Two jurors who deliberated Nicolae Miu’s fate in the Apple River stabbing trial told FOX 9 the panel of 12 quickly focused on the issue of criminality between intentional and reckless homicide, with little support among jurors that the stabbings were done in self-defense.

So this guy getting beat up by multiple people and knocked down into the water isn't allowed to defend himself but an ex cop gets popcorn thrown at him in a movie theater and gets off by killing the guy?! Wtf?

some of them weren't even attacking him lol. Some of the teens touched him on the shoulder and told him to get the hell away. You can't just stab everyone in a 5 mile radius and claim your innocent. Especially hiding the knife, claiming the teens were armed, and lying to police multiple times.

@@mbkhan3116 With that level of brains and deductive reasoning, you should have been on that jury. Madison Coen the drunk belligerent women that charged up to shove Miu several times, cursing, until he finally pushed back and her sunglasses fell off. Face unmarked, Coen claimed he punched her, and then the thrower of the 1st real punch Dante Carlson - sucker punched, knocked Miu Down. Then the sucker puncher and 4 others started the beatdown, inc. pushing Miu's head back into the water 3 times. Then the stabbing began as Miu began fighting his attackers. Given how degraded and dumbed down Americans are becoming - I'd be very nervous to have to be forced to either plea guilty - or face a jury trial of ever more dumbed down Americans like those involved in the Miu Trial - if I was innocent or there were mitigating circumstances.

Did you watch him take the stand? Like the actual cross examination? The guy lied and lied and lied and lied over and over. His story was completely mixed up. It seems clear to me. The girls were harassing him, he got pissed off and he stabbed them. You cannot do that. It is what it is.

People that defend themselves avoid conflict like this. Miu stayed because his ego was hurt and he wasn’t gonna let some kids to that to him. He had 1000000 chances to avoid the situation instead he escalated it which is what the prosecution proved and miu admitted to himself. He claims to “stand his ground” in a non stand your ground state first of all. He made no attempt to retreat and willingly faced the “mob”. He made so many bad decisions that day, and you want to enable them. It will be a glorious day when you and miu shuffle off this mortal coil

He got about 15 feet before the 20 year olds physically stopped him by shoving him back and refusing to let him leave while everyone surrounded him in preparation for the planned attack.

Drunken provoking screaming in-his-face Lord of the Flies mob pushed and pushed, called Miu a pedo, and challenged each other to confrontation or get a physical reaction with "for the culture" chants and blocked his path to the shore to his friends. How did the 17 yr olds at 2.5x the legal limit, spoiling for a fight with an old man know he could swim when they knocked him down and backed him up into deeper water w/o a tube? Small town jurors were cowards and protected the local hoodlums and their parent's wrath at the cost of the out-of-towner's life sentence.

Good argument about what if he couldn’t swim. To me I would have looked at the language barrier and how well he spoke English. If I was defense. Either way, he’s a grown man and had plenty of chances to simply turn around and walk the other way. After he was hit, that’s another story.

@@b4lt1m0re_jay He got here 37 years ago. His twin brother who looks exactly like he did in 2022 has no or only very slight accent (see Christina Randall's video). Nic speaks 5 languages, so not exactly short on language skills, but in jail interview tries to talk like some disillusioned, naive child, reverting back to nearly babbling baby talk. PTSD from early life abuse CAN last a lifetime, but why no health history introduced in his defense about that? If he never got help for it, is his fight response an UNpredictable possibility? I doubt it. What did his friends and family know before they let him wander around loud obnoxious drunks unsupervised? He stated in an interview with Lt Hart that his only medications were for his heart condition.

You are as dumb as two bags of rocks. The juror clearly explained that they believed Miu forfeited his right to self defense by initiating the aggression. That means the people he stabbed were acting in self defense, or attempting to protect someone else who was under attack.

They were, too many things aren't taken into consideration. Miu was an older guy in not so perfect health and also had been drinking and these kids are yelling at him. Sure he hit some dumb girl, charge him for that if you wish, but still, he was severely outnumbered so what choice does he have? He was extremely nervous. He isn't used to being involved in criminal behavior. So he lied about a few things, so what? What's relevant is: was he defending himself at that moment, or was he not? That's all that's relevant and nothing else is, not what he said during the arrest, not what he said on the stand, not anything else. Just what he defending himself or not at that moment. The only thing you can say about anything related to the mistakes he made after are simply that he shouldn't have. People seem to have problems coming to terms with this and need to put themselves in the same situation: you're a 52 year old man that had major heart surgery two years ago and your surrounded by people less than half your age who by no fault of your own are yelling at you and getting in your face calling you a pedophile. You're drunk, they're drunk, you know you could possibly get hurt or killed but they won't stop taunting and in your frustration (and being called a pedophile is pretty much the worst thing you can be called) you hit one, now you're pushed into the water and you make a quick decision to defend yourself in the only way you can, with a knife, since you obviously can't take on all these people. So afterwords the police come, you're nervous since you know you're life has completely changed now, so in nervousness you simply lie about it, no different than if a cop asks if you got weed in the car. It's not like he had all the time in the world to think this through and how he would respond. He had no record, so he didn't right of the bat think to keep his mouth shut during the arrest and get a lawyer. But basically what it comes down to is he shouldn't be guilty based on mistakes he made after, he shouldn't be guilty ONLY if he wasn't defending himself, that's it.

The "punch" was not on the video and was only "witnessed" by others who would only benefit to say they saw a punch. What is visible is Mui getting attacked by 3+ people at once. The jury; just like the witnesses who seemed to all have the same lie ready for court, became emotional that an almost adult was killed and based their verdict on that. They are wrong and I hope they are never surrounded by a bunch of drunk morons yelling and cursing at them.

@@TrevByTheTon300 The jury got it right, although I was surprised at the speed. That's partially the fault of the trial lawyers and the amount of "filler" and stupid tangents they go off on in their questioning of witnesses. Like the big deal over Miu carrying the knife in his pocket. Everyone knows that the issue is not that he had it with him that day, it's how, when, and why he used it during the relevant confrontation. Or the defense lawyer over-emphasizing the swear words used by Madison. You don't go into a party venue and not expect to hear bad language where everyone had been drinking for 3+ hours. There was a lot of "filler". They should have stayed focused if they want jurors to focus on facts in their deliberations, IMO.

They weren't all together, there were witnesses from two separate groups. You should probably familiarize yourself with the basic facts of the case before lamenting being born in "this era." Anyway, your theory is that two groups conspired to lie, and that lie just happened to be backed up by the people shouting "You hit a woman" on video, immediately after it is alleged to have happened? And the perpetrator himself admitted to "pushing" her in some way, but conveniently claimed he COULDN'T REMEMBER where on her body he hit her? He was incredibly cagey and selective in his responses when asked about it. He had a chance to flat out deny hitting her in the face, and he didn't.

I get it! They all had a reason to be mad at the defendant. He just stabbed their friends and family members. Never mind the reason. He stabbed them. I guess I can’t blame them for being angry anymore than I can blame Mr Miu for being angry for being accused to being a chomo unfairly and for no reason. It seemed to be more about who was in whose side. Unfortunately, Mr Miu’s friends were all far away and didn’t really see much of what was going on until after the violence stsrted and even then they didn’t see what actually happened. I think they were all to engaged in their own conversations and activities that they forgot all about him. Only his wife was concerned which makes sense. It wasn’t until after she saw him on the ground that she sent over two of their friends to go get him or see what was going on. By the time they got there it was too late hell already broke loose. I can imagine it was like this “Nick! What happened? Are you ok?” Nick: Yes I’m fine. Some incident just happened. Friends: What happened? Nick: I don’t know. Let’s get away from the scene. Wife: Nick was just happened? I saw you on the ground! Nick: It’s nothing! Just some incident but i don’t know what happened. I don’t want anything to do with it. I think we should move on. Friend: Nick I heard there was somebody or people stabbed! Do you see anything? Nick: Yes, I heard but i don’t know who did it. I think we should move on. Too bad we will never know if what the outcome would have been if he decided to stay on the scene and explain what happened or just claimed his 5th Amendment rights. Bet it would be wildly different

I don’t think he punched her, in the second video as LE are just arriving, she is walking up the embankment hair down & completely dry. I don’t underestimate why defense didn’t zero in on that. It was in witness Lorrion Davis’s video. She knew she escalated the entire situation & got out of there real fast. She was also the ONLY one that didn’t testify on camera.

Justice not served. Jurors were paid off or did not have enough time to replay the footage. Jurors weren't allowed to review the footage at their own time. Jurors aren't anonymous too, the judge read out their names and their decisions. This needs a retrial. It was a mess.

@@Defender78 If people were allowed to pull out a knife and start stabbing whenever teenagers got cocky, we'd all be in serious trouble! Even if he hadn't have thrown the first punch, you don't bring a knife to a fist fight! Especially if you are hiding said knife. Big difference between showing your weapon and hiding it until you want to use it. That was the deciding factor to me. I saw the look on his face, in that video, the moment he made the decision to pull out that knife. He was the only person on that river who knew he had a knife and that knowledge led him to the conclusion it did. Those kids would not have challenged him if they had known he had a weapon.

@@missmochiicecream Whether you agree with it being self defense or not, if you roll up to a person and start calling him a pedro and raper etc., don't expect all people to shrug it off. This was a case of social media meeting up with real life. That kid with the camera taunting the guy and the girl that came over and started shoving him are responsible for this going haywire. Perhaps 30 or 40 years from now they'll start doing some objective thinking about it and realize the role they played in this.

At the start, Ryleigh reported it was not a punch, but she changed her story because they all had to get on the same page & say it was a punch to try to justify their attack. That's why none of them could describe it consistently. One of them insisted it was a punch even though he didn't see it! If you're using reason, you know there was a slight contact, as the defendant testified, with the belligerent woman yelling in his face, pushing on his chest, and blocking his path. That's why there was no physical reaction from her (just more yelling) showing her reeling, why she had no bruises or swelling, and why she lied about the deleted photos. The video supports the defendant's account from the stand & is at direct odds with the 2 groups, especially that they were scared little kids. They were a drunken, hostile, inciteful mob that went full-on Lord of the Flies.

They created the hostile climate surrounding him. When the prosecutor said "senseless", he was right. But not in the way most of us saw it.

@user-cf6tm8yh2h Nic started the violence first, with the teens. It's on the video, at the beginning. We see Nic 50 ft away, Nic turns around and starts rushing back towards teens. We can hear the teens saying, "what is he on?" "Woooooa" "Whooooa" (the sound we make stopping a horse) as Nic is getting closer to the teens Nic, then jumps on the teens tubes, grabbing 2 of the teens legs. That's when the teens jumped up and got all defensive, calling Nic a pedophile. Completely deserved. We even hear the teens tell Nic, "to go away". Nic came into the teens area, the 2 groups never went into Nics area. Nics group was waiting for him and he should have left before he ever turned his deadly weapon on a bunch of young people, who couldn't even defend themselves from that drunk psychopath.. seems Nics wife, saw the criminal in him. The whole video we see. is the groups retaliation, for Nic stabbing everyone. Did you people expect those people there, to do absolutely nothing back to Nic? Ya right.

The jury understood that Miu was the initial aggressor. He placed himself there in order to cause conflict and violence. Therefore, he had no right to ‘stand his ground.’ Miu destroyed his own credibility by repeatedly making that claim while on the witness stand. Yet now here you are repeating the same fallacy. The video itself shows both ladies assault him by shoving his chest before the fight even starts. I doubt he even punched the blonde lady, she still had her drink in her hand as he is being pushed down. May he appeal his conviction. Then putt true justice jurors on the bench. This should be a lengthy trial. He didn't just hurry up to their rafts for no reason either. Not shown on video.

I mean, you can see his focus is on his search. He doesn't really ever make eye contact with them. They provide the commentary that he tripped, so not sure what some are looking at. He actually moves away from them more than once, but when the women come, they close in on him. No evidence of a punch either. It's a ridiculous claim.

It would have been a hung jury if I were on the panel. What a sham verdict. I didn’t see any evidence that he threw the first punch against a dozen adversaries other than the testimonies of the same people who were looking to justify their own abhorrent behavior. He was only guilty of lying AFTER THE FACT because he was afraid of getting in trouble and of being a horrible witness. Nevertheless the video showed he was being accosted by a hostile mob. The guy talked about how he could have walked away. He was surrounded. What about noticing that the victims were not walking away.

He didn't throw a single punch the entire video, but the jurors decided to believe the habitual lying punk highschool football players that he punched Madison off camera. It took them less then a day to deliberate, put Miu in prison for life because they believed 'for the culture' ring leader Jawahn. The defense did their job defending against Intentional but the prosecution cunningly and snakingly threw everything else in the book at the very end because they knew they lost their case. The uniformed jury fell for it. Terrible slimly prosecution and poorly instructed weak jury. Sad, I hope Miu gets pardoned.

Did you even watch the trial, miu basically admitted it, his own friends testified they saw him do it, on video you hear everyone say “you dont hit a girl”, and witnesses that weren’t involved testified he did. A medical professional testified she was likely punched. Get over it, jesus… He pulled knife right before hitting her when nobody had even touched him… how do you defend this? We had more people that said he punched her, so they say. I saw that , witnesses saying it happened. No video evidence of this to save the day. Trouble was inconsistencies in the stories, I did not think them kids were credible. I think they texted and made up a story in the months prior to trial. Would love to subpoena all the cell phone records to make sure they were not scheming and convicting a man that was trying to not get pounded into the river. Nobody held back and everyone was healthy enough to walk away, not just Miu! I also think it’s disgusting of the prosecutor to not charge for underage drinking or anything for them including the Cannibis possession. There is no medical or recreational in Wisconsin, that’s an arrest in Wisconsin. I don’t agree with the verdict , some twisted logic there.

Almost all our all of them told police about the supposed punch. I think every single one said their statements to police about the punch was false because they all made the mistake of trying to describe the fake punch, so everyone's story was different before they could cordinate the lie. Enough was flushed out in the trial that anyone claiming he punched the girl is lying and knows it. Both tactics used by the mob are well known tactics used by groups that want to have fun beating up a stranger for fun. - falsely call someone a pedo and try to incite other random people to get involved in the beating (pedo is moral/pseudo legal justification and cover for the beating, including other strangers is cover) - Send in a women to start the fight with the men right behind her. At this point the beating is going to happen since any movement even to walk away or just block will be claimed as hitting a girl and 'justifying' brutally beating up the victim. Notice how fast everyone mobbed in, everyone knew the game plan. Not one single white knight thought to protect the girls by getting them away or stopping them from physically fighting with a stranger.

I didn't buy the "punch." I don't think walking downriver is a strategy to get away from people who are floating downriver. I think Miu was defending himself and the kids were lying BUT that Miu's apparent callousness and entitlement convicted him. He did not come across like a scared, feeble old man...which at the time of the incident, he may well have been.

Drunk young men and women started the entire event at / in the Apple River that day. Mr Miu was on his own, well behaved, minding his own business, not disturbing anyone and looking for something with his goggles in shallow water. It was totally unnecessary to be confronted by drunk youths, who also unnecessarily started horrible name-calling and harrassment of Mr Miu. Soon gradually joined by equally dunk youths, the harassment continued and escalated. Mr Miu did not bring a knife on that day, planning or hoping to injure, or kill, someone. It apears that the sport tubing requires knives for cutting ropes, etc. Like other people, Mr Miu was in possession of a knife for that purpose. Mr Miu was a single person, being confronted and aggrevated by a group of very drunk people, also having knives in their possession. It was, however, wrong swinging the knife, injuring people. On the other hand, If the drunk youth minded their own business and left Mr Miu alone to enjoy his day at the river, the entire horrible event would have been avoided !!!!!!!!!!

The guy the phone belonged to, that Miu went to go look for - there was testimony saying that he didn't want Miu to go and look for the phone but Miu did it anyway. Multiple times he had an opportunity to avoid conflict and get out of the situation, but he didn't. It's only insanity because you choose to see what you want to see and ignore everything else.

JACKPOT! The jurors blamed Miu for failing to retreat; but as the defense-lawyer said, there is NO DUTY to retreat, under Wisconsin law. So the verdict was unconstitutional, and now Miu can appeal on that basis. And what's more, they're saying "he can't claim self defense if he hit first," but that's WRONG since they ILLEGALLY PROVOKED it. This is the most messed-up case I've EVER seen, and it makes me sick; and I can't imagine this will go to sentencing.

The juror said Miu could have walked away. You know who else could have walked away? A) The Carlson group. B) the teenager group. But wait!! Actually both those groups had to actually walk INTO the final moments of the confrontation. The Carlson group from across the river and the teenagers had to FOLOW Miu as he walked over 5 or 6 steps toward Madison Coen (very wrongly thinking he could explain his side of the story to Madison). In fact in their case the teenagers could have literally sat down in their tubes and the river would have carried them away. They wouldn't even have to lose any face or have a bruised ego. They could have walked away feeling like 'we showed that guy' In addition to that - Wisconsin has no "duty to retreat" so if they were actually applying the law the juror would never say that . I'm not really on Miu's side. I think if you put me in charge of both deciding what charges there would be and what sentences there should be I would probably send Miu, Dante, and A.J. to a year or two in prison and Madison and Rhyle (sp?) to jail for a couple months. Without the Carlson group it would have just been an argument. In fact I suspect without Madison's fingers and phone stuck in Miu's face no one would have been punched or killed. Good job Madison.

@@AshleyWarrick-s7m Yeah I thought so too. The way I read it Madison was the one who insisted that she not testify on camera and was refusing to even testify in the beginning. I don't know if you caught it in the trial but the Carlson dad claimed on the stand that he saw a picture of Madison's supposed swollen cheek from the punch on Madison's mom's phone but that the investigators didn't want the picture. That seemed total BS to me. That whole supposed punch happened in about 2 seconds. A whole bunch of the participants claimed she was knocked over until the video showed otherwise.

I don't know that he is entirely innocent but I also can see that he was put in a really bad position and it's similar to some experiences I have had so I have some empathy for what it is like to have a large group (or two groups) aggressively antagonize you and surround you. I saw a legal analysis of it done by a lawyer and he felt that he would be sentenced to near the max which would be a life sentence for him. He's a 52 year old engineer with zero criminal record prior to this incident compared to the numerous felonies accumulated by some of the opposing party in their early 20s. Watching their behavior on the video it did not surprise me when they reported their criminal histories

There is NO proof he punched or hit Madison. They went entirely off of what everyone was saying, even though stories differed dramatically. She also didn’t have ANY marks proving she was hit. The impression I got was that he swapped her hand away when she raised it to him. I hope he appeals, as this alone is enough to cast the decision into question. The jury did not even factor in reasonable doubt.

I recall Chirafisi instructing the jury during summation, If you think the Defendant...acted in self-defense, probably acted in self-defense, possibly acted in self-defense, possibly didn't act in self-defense, or even probably didn't act in self-defense, then...you must acquit.

The location of the trial was wrong, the selection of the jurors was wrong and everything was set up from the start to convict him disregarding truth and common sense. I do not believe mr Miu had the speed to chase them one by one and stab them. Most likely he stabbed them when they gang jumped on him. A lot of these young men lied or changed their story during trial but the jurors did not care. Defense lost the trial probably on purpose by accepting the trial so close to the aggressors that are now considered victims. They said he should have walked away but obviously they pretend they don't know or understand that his group was not down the river, nobody owns the rights to be on the river and most importantly they have amnesia and forget that they were coming at him seconds before the incident as he was on the retreat as he is punched/pushed in the water. This decision is as racist as it gets. Puppet show trial!

being judged by a jury of your peers is the WORST possible situation you can be in. that's a jury of average members of society. think about how dumb the average person is that you encounter during your day-to-day. that's your jury. they get to decide your fate based on a lot of he said, she said. a lot of them could sit there, have a lawyer gas light them that grass is always red, and decide to believe him with reasoning along the lines of "he's a lawyer. he must be smart".

A travesty of justice. There's nothing in the video backing up the claims of the jurors, on the contrary it supports mr Miu's version. You have to be willfully obtuse to believe the "victims" distortions and contradictions.
