I would argue to say that it was based on an earlier discussion he had with his brother regarding his flashy clothes thus making him look like a clown with the "arrest me" sign. Since the cop got shot, Frank's operation is now hot and he had to change their method of communication. Denzel being the great actor improvised that sunglasses part.
