That wouldn't protect from blatant negligence or incompetence. This is a case where the hospital would settle quickly and quietly. Surgical hospitals rely on their reputation, and if you get the reputation for wrong site surgeries, it's bad for business. Funny episode though.

It would've never happened because even if Al won, Peg and the kids would've still screwed him over. They would've gone on a shopping spree with that money and left him with nothing. That is unless Al finally took control of his life by keeping the money for himself, quitting his drudgery as a shoe salesman at Gary's Shoe Store, faking his death to escape his miserable family, changed his name to Jay Pritchett and get a plane ticket to Los Angeles to start a new life in a much happier circumstance where no one knows who he is.
