I watched a bunch of reviews when he was first arrested. One of them pointed out that the Romanian lawyer who is prosecuting Tate is the top one in the country against the organized crime. He is on 24/7 military guard because of the high profile cases he has done in the past. The fact that it is being done by this caliber of lawyer probably means that the brothers are screwed.

Even now, the UK has a big issue of trafficking Romanian girls for profit. Tate was dumb enough to do that in Romania of all places. A guilty verdict followed by the most harsh sentence is warranted. If Tate wants to continue his profit scheme in prison, there's plenty of guys he can use inside.

Hey this guy went to this other country, by his own admission, because of the lax enforcement and lower standards of law. You could feel bad for him if he was on our soil or was there for some other reasons like just a vacation.. He went there specifically because he believed they had a lower standard. Well, possibly there could have been no charges, but he's just getting what he asked for. He went there to play their game and he lost.

As fsr as I remember, after he was denied his request he or his lawyer then came out saying he actually doesn't have cancer after all (also after Romanian doctors claimed he was bullshitting after doing a check up on him).

He clearly isnt smart for doing that. I think he is smart to a point where he can sell to a target group of population. Not rip off. To certain extent, these people who spent money gets something back that are somewhat useful to them. Just won't make them millionaires. Taking advantage? How should I say it. I think those with the right mindset will get somethink out of what he sells. Just not everyone. Perhaps some may get ripped off by him as well. But I think he is definitely not as bad as people think. I don't like his personality online though. I kind of look at him as crook selling stuff online and made a fortune. that is all. But he is clearly not smart on what he say. And it is biting him back.

the people who have power are the politicians, the more the society is weak they get more power: if someone is ill he pays money to the government, if someone is broke he needs money from the government. When tate says to the young people who are just watching porn and wasting their life to do the opposite of that in such a way that lots of accounts are posting his message everywhere, now that's a threat to the government especially the us government, so they pay money to the romanian authorities to keep him in jail...

Yes, Tate had a closed list of people he was supposed to call, and no others. And it looks like he tried to get around this the old-fashioned way, by having somebody he called conference-call people whom he was not supposed to call into the call. It's surprisingly common, even though people who do this are pretty easy to catch. Telcoes have call records.

Hey Bruce, I work for a company that monitors jail calls in NYS. Any call placed to a lawyer is considered privileged and cannot be monitored even if it's done through a 3 way. However, if a call is placed to a lawyer's office, but it goes to voicemail or they only talk to the secretary the call is not privileged. A lawyer must actually be present on the line for the call to become privileged, and many times inmates will leave detailed messages for lawyers. Also inmates have a limited list of phone numbers that are curated by their counselor. 3 way calls are technically not permitted, but the technology to stop them is really inconsistent and 3 ways happen all the time without being terminated.

Tate is not in American prison though so their rules are likely different . Also, while the calls themselves may be privileged prosecution or investigators can use that knowledge as a springboard to find other things and you'd have to prove the calls were monitored. Which without hard evidence you would be admitting to knowing of criminal activity your client was taking part in.
@purpleomlet
@purpleomlet Жыл бұрын
@@benf6822 yeah, I assume the rules would be different. Especially since New York State is SpEcIaL and needs to do everything with such needless restrictions and guidelines that I'm sure most other states will have different rules, let alone other countries. I am not sure what you're trying to say about the prosecution using the privileged calls as a springboard. I think you mean they could still listen to them and just act like they didn't. I have no idea how it would work in Romania, but at least where I am a prosecutor isn't entitled to any calls that come out of a prison. Those calls are property of the company that supplies the telephones for the prison. There are not only company policies to ensure a person's rights to privacy in the legal system, but laws stating those calls cannot be listened to. The company who owns those calls would get in serious trouble and probably be heavily fined and lose their contracts if it ever came out that privileged calls were being provided to or used by prosecutors to gain an understanding of potential crimes. Again, I have no idea how Romania works, but I'd assume they wouldn't be able to listen in on privileged calls either.

They instantly "flag" calls made to certain numbers. Doesn't matter the context. If you ever find yourself innocent and in a position, make sure they mail you with a pseudonym from the post office telling you to call that burner. No particular stuff. SO The nurse gets the blood sugar test and low and behold it was so high the test device could not even to begin to measure his blood sugar. The nurse gets another one thinking it was broken, but it errors out. At that point we Don't have the means to care for him and transport him to the hospital were he dies 4 hour later of complications from diabetes sugar level. The sad part was not one Doctor or nurse took the time to check his sugar level in 2 days 18 hours. The doctor at the hospital said he should have died 2 days ago it that high. If the medical staff at the prison would have read his chart coming from county and did their job by given him a full check over He would still be alive.

They wouldn't even have to monitor each call either. In a domestic case the prosecutor could just ask the girlfriend "Have you had any contact with him since incarceration?" "Yeah he called me a week ago" or they might even hate them enough to call and tell without being asked. It also wouldn't be hard to look at a list of numbers called by each inmate and match them with numbers they shouldn't be calling and then go back and get the recording.

They are still gathering evidence to charge. From what I have gathered, they have enough to meet the threshold for human trafficking. But new details are recently being discovered, for example it only came to light a couple of weeks ago they tried to get inside information out of the police (a new charge), only a few days ago they froze his crypto currency as I imagine new information came to light about that. organised crime is complicated and takes months to paint the full picture. They could hsve sentenced him based on the immediate info they had, but it wouldn't have been an accurate reflection on the full body of crime. Preventative arrest on someone with ties to mafia, and lots of money who Is involved in organised crime is necessary. He would be a significant flight risk and his ability to manipulate the press and victims with his connections on the outside world is too high.

Yeah it seems clear the human trafficking charges have weight but tax evasion and running a criminal enterprise are more sophisticated crimes and require detailed financial evidence. That takes time to gather and I'm sure that's what's causing the delays in going to trial.

I work for a public defender’s office and SO many people call us from jail on 3-way and it makes no damn sense! If they give their attorney permission to talk with mom/dad/baby’s mama/another person they trust, the attorney will keep them updated too. But why subject yourself to recording/monitoring?? Our clients can make free, private calls to our office, but if they call any other # it’s expensive. Plus the telecom co the jail here uses can sometimes detect the 3rd party on the line & will disconnect the call anyway.

They won’t face charges. It was a combination of things. They had a run on the bank depleting cash on hand. They had to raise cash to meet the depositors demands and had to sell bonds to do so. (Banks must invest in safe portfolios generally and carry a certain amount in low yield/high liquidity instruments like federal bonds.) Bonds were bought at 1% or 2%. Current yield is 5%. They had to sell for deep discounts and became insolvent. Had there been no run the banks would be open today. No crime. Just a set of circumstances. Anyway, Bruce Rivers is the criminal lawyer. But the financial lawyer.

Im not romanian, never been there and dont know much about their judicial system. I am swedish tho and the european norm is you are usually kept in custody(jail) pre trial depending on what the charges are and and custody can drag on, and I mean really drag on.. And should you find yourself really unlucky you might be put in full isolation, that is only contact is with your lawyer; no contact with other inmates, no letters in or out, no newspapers - zip. I dont know the Romanian constitution but I doubt that they share your (the american) right to a fair and _speedy_ trial, thats the issue both with pre trial custody and waiting on a trial itself. Im unsure, there might be EU guidelines, but I think the EU countries laws trump any guidelines, and if not he will have to take his treatment in pretrial custody before the European court, and Im unsure of his abilities to do that because if hes still a British citizen I dont know what rights he can claim since theyre no longer part of the EU. So, a long story short.. The european norm of pretrial custody can be a real pain, but still I wouldnt trade it for the American bondsman system.

please correct me if i'm wrong , but i think the reason why the prosecutor didn’t charge them yet is because they need more time to fully investigate this case , not because they don’t have evidence but maybe because they found more illegal stuff in this case , so they need to investigate more. they can charge them when they’re ready. if the prosecutor just charges them , they can’t continue the investigation. why? it is because charging them immediately would be bad because they would lose the ability to do more investigation , to dig up more information, and to dig deeper into this case. his fanboy keep on saying " they don't have any evidence otherwise they would have already charged him by now. romania's legal system is corrupt. " they have no understanding of how their legal system works and their opinion are solely their own. you absolutely do need evidence to extend the detention , plus the prosecutor was given 180 days for the criminal investigations. so just let them do their work and we just wait for the trial.
@matthewyoho5422
@matthewyoho5422 Жыл бұрын
You have the gist of it: they probably have more than enough evidence to take the case to trial, but the preventative detention their system allows for means that they can continue to conduct their investigation and make that case *ironclad* and expand it to wherever the evidence they dig up takes them, while Tate is sidelined and unable to (mostly) interfere with it (he's still trying to interfere with it, via frivolous defamation lawsuits aimed at the accusers), and take the case to court in their own dang time, provided they can continue convincing the human rights judges of the merits of continuing to extend his detention each time (and then convincing the inevitable appeals court judges to uphold those rulings). The cope from the tater tots that "there's no evidence" and that's why they haven't filed charges yet is pure delusion on their part, Tate would already be a free man if that was actually the case.
@mugenzero007
@mugenzero007 Жыл бұрын
There’s truth to that. I believe that whatever you charge someone with in court, you have to prove that specific charge. If new charges are brought up after the fact, you can’t simply just ‘add’ them to the same case and try to proof said added charges. An entirely new case has to be made. And that takes time.

@matthewyoho5422
@matthewyoho5422 Жыл бұрын
@@conlawmeateater8792 You'll see those charges when they either run out the entire potential 180 detention period, or if the judge declines to extend that detention by the next requested 30 day increment (and then the court of appeal upholds that decision), whichever happens sooner: unless DIICOT thinks they've exhausted all their avenues of investigation, and there's nothing further to be found, then there's really no reason for them to rush things - it's only the (potential) halfway point.
