@@JulioCerdaJulioCCerda I think it is fine that they "investigate" undercover, but they should identify themselves when they are going for the arrest, otherwise how is one supposed to know they have legal authority to do so. It is similar to when police force their way into someone's house, they might even have a legal back up to do so, but if they don't identify themselves in any way, the occupant will only know that someone is forcing entry to their homes, and in their perspective, they'll be justified in defending themselves. Knowing that they are cops, they might cooperate -not always, but at least more often than if cops don't identify themselves-.

If a y plain clothes officer, goes to a civilian then escalates the situation to the point it's going south, and if he refuses to identify himself, then the civilian is entitled to defend themselves with deadly force. I don't CARE if its a cop that gets shot. They make up rules and lie all the time because they get away with it while turning the public into victims, of their brutality.

The Knower of the hidden and the manifest. He is exalted, far above what they associate. (91-92 / Translated by ITANI). Allah means the one and only God, the God of all prophets and creatures, the creator of the universe and mankind, and the Master of the Day of judgment, where our destiny, Hell or Paradise, is decided based on our faith and deeds in this trial life, and above all, Allah's mercy. Allah said in Surah Al-Ikhlas : In the name of God, the Gracious, the Merciful. Say, “He is God, the One. God, the Absolute. He begets not, nor was He begotten. I mean, true, but at the same time a random person just showing up to the police and dropping off a package without identifying who they are opens up a can of worms. They are right about companies identifying themselves as workers for that company when it comes to delivering to places with higher security. Both sides, honestly, went about this poorly, but it does highlight an issue when it comes to making deliveries to certain places.

Yeah they were so scared of the envelope that they left it on the counter, didn't clear the area, didn't call a bomb or drug sniffing dog etc. They were so scared of it that they all stayed within close proximity of it while taking literally 0 precautions. I made this argument on KZbin. A real lawyer should be able to dismantle any argument they try to make about being concerned about the letter.

Most process servers hand you the package and say you have been served as they are legally required to do. This was a super fishy drop off IMHO that could have been settled with a quick examination or explanation by guy instead of baiting a lawsuit.

@@edsloan8535 Fishy? Really? How many packages a day do you think are delivered to that same department, where the person delivering never does anything they're requesting of this man? Id say what? Half a dozen, maybe a dozen? Lets be honest here. This was an incident because an undercover officer, who was not actually an undercover officer, rather an inactive, retired officer, illegally did what he did. Im willing to bet, he was forced into retirement because he does not seem like he wants to be done policing, rather he probably racially profiled too many people and was forced into that retirement due to a potential lawsuit or simply too many complaints.

@@edsloan8535 The only person a process server has to identify himself to is the person receiving the documents. Most don’t even reach this stage as most process servers don’t even meet the person in person. Simply delivering it to their place of occupation or their current address. They can even just have it delivered via signed mail to the last known address the court has on file. The person receiving the documents don’t even need to actually have psychical ownership of the documents. If you get a summons delivered to your house and you’re on holiday or just avoid going into work and you miss the court date because you never actually received the summons you are held liable not the process server or the courts. Also we live in a world where physical copies of court documents never even leave the courthouse. If the court has a known email address they can just send the court documents via email and that is a 100% legitimate process serve.

Allah means the one and only God, the God of all prophets and creatures, the creator of the universe and mankind, and the Master of the Day of judgment, where our destiny, Hell or Paradise, is decided based on our faith and deeds in this trial life, and above all, Allah's mercy. Allah said in Surah Al-Ikhlas : In the name of God, the Gracious, the Merciful. Say, “He is God, the One. God, the Absolute. He begets not, nor was He begotten. And there is none comparable to Him.” (1-4 / Translated by ITANI). Allah said in Surah An-Nisa : O FOLLOWERS of the Gospel! UPDATE TO THE CASE: So far there have been 60 filings in this case and the city of course has pretty much done nothing to comply, including not responding to FOIL requests. They just keep playing a delay game (and lying) but Shawn is very good at keeping them (or at least the courts) on their toes. He even went so far as to email 133 employees within the department a "wanted poster" he had made in order to identify two of the names of plain clothes officers (listed as john doe in the original lawsuit) whom were a party in his arrest and he also did some undercover video taping of the cops in their shop (thru the glass) to identify them. He was successful and actually 2 of them happen to receive the very email with their wanted poster which contained their images and the text "Wanted for Civil Litigation" or similar, which Shawn himself created. These 2 cops did everything possible to keep from being identified but Shawn is smart and used this to document their "guilty" conscious. This is just an example of only one of many things Shawn has done so far for his case and he is either an extremely skilled shadetree lawyer, a law student, or has a best friend or spouse that is a lawyer. Reading through the documents to date is not for the faint of heart and the average citizen (non lawyer) would never even come close to keeping up with the proper actions and documents for their case as Shawn. Many of these 60 filings are up to 30 pages or more of text and not normal text, it is all legal lawyer jargon. In short: its still playing out but Shawn has these guys by the balls, bigtime.

I absolutely gave him credit for being smart and witty, especially through his actions. both in this video and the stories of what has taken place after it, which he is on his very own accord. It also just happened to be the main motivator for me to research an update. BUT, smart and witty has nothing to do with the actual language used in the court filings. There are normally only two professions skillful enough to file with the courts and use this language; a lawyer, of course, and also some skilled paralegals. Do yourself a favor and follow any of the links provided by audit the audit, which lead to the court filings, pick any one filing, and read it. You will know exactly what I am referring to before finishing one full paragraph.

They had a sticker with the data of the sender and reciever adressed by name and ID. wHEN NOT? IT S BECAUSE someone close with the reciever was expected to bring the documents in confidence. When I was in high school (in the 70's) and college in the early 80's, cops said they had the right to detain me in jail for up to 72 hours for no reason and did so on several occasions. They laughed about damage to my car when they towed it and laughed while I was assaulted while locked in a cell. At 65 years old, I still will not call cops even if my house is broken into.

They parked up and went into a house, so I knew where they were. I went to the local police station to report it. Man, oh man they went and sifted through every document and sniffed out everything they could. I was legal, so OK. But I can imagine if something had been a bit iffy I'd have been done. That would be a nasty shock for someone... They did nothing about the guy who drove into my car.

Defunding refers to defunding the money used for military style weapons, like Assault Rifles and tanks to reroute those funds to mental health resources and training. It's been taken by conservatives who refuse to listen to the language of defund the police advocates and assume they mean to get rid of the Police Department.

They may have suspected that the envelope contained something of harm. They could have detained him and sought answers and then returned the item to the man. There have been too many attacks on officers to date for them not to be suspicious. And the fact the city has actively gone out of its way to weaken the force has created the current climate.

Many Religions that we know nowadays, at their beginning were true and under Islam, initiated by one of the prophets of God, but their original teachings, history and scriptures have been corrupted over time with falsification and polytheism, or lost and replaced with false ones. That's why Islam is the only Religion accepted by God nowadays, which consists in bearing witness that there is no god besides Allah (God in Aramaic, the original language of Jesus and the Gospel), and that Muhammad is His servant and messenger, just like Jesus and Moses and others are His servants and messengers. Never a messenger of God said he was God or literally son of God, it was the people after him who changed the words of God and corrupted the Religion. God is unique and absolute, He does not need to have a family and sons or to associate anyone else with His kingdom, He can simply create whatever He wants, everything belongs to Him, and to Him everything will return. Allah said in Surah Al-Mu’minun : “God has never begotten a son, nor is there any god besides Him. Otherwise, each god would have taken away what it has created, and some of them would have gained supremacy over others. Glory be to God, far beyond what they describe. The Knower of the hidden and the manifest. He is exalted, far above what they associate. (91-92 / Translated by ITANI). Allah means the one and only God, the God of all prophets and creatures, the creator of the universe and mankind, and the Master of the Day of judgment, where our destiny, Hell or Paradise, is decided based on our faith and deeds in this trial life, and above all, Allah's mercy. Allah said in Surah Al-Ikhlas : In the name of God, the Gracious, the Merciful. Say, “He is God, the One. God, the Absolute. He begets not, nor was He begotten. And there is none comparable to Him.” (1-4 / Translated by ITANI). Allah said in Surah An-Nisa : O FOLLOWERS of the Gospel! Do not overstep the bounds [of truth] in your religious beliefs, and do not say of God anything but the truth. The Christ Jesus, son of Mary, was but God's Apostle - [the fulfilment of] His promise which He had conveyed unto Mary - and a soul created by Him. Believe, then, in God and His apostles, and do not say, "[God is] a trinity". Desist [from this assertion] for your own good. God is but One God; utterly remote is He, in His glory, from having a son: unto Him belongs all that is in the heavens and all that is on earth; and none is as worthy of trust as God. Never did the Christ feel too proud to be God's servant, nor do the angels who are near unto Him. And those who feel too proud to serve Him and glory in their arrogance [should know that on Judgment Day] He will gather them all unto Himself: (171-172 / Translated by Muhammad Asad). Allah the Most Merciful said in Surah Ali-Imran : Behold, the only [true] religion in the sight of God is [man's] self-surrender unto Him; and those who were vouchsafed revelation aforetime took, out of mutual jealousy, to divergent views [on this point] only after knowledge [thereof] had come unto them. But as for him who denies the truth of God's messages - behold, God is swift in reckoning! Thus, [O Prophet,] if they argue with thee, say, "I have surrendered my whole being unto God, and [so have] all who follow me!" - and ask those who have been vouchsafed revelation aforetime, as well as all unlettered people, "Have you [too] surrendered yourselves unto Him?" And if they surrender themselves unto Him, they are on the right path; but if they turn away - behold, thy duty is no more than to deliver the message: for God sees all that is in [the hearts of] His creatures. Verily, as for those who deny the truth of God's messages, and slay the prophets against all right, and slay people who enjoin equity - announce unto them a grievous chastisement. It is they whose works shall come to nought both in this world and in the life to come; and they shall have none to succour them. (19-22 / Translated by Muhammad Asad).. Salam (Peace) --

@@RavenGlenn Your reply contradicts itself! The police department is not someone, but an agency. Any process server knows that the summons has to go through proper channels to get to the officer. Copies go to the legal department, then to roll call for the officer to be assigned to court for the day, etc. The server will ID himself, then sign the log as proof he was there-it is for his benefit. The person accepting the summons will then sign the receipt, further proof-see where this is going?

There are a lot of reasons why a plain clothes courier will drop something off for someone. One of the main reasons I can think of is I'm getting served legal papers. Un-ironically, this guy was doing just that: delivering legal papers. If a plain clothes courier were to hand me an envelope I would immediately think I'm getting sued. I would think in those instances you CAN'T tell anyone but the recipient what's in the envelope without violating the privacy of the recipient.

I work with a man who was attacked and beaten by police and spent months in the hospital. The police resigned and went to work for other departments and we're able to escape. As a result of the trauma that he suffered at the hands of the police, he now carries a gun and swears that he will never be taken into custody again. He States very clearly that he would rather die in a gunfight with the police than to allow them to ever attempt to kill him again. How does one argue against this? I was a soldier and I killed in Ami soldiers and I would never have allowed them to take me into custody, so I have some idea from my point of view

I'm assuming you were not yet around when the whole anthrax situation happened. 2001 terrorists were lacing letters and documents with a bacteria, that with contact or breathed in can spread anthrax, a deadly disease. This not only affected the letter that was tainted, but any other letter that came in contact as it went through the post system, or anything a hand sent letter came into contact with, desks, other papers, etc. So yes, even today mail is screened and scanned for posible contaminates. While that don't warrant what these officers did, saying people shouldn't be scared of a package that has no lable and just the name of someone is warrant for some concern. But reacting the way these cops did was way over the top.

3:45 Actually it was more dangerous for the plane clothes officer to put his hands the guy without identifying himself as a cop. To place your hand on someone in such a fashion constitutes assault and it can (and often will) trigger a justified self defense counterattack. The officer could be seriously injured in such an attack. Grabbing someone from behind is extremely dangerous, especially if you know nothing about the person you are grabbing. A person who has had extensive training in hand-to-hand combat and a bad case of PTSD can kill on pure instinct without stopping to think about it. I had a friend who had been in the Army, in combat. In a bar he got into a dispute with another very drunk patron (my friend wasn't drunk) and when he turned to walk away the drunk asshole grabbed him from behind. What happened next happened so fast I still don't know what exactly happened. The drunk guy didn't die, but he spent two weeks in a coma, and I heard he was never quite the same again. Never ever grab someone from behind.

Since when do you need a licence to deliver anything? I can understand why even answering basic question is a bad idea in this case. Police officer in the US are trained to twist anything you say against you. Once they officially arrested him, they needed to justify their actions. Invoking his right to remain silent was his best course of action.

Police officers' incurable talent to make any matter worse. The man dropped off an envelope addressed to a specific person whom they know works there, at the front desk that is there to accept envelopes from the general public. But, no. They cuffed the man, illegally searched him, and held him for five hours. I, for one, feel very protected and well served by these officers.

Plain clothes guy delivers an open envelope, then books it out of the building saying he made a delivery and isn’t answering anything. That’s a bit strange. A delivery person wouldn’t do that. ID or uniform aside. His evasive behavior is what got him into the confrontation, that and a bunch of crazy cops.

@@robv5834 ah yes, because people never have other places to be and delivery drivers aren't famously expected to make ridiculously quick trips. It was a manila envelope that very obviously only held a couple sheets of paper at most. They could just be normal people and give the paper to the officer, or be a little bad and read someone else's mail, but instead they decided to roughly search the guy and stick him in a cell for 5 hours. Very normal behavior to do to someone for dropping off a manila envelope

We also here all the time about ricin in envelopes, so although rare, it could be a valid concern. But the open envelope and silly evasive behavior of this man wasn’t normal. That’s assuming his case wasn’t continued by himself. Most civil cases takes 3-4 years before a trial date actually happens. Most cases eventually settle. 18 months isn’t a crazy time period.

As a delivery person we've got a ton of envelopes to be delivered and not enough time. I get paid to deliver items not answer questions about them or stop to discuss package contents.. which- in 28 years- I have never been privy to the contents of an item I am delivering, and for me to open them would be- wait for it-- illegal.

This was just a manila envelope, which was not even sealed, and it was not part of the USPS mail, or of any other common carrier company, and there was no proper addressing on it, just someone's name.

A courier doesn't know every time what he's delivering. The cops should have read whose it is, contacted him, and held it in a safe box. Or called the bomb squad; they obviously didn't clear the room, floor or building.

If they straitened something criminal, they should have taken safety precautions while detaining him. They did not because their goal was to flex nuts instead.

Suspicion doesn’t cancel the constitution or them performing their job correctly, although cops try their best to operate that way. The first thing they did was put hands on him and did not identify themselves and started ordering him around.

I'd say Thomas gets a D- and the cops get a D. Thomas did everything in his power to act unprofessional, uncooperative, and suspicious. And the cops shouldn't have searched him. People need to understand that cops have difficult jobs and should be afforded a little more cooperation and community spirit by citizens. Spending 5 minutes to be courteous and cooperative is not difficult, and is a choice. Stop hiding behind your rights just to be a dick and antagonize - that is not what rights are for.

First, "Don't shoot the messenger." Second, these City of NY police officers behaved like pure thugs. Its frightening to know the laws are so easy to corrupt that they can get away with manhandling this delivery man the way they do. BTW, a knife is not inherently a weapon unless its used as one. In that case, anything you can pickup can be a weapon. There is something called a "pocket" knife which is a tool, not a weapon. Is a nail file a weapon? What about a screw driver or a hammer? When I ride my bike I carry a multi-tool. Among its dozen or so various tools it also comes with a blade. If I were stopped by the police can the cops then say I was carrying a knife? The public need to be aware of this type of misleading terminology, and the context for where it was found. The delivery man had existed the station and the cops had to run him down and dig deep into his pockets to find his tiny pocket knife. You'd think he was carrying and brandishing a Samurai sword by the way the report is written.

Both parties were pretty poor with their attitude. I think it's pretty expected that if you're antagonistic towards anyone whether they have a badge or not they will treat you the same, you hope that an officer isn't like that but alas we live in a country where people have to be reminded they shouldn't eat paint. As for most officers they were regular people before they were officers so it's not like children learn about police training when they get sent off to middle school
