Wtf do you mean? This guy started as an underdog, a rookie that barely got a shot and was supposed to be fired and built a whole ass legacy, how can you not place him as a top tier? The matches he had with Randy Orton, the rivalry with Seth and the Authority only built him bigger after his glory years.

Hey, you described pretty much all the top stars in WWE history: $7 Rocky Maivia, The Ringmaster, Mick Foley, etc had to struggle as an underdog. John Cena is an all-time great, but he's not a Michael Jordan/LeBron James level relative to the WWE. He's like a Magic Johnson or Larry Bird, an all-timer for sure, but not that top-level Pantheon.
