Supposedly he was negative for alcohol, which not sure how accurate that could be by then. Wife said he was having a diabetic episode, but no history of diabetes.

I think you give too much support to Payne’s argument by saying that Mr. Herring “attacked” her. He was in his vehicle and she intruded in his space and assaulted him. It was aggravated assault because she was threatening serious bodily harm or death and produced a deadly weapon. Anything that Mr. Herring did under those circumstances can only be fairly described as defending himself, not attacking Payne. I don’t give any credibility to Payne’s version of events. The jurors didn’t either.

I honestly think more emphasis should have been placed on the fact that Kenneth must have been afraid for his life and was DEFENDING himself and not "attacking" Hanna. I find it hard to believe that anyone would "not, NOT" defend themselves after a stranger cornered them with their vehicle, ran up to their vehicle WITH A GUN (because he didn't run to her vehicle and grab the gun) screaming and swearing at them, reaching into their car and punching them(witness statements, video footage). I cannot be 100% sure but I do believe that the average citizen would have fought back... He did not "attack" her.

I agree and would add that if a person obtains a permit and related weapon they take on the responsibility to learn, understand and retain the legal permissions and prohibitions associated with carrying. It is clear that she did not do this. Additionally, although not stated, I am thinking that there is a good possibility that there was a racial element involved in Hannah's decision to engage with the victim. That's speculation, I know, but there is an elephant in the room.

I think you portrayed Hannah more fairly than she deserves, Dr Grande. Listening to the 911 calls and the way she barked orders at the operator as well as how she responded once he had been shot, she was cocky, arrogant and self-important. She did not chase Kenneth because she felt she was permitted to by the corrections officer, she was going to complete her grandiose desire to be a heroine no matter who was around and counselled her. Hannah Payne truly believed she was justified in her pursuit and then screaming those expletives at an evidently terrified, elderly and disoriented innocent man who may have been having a diabetic episode. Her disdain for him was palpable on the calls. It was chilling!

He waited for about 20 min. after the accident and then drove off. His wife says he was possibly going to the hospital. Hannah decided that this man was drunk, without any evidence and chased him down and killed him. My heart and prayers go out to Mr. Herring's family and all those who loved and cared about him. And Hannah was driving recklessly following Mr. Herring. And Hannah showed that she didn't value the safety of others by the way she was driving, and she too caused an accident with Mr. Kenneth Herring.

It was the gun that emboldened her. Had she been unarmed she probably just gets the plate number and returns back to the scene. It was the gun that made her think she could go up to his car and bark orders at him to get out of his car. Agreed, but the case that was presented by the prosecution was contradicted by their own witnesses and their star witness repeatedly contradicted herself while on the stand. *The defense didn't object to the prosecutions speculation about a medical emergency to have it stricken from the record, and that witness should have been impeached and her testimony impeached based on other independent witnesses testifying to seeing the same thing which was contrary to that witness, and it discredited her.* That witnesses that lied was their star witness! She's certainly guilty, but not in the way the case was presented.

Most concealed carry courses stress the fact that just because you have a permit to carry a concealed handgun it doesn't make you a cop. I have met enough people who don't seem to understand that fact that it concerns me. Everyone has the right to keep and bear arms. But not everyone is smart enough to exercise that right responsibly. I'm sure she showed her entitled personality in past behavior but this time a 62-year-old man lost his life as a result. She should have taken a plea but she decided to roll the dice and now faces years in prison.

The symptoms of a diabetic crisis involve confusion, slurred speech, flushed skin, fruity aroma breath and can be easily mistaken for intoxication. The symptoms can impair driving and result in an accident. However, such an accident due to unexpected medical impairment is not a violation of traffic codes. The woman vigilante had no standing in undertaking actions to enforce traffic laws, esp when directed to cease by the police dispatcher. The use of deadly force was unjustified in this case.

Note that reasonably foreseeable medical impairment that endangers others IS culpable. If one is a diagnosed diabetic and is negligent over medication and driving, that entails culpability. Other medical conditions would prevent one from legally driving and are required to be reported.

Perhaps a detailed interview and examination with Mr. Herring would have provided more detailed insight, but the only evidence available in court was medical history, officer testimony, and autopsy/toxicology. The first officers arriving at the scene identified Mr. Herring as suffering from abdominal gunshot wound and diabetic shock. The toxicology showed no alcohol or drug impairment. Prosecutors brought up this point at trial. No evidence was presented that Mr. Herring was somehow not compliant with medical requirements.

I believe this poor man was having a medical emergency. And instead of getting help, he was assaulted and shot to death. I am sure someone at the car accident scene had plenty of time to get his plate number, and the police could have dealt with this. People need to realize that often people are having a medical issue, and that is the cause of their confusion and not because they are intoxicated. She had so many opportunities to just stop, but she made mistake after mistake. Tragic all the way around.

Because confusion/disorientation is a symptom of hypoglycemia (low blood sugar). Sufferers can also become combative or aggressive. If not treated it can lead to unconsciousness and potential death.

This reminds me of George Zimmerman and Trayvon Martin, particularly in that the emergency services operator repeatedly told an undeputized citizen to cease pursuing a "suspect," and the shooter refused to listen to this. These are not people who respect authority, but entitled people who take it upon themselves to act as they *feel* they should be authorized to do.

Zimmerman lived in the neighborhood and was in the neighborhood watch (was the head iirc). He had a legitimate reason to be watchful and protective of the neighborhood and was carrying out that duty when he saw what he thought to be a suspicious person. There is also evidence Trayvon both attacked and injured Zimmerman before Zimmerman drew his firearm. So the cases are not the same at all. Zimmerman was acquitted because he did nothing illegal.

Giving the 911 operator a general direction the vehicle went and a license plate number is one thing. Chasing it down is another. Reminds me of the time I witnessed a robbery at a Wal-Mart. My gf and I had just entered my vehicle and saw all these folks running out of the store with clothing and other items. As they left the scene I followed them from a distance to get their plates and had my gf call the police. I eventually caught uo with them and reported the plates to the police. That was it. Didn’t take the police to tell me “Dont persue, dont engage” My part was done. Point: What happened to common sense? Seems absent in Payne’s case. Being a good citizen is great. Being Karenwoman..? Not so much.

Thank God she was convicted. This kind of scenario scares me so much. So many people are armed nowadays, and you can never tell when someone will open fire. Where I live, there have been two road rage incidents in the past few years where someone was shot by another driver. I myself was followed all the way to my home by a crazy driver who must have thought I did something wrong. I'm 71 years old and drive like the old lady I am. I don't know what could have made that man do that. I managed to get into my house before he got there and I called 911 right away. The man pounded on my door but left before the police came. I often think that if he had a gun, I have no doubt that he would have shot me. He was obviously disturbed. A man was shot just driving down the freeway by another driver who was never found. The shot man veered into the median and was killed. I have gotten to the point where I am afraid to be in crowds because I'm afraid of all the people who probably have guns. Life in the US has turned so dangerous now with all the guns. It's really frightening.

In the future, if you suspect someone's following you, PLEASE fight the natural instinct to drive home, get inside, and lock the doors. Doing so leads the nutjob right to your front door. If you can, drive to a police station/sub-station, a firehouse, the ER...anywhere that law enforcement/security/authoritative personnel may be and let someone know that you think you're being followed. Hannah had a lot of opportunities to de-escalate things... Shouldn’t have pursued. Should have disengaged as soon as she has successfully relayed the tag number to the 911 operator. Should not have blocked the victim’s vehicle. Should not have brought a gun into the mix. Should not have approached the victim and giving him orders. I like what the prosecution said during closing arguments.... You can’t poke a bear and then when it turns around and starts attacking you, use that as justification for self-defense. Hannah was the aggressor. If anyone can claim self-defense in this scenario, it was the victim.

You have a reasonable presentation of her actions, but the prosecution also misrepresented the case. Their star witness lied multiple times and her defense did nothing. They introduced speculation into the court record and her defense failed to object because it would have been stricken. The other independent witnesses testified he rammed her vehicle and there was a mutual struggle through the window. The fact that he rolled the window down is also an important piece of evidence, because she didn't pull the gun out and order him to roll it down, he had the window down well before she pulled the gun. She's guilty, but it was a 70/30 reality rather than 100% her. I am not saying she shouldn't have been convicted, but the case was misrepresented and she was given a black prosecutor and black judge so her race was on trial just as much as her actions. *All the shit I'm reading from armchair lawyers and social justice warriors is a product of people being easily manipulated and refusing to look at both sides of the evidence.* 43 years is insane. 10 or 15 would be fair.

@@JonDeth Lying is too strong a word, IMHO. It all happened 4 and a half years ago and not all witnesses have photographic memory. Jeez, I can't even remember the color of the jacket the motorcycle rider who cut me in traffic this morning was wearing. In these cases, you just need enough corroborating facts among witnesses to put it in favor or against the defendant. There are video evidence as well, which corroborated with witness testimonies.... for the most part. I look at it this way... Hannah made bad judgments one on top of the other but the worst thing she did was unholster her gun. That one single action turned it from a traffic altercation into a homicide. She inserted herself into that situation and started playing the part of an officer. The victim, medical condition notwithstanding, didn't even try to open his door or much less, step out of his truck. He did plow into the jeep, but again, it's a traffic altercation. She had his tag number and she should've stepped back and let a real officer take over.

@@orlypalomar that's not true. Those people were interviewed immediately after the murder and gave signed sworn statements. Their star witness mid testimony said she couldn't see if the windows was down and didn't way to say it was up per-say, then said she "felt like it must have been down some" which makes her an uncredible witness. *When a witness cannot remember specific details critical to the event like that, they then become impeachable and their testimony impeachable, but her lawyers did nothing.* Hannah's lawyer failed to object and pursue impeachment which was catastrophic for her defense regardless of her version of events. That witness most certainly lied and had to change her story mid testimony or it would have had Hannah shooting him through a closed window. Multiple other independent witnesses testified to his ramming the car, the fighting through the window, and then shot fired. That witness had uncertainty about critical details but said there was no fighting, she shot him in cold blood and then said "now you need an ambulance" also in cold blood. She blatantly lied and her demeanor in general was of malice and spite, not anger over witnessing a murder. If you are a witness, including a police officer, and you cannot remember these critical details, *it's factually grounds for dismissal if that is the arresting officer.* The prosecution also used the theory that he was having a medical emergency which is speculation and her defense team should have moved to strike from the record, *but again, they did nothing!* I agree, she initiated all of it and pursued it, however, his hit and run behavior is evidence that he would have become hostile and combative upon her confrontation, and this makes it reasonable that he initiated the actual physical confrontation. She is guilty, but of a much lesser crime than she was convicted of and the court was coordinated against her intentionally so their ridiculous version of events went unchallenged. He was a humble, innocent and sick man in need of help that she hunted down and murdered lol! *It's utterly ridiculous and a miscarriage of justice.* 10 or 15 years with parole would have been more appropriate. If she's telling the truth about him assaulting her, grabbing onto her and trying to drag her away, *she's still guilty of creating the entire conflict and should be found guilty of manslaughter, but 43 years based on actual facts as opposed to speculation and a witness that blatantly lied?* If that star witness saw all that and heard all that, she would have saw the physical altercation, known if the window was up or down and many other critical details. *So, yes, she most certainly lied to ensure she was convicted.* Hannah also gave "direct evidence" which is known as testimony. This makes 3 witnesses on the stand testifying to her version of events being credible, whether or not her entire version was true. *What if it was!* It's still irrelevant IMO because she initiated everything that occurred by pursuing him and having the arrogance and bravado because she was carrying a gun.

If you believe she should have received 10-15 years in prison, then you agree she was guilty of one of the non-fatal felonies (aggravated assault or false imprisonment), and possession of a firearm when committing a felony (8+5 years). It doesn't matter at that point, she committed a felony, if someone dies directly or indirectly of a felony then they are guilty of felony murder. Even if it was self defense she's still guilty of felony murder she gets the 43 years. So you see why she tried so hard to claim on the stand she did not cut his car off and that he attacked her and he shot himself. The only way she could have avoided life in prison was to be found not guilty of the false imprisonment and aggravated assault charges. She was convicted of malice murder, its the same penalty so the felony murder counts were dismissed. Even based on your argument she is not guilty of malice murder, she then is still guilty of felony murder, she still gets the 43 years. Also I don't see your point about the witnesses seeing him ramming her car. Him crashing into her car merely proves the false imprisonment charge. Her car partially blocked his car's path, and if he crashed into her car then clearly he was trying to flee her attempts to keep him there. Her Jeep blocking him in, then she pulling a gun on him is false imprisonment, again that's a felony.

@@russell-di8js It's obvious she was tryign to act "cop like" which is what i meant. She obviously got triggered and lost control. come to think of it, that is how COPS act these days- they tend to get triggered and lose control at times. (Ffloyd, etc.)

Citizen's arrest is not the problem. *Abuse* of citizen's arrest is the problem. Nobody should attempt a citizen's arrest who does not know the boundaries on it that the state's law places -- either by studying the relevant statutes or (better) consulting with a lawyer. Because if you break those boundaries, guess what? *You* may be wearing orange in court.

So for a citizens arrest to be lawful you have to witness someone commit a serious felony. Grape, murder, robbery those kinds of things. And you have to use reasonable force in order to restrain them until the police arrive. So someone tries to rob the cashier at a gas station in front of you and you tackle them and hold them down until the police arrive. It doesn't mean pursue the person and shoot an unarmed man that was in a relatively minor accident.

You know what else infuriates me? When people watch someone getting attacked and they look the other way, or film it on their cell phone. Not having an OUNCE or SHRED of care for anything but themselves, but you dont get arrested for that do you

Pretty accurate assessment I think. The thing people do not seem to understand is that if you pull a weapon in an altercation then people may die. This goes both ways with people pulling weapons who are not really willing to use them and people who are overeager to use them. I am usually armed when I am not at home and never once did I pull a weapon, because that is the highest kind of escalation you can have. I am armed to protect myself, not to pick a fight.

Honestly, this is why I don't carry a pistol around. I know I can be confrontational, and at times I make rash decisions based on emotion. So I keep my guns at home. Yes, that means that I am leaving a small security gap in my life, but I weight that gap against the higher likelihood that I'll do something insane while armed, and spend the rest of my life in prison. Ultimately, we have to be honest with ourselves about our shortcomings if we hope to succeed in spite of them.

this decision is very wise especially because it means your firearms are less likely to be stolen if they are secured at home! I know so many people who have had their firearms stolen from their cars. A lot of times the cons outweigh the pros when it comes to having a firearm somewhere outside of your home.

Concealed carry is not a problem for people of average intelligence. There are very specific guidelines to follow to stay within the law. This is learned when you apply for a license to carry concealed.

I'm referring to making a self assessment about how likely I am to lose my temper while carrying a firearm, and how that firearm immediately makes that potential lapse of judgement deadly serious. I understand the law, I just act before I think when I get angry. It's a problem that I wrestle with, and I think carrying a firearm around would make everyone less safe, including me. That's just me though. I support more well balanced people carrying their guns in public. My brother in law is one of those types.

Perhaps, this 21 year old was trying to "prove something" - like, she could make an example of a senior citizen breaking the law... Not considering, medical conditions could, I guess, 'mimic' intoxication, from low blood sugar levels perhaps, is being *rash.* So, not being an expert, the pursuit was made more dangerous in my opinion! This person who could not take (lawful) instructions herself, was "performing duties" that was best left to the officers of the law.

This is so reminiscent of the Trayvon Martin murder. Once again, someone feels it’s their right to follow someone Black even after they were told not to by a 911 operator and end up murdering someone. Why did she think she had the right to police this elderly man when she wasn’t the police? And the disgusting thing is she thinks she did nothing wrong!

According to the testimony on the witness stand. Many witnesses said he had the window halfway down, she was freaking out and banging on his car with her hands and putting them through the open part of the window. When she pulls the gun out to shoot him she said something extremely mean and then shot him. I forgot the exact statement.

my theory is that hannah was a busybody who not only had too much time on her hands (did she even have a job?) but probably not getting something most young women want and need which was a source of anger and resentment for her leading to the victimization of an innocent person she had never even met before⚛😀

I think it’s telling of her character that on the witness stand during direct, she mentioned something along the lines of “now I’ll never help anyone again”. I really think that shows her state of mind. To her, “helping someone” meant commandeering a situation you had nothing to do with and becoming physical with someone. Where as, the correct thing to do that actually would’ve “helped someone” is take a picture of the tag immediately instead of waiting 20 minutes or staying and telling officers a description and direction. Now a man’s life was taken and a young woman’s is effectively over.

Agreed, it's another case out of Georgia, where someone thinks they're doing the moral and legal thing, only to find out they have absolutely no understanding of the law. If your going to carry a concealed weapon, you have to know the laws in your state.

He was not drunk he was most likely having a diabetic episode. Unfortunately, though we will never know because she shot and killed him. Regardless, he along with the other driver, waited about 20 minutes, and the cops did not show up before he decided to leave which he probably should not have done but nonetheless, she should’ve never went after him, especially not being in the accident herself.
