The thing is that the majority of people don't even know that defamation laws like this is the same as in South Korea and Japan but like the others Thailand is a precious Allie so the best you can expect is that their friends tell them to be more smart like Korea and Japan when abusing the defamation law in a way you don't make a big fuss
@IanKorman9 ай бұрын
One simple solution is for Thailand to merely have their defamation laws adhere to the UN Declaration of Human Rights which Thailand is a signatory of. In that document, you have the right to state your opinion and to relate your experiences and should never face criminal repercussions for doing so. This would not stop civil cases being filed but would at least remove the possibility of being jailed.

At least they got to fight in court. I am American and was sued for criminal defamation by an Iranian crypto scammer in Thailand. My passport was taken and held hostage. I could prove everything I said was true but I was told pay an arbitrary amount or never get my passport back until trial ends in one or two years. Yes it’s extortion The guy suing me has fled Thailand wanted for a murder and torture of a Taiwan national on November 16 but I still had to pay my life saving to this guy just to get my passport back. No red notice was even issued to bring this guy back. The American embassy wouldn’t help, no media would help. I lost everything This same guy even has made attempts to kill me by trying to lure me into situations. I must hide. Yes it went to the court, I was arrested by the police and arrested after the prosecutor accepted the case. I never spent time in jail but they where trying very hard to make me serve time

Sadly, this happened all over Thailand. The general population have no rights and no way of defending themselves. The fact that debt is passed on to next of kin, is absolutely horrendous. The legal system here feels as if it were designed to prevent everyday people from climbing the social ladder.

Debt is passed onto next of kin in western countries. Thailand has little ability to recoup the debts of average citizens, it's not like the west.
@rhizomorph-music9 ай бұрын
@@ThePatriot-gm1fg I don't know about other western countries, but I don't believe that's done in the US. Children don't get saddled with their parent's debt, but the court will try to settle the debts out of the parent's estate before the heirs get anything.

@rhizomorph-music I could be wrong but I thought that's exactly what happens in the USA and that the country isn't any different in this regard than other western countries. Again, I'm not 100% on this but I'd be surprised if debt was completely forgiven upon someone's death.

I knew a bloke who made a school owner lose face. He raised his voice and slammed his plastic mail door shut in front of parents. The school owner said that it was cracked, claimed damages for the draw and filed the charges 400km away. It dragged on for over 18 months and cost him hundreds of thousands of baht, much of it in travel and hotel costs.
@ThePatriot-gm1fg9 ай бұрын
I think that's a bit exaggerated or there's more to the story. Unless you've actually destroyed property, raising your voice, although culturally frowned upon, won't have any bearings on anything. One time at Don Muang Airport and this is going back almost 20 years now, I lost my cool and angrily demanded my right to be checked in for a flight I was late for. When the staff refused, I stormed out of the office and due to the force I used to open the door, the glass pieces shattered. After getting fixed up at the airport clinic, I was asked to pay the damages of around 10000 Baht and also filed an insurance claim, which was accepted. I didn't deliberately cause damage to the door. Strangely, one of the employees was crying after the incident. Not sure if she was sad that I got injured or just being a crybaby. There was no further action taken. If the same thing had happened in the west, I'd probably have been charged even though I can state with confidence I did NOT deliberately destroy property. I was angry and wasn't careful as to how I opened the door. Had the door not been glass, nothing would have happened.
