You’re right! The first trial was a mistrial because of the abuse. The second trial the prosecutor got it thrown out as prejudicial and that’s when they were convicted because the jury never knew about the abuse. The prosecutor is probably the one who doesn’t want to let it go because it will reflect poorly on them.

I feel like this part of why the brothers are still locked up but also that society at that time did not believe boys/men can be sexually abused, in every documentary, interview, article, that I’ve seen or read on the case, there was always someone involved in the case that didn’t believe men/boys could be r&ped or abused by their parent, even in the trial they asked questions suggesting that the brothers were gay, fine with being r&ped, etc. The brothers were accused of being liar even though those who examined them did see how much they were damaged/that there was no way they could lie about what they experienced

They could and did but there were limitations in its use. What is interesting ? The jury said that the sexual abuse did not factor into the verdict. But the jury also took capital punishment off the table because of it.

Your first reading on this case totally lines up with their version of events: Lyle told his dad he was taking his brother back to Princeton with him to get him the fuck away from his dad who had told Erik he would still have to spend a few nights a week at home even though he would be going to UCLA (presumably to continue the sexual relationship). Dad called Lyle’s bluff, said if you tell our secrets I’d rather be dead anyway. They realized they were never gonna be free of him, panicked and rage took over. So yes, given those circumstances and believing they suffered horrific abuse, I do think they should be free as I don’t think they’re a danger to society.

Netflix just released a new documentary today about the Menendez brothers and the original prosecutor Pamela Bozanich spent all her screen time talking about how Erik and Lyle are liars and it pisses her off that people believe them/ want them to be free. 3:05 - The judge was up for reelection and had a political agenda. In the 2nd trial, he needed a victory no matter the cost or casualties. He had pressure on him after OJ was acquitted. And Abramson (Menendez’ lawyer) was in the way of his reelection so he made it extremely difficult for her to argue her case while simultaneously limiting critical evidence into the trial for their defense.

The fact that you saw only one of the brothers potentially getting out of jail makes sense considering Erik (the youngest) fired first but didn’t kill the parents, Lyle was the one who shot the fatal blows. I believe they shot their parents out of rage and fear but that’s not what they initially intended, they wanted to threaten josé. Lyle being the one who ended up firing best is factual, they both deserve to be free but for the Justice system this fact could be relevant enough to let one go and not the other, that’s just what i’m saying 🤷🏻♀️.

And saying that one should go and one not at this time when they get a chance is destroying Lyle's chance. And yes Erik was the one who planned it. Erik already said in the documentary Lyle gets into this tragedy because of him and they get caught also because of him. If we are thinking of freeing them we are not really looking at this case from a legal system pov from the start.

If that ends up being true, That is going to cause more suffering for Erik. Lyle was his Brothers protector. He could of had a different life but chose Erik over all the materials items they could of had. He stopped their Father from ever hurting his Brother ever again. They couldn't be happy and normal brothers growing up. And then their world ended when they did what they done. Their punishment was also living 20 years without each other. So glad they are finally back together now. Just wish it was on the outside.

People need to actually stop saying that they did it because of abuse. They did it because they felt trapped in an impossible situation, because they believed to be in immediate danger. They lived in a highly controlling family. They didn't even have keys to their own house. The mum tapped phone conversations and stole Erik's diaries. Erik was told every time he was SAd that he would be killed if he ever told anyone, once he tried to say "no" his father put a knife to his throat. He thought he could escape when going to college and finally be free but learned that his Dad has mapped out his entire future, which courses he would take and that he had to sleep home several nights a week and that after college they would move to some island and he would be working for his father there. That's when Erik started to feel hopeless and ended up telling Lyle. Lyle then made the mistake of threatening to tell the family secret if he didn't let Erik go and that was when they thought their lives were in danger and honestly I have no doubt that someone like their father would in fact kill his sons before risking to be exposed. If they tried running away, he had all the resources and connections to track them down. Also as boys at that age, who would have believed them and were could they have turned too? There's no shelter for teenage boys and people still to this day don't understand abuse and control and how complex it is. But this wasn't simply about past trauma, they felt stuck and snapped out of fear.

Their story is so tragic and very sad. If only they got to live a different life. Erik had those images and could of been a Model. What I can't get out of my head. 1) there's bits in the GR evidence that points she certainly "could've" done more than was first believed... 2) there is absolutely evidence for the boys too. Plus there was discussion as to just how much was true in the case of GR and her "evidence" of her abuse. i seen a documentary yesterday that released in 2018 Erick telling his side of the story. This case got trialed TWICE because they jury couldn’t make a decision in the first time. In the second time of the trial the jury dismissed the boys to talk about their SA unlike the first trial they had family members, people that knew them, talking about the weird things that was going on and that did not happen in the second trial. It was mentioned by Erick that the system needed a victory because this was going on too when OJ case happened and we know what happened with that allegedly.. so they looked like fools to public. so spot on ant!!

I know this case pretty well. - Pam was the prosecutor and let me tell you, this woman is the epitome of close-minded. She wanted victory and completely believes in her heart that the whole abuse defense is fabricated even with the overwhelming amount of evidence from family members, medical experts, coaches, and the brother’s own testimonies. Even today, she is still saying that and she keeps saying that she is armed and willing to shoot supporters if they come at her. - The second trial was unfair due to the public being mad about the results of the OJ Simpson and Rodney King Trials. The LA DA office made it very political so that they could win something-where a lot of the evidence from the first trial was not admissible during the second trial (like the abuse defense). SO I CAN SEE THE CORRUPTION HERE. Because I feel like if they get released, there’s gonna be a whole another case probably and reopening the corruption that happened during that time. (Not my legal expert opinion, just my own personal opinion) If they separate the brothers again I will be sick to my stomach and I feel like the brothers would just want to stay in prison to be together.

I can definitely see how Lyle will stay in prison. He’s the older sibling, & they can try to say that Lyle somehow persuaded Erik to murder their parents, because Erik was 17/18 at the time. They also are already in separate prisons, & they’ve been separated for years. I really hope that isn’t the case though. It’s been long enough, free them both.

A lot of people don’t understand how much rage and anger a victim of horrific violence can affect their mindset. Some people will say “I been through this but I haven’t killed anyone” but unfortunately that isn’t everyone’s case. They maybe didn’t feel like they had a choice and the rage took over them. Even then I don’t feel like they should be locked up for the rest of their lives I think the brothers served enough time already.

Those people are also forgetting or not realising that many victims of abuse end up killing themselves. Others kill the abuser. It’s really not uncommon to kill the abuser. years of all kinds of abuse and torture makes people snap eventually. Even just emotional and psychological abuse can make people have a breakdown, but add all other abuse to it is even worse. I personally can’t even fathom how Erik survived all that abuse from 6-18 years old.

As controversial as the netflix series was, im glad it was made because its gotten this case talked about among a new and more compationate generation. I said this from the beginning and VERY few people listened. I’ve lived in LA 7 years and I’m in the industry. Their father Jose was a powerful record executive he was most certainly involved in some of the industry cults here and at the least he most certainly had friends in high places here. All the industry people here are in some sort of cult/secret society and all of the local PD is paid off by said cults. People can have their own beliefs however WE need to start holding our corrupt government ACCOUNTABLE local and otherwise. We need to start holding judges accountable. Enough with the kickbacks and “favors” at everyone’s expense. Shame on the person keeping these boys incarcerated just because they don’t wanna admit they were wrong. They have blood on their hands.

I hope they stay in jail for life, they were always old enough to reach out to the authorities. They massacred both parents never showed any remorse had wild lavish parties, but expensive cars when I’m shopping sprees & vacations ‼️

They would not have taken seriously two rich boys from an apparently perfect "American dream"-like family claiming to be raped by their father back then. Sexual abuse, especially in men, was treated very differently. Someone in their trial even said it's not possible for men to be raped. Also, their father wasn't just any man, he was the extremely powerful and rich Jose Menendez. They saw him all their lives getting away with everything and stepping all over authority figures. All of this combined with the severe trauma they carried all the way through their early childhood and the learned helplessness that it lead to, it's no surprise they thought there was no possible escape from him. This is an extremely common mindset in abuse victims. It can mess with your head and thought process in a terrible way. It's really not as easy as you paint it to be.

I believed them instantly. How many of us would’ve done better in their situation? Hell most people don’t experience that level of pain, control and abuse. I had such a hard time trying to find help outside of “family”. I got lucky but people need to reshape their minds and find some empathy. Who do you turn to for help from your parents if they raised you and are powerful, dangerous, rich and controlling over you??? They were threatened and abused. They did it fearing for their lives. End of story. FREE THE BROTHERS. I pray for their freedom and send them so much love and light. Protect them from the darkness of their terrible parents, the bias / ignorance of the world, judge and those in power too damn evil and corrupt to admit any wrongdoing.

I honestly think that if they were bought into an office, sat down and told "here's the deal... we will let one go, one stay." I'm not sure they would!! I understand that what they did was a VERY serious crime.. I would never deny that fact. But on the other hand, what their parents did to them was also a very serious crime 🙃. They have been locked up for decades now. Their testimonies were heartbreaking and gut wrenching accounts of the abuse they suffered at the hands of their parents almost their ENTIRE lives up to the point they did what they did. They have been exemplary inmates and I believe they deserve freedom now. It’s been more than long enough. They should be freed. They were prisoners in their own homes and went on to become prisoners in the real world. They truly deserved so much better.. 🥺

There are ppl still alive that 100% knows how bad the dad, Jose Menendez, was. His partner in crime, Edgardo Diaz who, no doubt has so many memories and shared stories of their terrible sick abuse of boys. I hope that the other Menudo members come together to prosecute Edgardo, and while that is happening the courts allow him some relief from his sentence if he outs other abusers like Jose Menendez.

Rob shapiro was their first lawyer and he wanted to settle and i think that would have been the best choice for them but the other blonde lawyer they hired cant remember her name allegedly she wasnt doing good on other cases and she needed the stund

That's not true. She was interviewed by Barbra Walters, and she said that out of 50 such cases, only 3 had gotten guilty murder verdicts. She was doing really well on her cases.

My issue is the prosecution didn't allow any of the sexual abuse into the second trial. ANY of it nor the choices of punishment for the jurors to select. It was either they were innocent or they murdered their parents. That pretty much ensured a guilty verdict. THAT is wrong. I think they deserve another trial with ALL of the sexual abuse and witnesses in the trial otherwise it wasn't a "fair and lawful" trial. The father did not have one person come forward as a character witness. Not one. That is how disliked he was. He was a monster...not the kids. I just want them to get a FAIR trial. Even if they got another trial it doesn't mean twelve jurors would unanimously vote the same but at least ALL of the evidence would have been admitted. I think that is fair. But, I hear what you're saying....it's an uphill battle for these men. Really tragic story.

The 56 witnesses that took stand at the first trial weren’t allowed at the second trial to take stand and at the second trial the judge didn’t let the abuse in so it was just a murder case. The prosecutor couldn’t find 1 person that had a single positive thing to say about the father. The documentary is really eye opening

I remember this trial, I also remember the horrific jokes on TV about them (basically making fun of the abuse). At that time it seemed like people did not want to acknowledge that abuse can happen to anyone. I don't know if it was the fact that the family was wealthy, if it was the way the brothers were presented-- I really don't know, I just know it seemed like TV personalities were very vocal about their opinions and they were not sympathetic. I just recently watched both Netflix pieces on them (the actual documentary was very interesting-gave some really good perspectives about how the 2nd trial went down and the very narrow instructions from the judge on what was admissible, and instructions to the jury about what the findings could actually be- really the 2nd jurors had no choice- it was either murder or no crime occurred. Other people from that time (not the prosecutor) were far more sympathetic, at least now.) You are very talented, also very thoughtful about the way you phrase things. You really are spot on.

3:24-The LAPD was receiving massive hits because of the McMartin trial, the Rodney King verdict, and OJ Simpson's acquittal. Many believe that the prosecution set the boys up as fall guys and were particularly tough on them so they could salvage their reputations from those hits. 6:17-That was the prevailing opinion at the time even from many who believed them. 6:42-The DA makes the final decisions so it all comes down to him. 8:30-I imagine if they go with one, it will be Erik. Whether he will be happy with it, I don't think so. 11:20-You also have to look at it this way: they lost their childhood to abusive parents. They lost their adulthood because of a long prison sentence in which they were separated until 2018. If they are released, they will probably have a difficult time adjusting to the outside world and may have more psychological and legal problems upon getting out. The stubborn energy could be from within themselves.

Siiiiigh this is some bullshit! There needs to be a law for people that were sexual abuse and wanted to escape that torture by killing their abuse. Yeah killing is bad of course but torture someone for yeaaaaars sexually and they feel like they have no other escape but do that makes sense! I’m tired of victims of sexual violence going to prison for so many years or life. That’s not Justice! They need to escape, they were desperate. Sexual Abuse victims deserve so much better than this shit. And what piss me the fuck off is that laws like Gay Panic law exist but not any for SA victims wtf!!! Fuck the Justice System .
