at all. I appreciate NT, keeping it open for recent graduates. Because, in most states, they cannot even apply for graduate streams. The way they have treated students is beyond frustrating.

There is definitely a huge backlog for the 190 visa, much more than for the 189 visa now. The DHA should take action to grant those skilled applicants in the building and construction sectors to help solve the housing crisis. Additionally, some migration agents cause delays for the 190 and 491 visas when they refuse to conduct the health assessment at the very beginning of the invitation to avoid the s56 redo. MIGRATION ACT 1958 - SECT 86 is outdated and should make some changes. for example, state nominated AND under the state priority occupation should be excluded form this law.

Recently, there has been a refusal letter circulating on all online platforms like Facebook and tik tok, in which it mentions that 191 has been refused because applicant was absent for 192 days from Australia which has breached conditions of residency requirements that applicant must not be absent from Australia for more than 60 continuous days or 90 days in total per annum. Do you have any information regarding this? Please help us digging into this residency requirement for 191. For the regional stream of the 191 visa it is not possible to refuse an applicant based upon the periods of time spent outside of Australia in the three years before the application is made. That is because no such clause exists in the regulations. Such rumours are nonsense and probably started by the nominated states trying to scare people into staying in their regions. You can spend as much time as you like outside of Australia for the 191 Regional stream and it also does not matter if people leave their original areas and go to other regional parts of Australia

It’s so frustrating Karl that after waiting 2 years for 491 to be granted and then spending 3 years on 491 visa that now people are having to wait almost a year for their PR to be granted. It’s almost a 6-7 years journey and I cannot recall if there was ever a longer wait period for a PR stream. The people who have contributed so much to the regional growth during Covid times are having to suffer the most. Thanks for raising the 191 visa processing delay issue. Hope the department can wake up and start issuing some grants otherwise it won’t be long before the processing time will escalate to over 3 years.

@ My spouse was the main applicant who was selected to apply. It took us 3 months and various challenges to get a job offer in Australia. Now that we have a offer, we are finding out from other applicants that they have been waiting for months for their visas to be approved. This is a problem as employers can’t wait to long for our visas to be granted so they have had to look for another employer due to their job offers been withdrawn by the employer as it went past their start dates. I've been waiting for my 491 visa for about 18 months and it seems like my grant will not come earlier than in May. This is unbelievable! How could they stuff up the system so much, that the waiting time has increased from 7 months in 2023 to about 20 months now? 1.5 years in absolute uncertainty! And after the 491 visa is granted, we'll have to satisfy the requirements and live for 3 years before making an application for the 191 visa which waiting time can reach 2-3 years in the near future. This system looks like humiliation!

Australia immigration law is not strong enough because I know a lot of people who came to Australia on visitor visa from Vietnam before the Covid 19 and they left their child behind with the grandparents,They even had a baby in Australia and every day they work for cash in hand

I am currently onshore waiting for 491 grant for 18 Months. I am thinking about going offshore and wait there and come back after the Grant. Is it okay to do that. I am currently on bvb.

You need to check with the sponsoring region on this issue for they still hove the power to withdraw the sponsorship approval whilst visa processing is underway.
