But to bypass the game security (which is usually patented by the game company), there has to be some kind of mimic code to cover the injection of the cheat function into the game, which is very likely to violate the patent.

The more sophisticated cheats don't do any of that. They just find the addresses they need at startup and then read/update the values with low level OS calls. Anti-cheats wised up to that and now these types of calls are often able to be detected. Which is why most people who get away with cheating now run their cheats on a whole separate "computer", and use hardware to read / update the memory (DMA cheats).

On top of that, this isn’t necessarily a ‘its legal or its illegal’ sort of deal. It is also a contract law issue meaning that the chat makers have ti get their hands on the game to test their cheats, but the only real way for them to do that is to buy the game. Buying and playing the game automatically forces you into accepting the EULA and TOS. Which have provisions to protect against people cheating or making cheats. These are certainly enforceable. It doesn’t necessarily need to be criminal for you to get sued

was looking for this comment cause yea. as someone with a cybersecurity degree who is also pretty familiar with these types of laws, i find Bungies assertion that reverse engineering code is in and of itself a violation of copyright to be utterly ridiculous on several levels. if you legally obtain a product, you are legally entitled to take said product apart in basically any way you want. now, taking that product apart might violate a warranty, or ToS, and the company has every right to ban you, but it most certainly is not illegal unless you are redistributing source code, which is not something that is needed to make a cheat. with all that said, there are specific situations where you kinda have to break the law to get your cheats working. i remember one time when some ROM modders had to essentially exfiltrate proprietary encryption keys in order to get a replay feature to work in the game they were modding. in this instance, they would have to store these keys within the mod client, and something like that is definitely skating a very fine line from a legal perspective. so yea, im honestly really skeptical of Bungies whole position here, but there could also be evidence against the cheat makers that we don't know.

No, but your distribution of cheats, and players' subsequent usage of those cheats, causes Bungie's market to further stagnate out of the multiplayer sphere they've created (and ignored, give you that one), which could probably open you up to a tortious interference suit. I'm not a lawyer, but it's not outside the realm of speculation to make that connection, considering their entire business revolves around players consuming the product, and cheaters make that number go bye-bye. If you wanna cheat in your single-player game, fine, knock yourself out. But the second you cheat in an online game where you can have an advantage over another player, in a competitive environment, you should 100% have the book thrown at you.

Someone already talked about it a little bit, but I think it can be possible to develop cheats without access to the source code; it would just be like navigating a maze without a map. The two I could think of are: reading the memory of game critical functions, or running a packet sniff. Both of these methods should be difficult to pull off without having access to the game's code, but if a dude is getting paid $700k for his skills, maybe he knows something we all don't. I fully believe they did break into the game one way or another, but I can see why it'd be difficult to prove and why it's not shut and close.

So not all law is criminal law. There's civil law, and that deals with contracts. Terms of service are a contract. Violation of that contract opens you up to legal recourse. They won't go to prison, but they will need to pay a lot to Bungie

Cheating isn't illegal but they aren't being pulled into court over a criminal case. They were being sued for damaging Bungie's brand/service and/or violating their copyright in a civil suit, from what I can tell. Saying "but it's not illegal" is probably the most pointless statement possible in the eyes of this layman.

the basic problem is cheaters make games unfun. that literally killed EA first battlefront. i remember confronting a cheater USING THEIR OWN LINK to a youtube channel. they spammed it in chat even while BOTH sides had stopped playing to shoot this guy with wallhack, shoot through objects, infinite jumpack and infinite health, one shotting everyone on rebel side. and you know what? he seemed genuinely shocked that people were so angry, that the rest of us were NOT having fun and laughing like it was a joke. he was more shocked when i pointed out how it could kill games, and he was directly responsible for making every player who bought the game effectively lose money when they stopped playing because cheaters made it no fun. and then some other guy turned up in the same comments making death threats to the cheater, which i said was out of order and over reacting. it is illegal here and in EU to tamper with proprietary program code so it is an offense. as an aside, i found cheating by russians and players who were from eastern germany, and former communist countries - except poland - was most common. not exclusive though, and now i see it common among mainland chinese players in other games.
