its a "common misconception" because its a recent law. it used to be, and absolutely still should be required. the only reason its not is because officers are too damn stupid to remember them or to remember to use them in the appropriate time causing headaches for the cities. i guess justice and whats right isnt as important as legal efficiency.

I'm crazy sketched out by this whole situation. Why is a woman on drugs and alone with 5 men ? Why was she compelled to lie about said men ? Why would the men feel the need to hide ? All of the men claimed to not be her boyfriend but none of them claimed to be her friend ? This smells of trafficking and I hope those men get very closely looked at. If it is the case it makes a lot of sense why those men were so polite to police and quick to let her take the fall for everything.

I know this all seems funny like a stripper that got too high and made a fool of herself, but she seems like a sex trafficking victim. The bruises. Seriously like people in the comments are like the cops were yelling at her that was unnecessary of the cops. Well if she just did what they said and answered their questions and not lied to them then later on kick one of them, then she wouldn’t be in this situation. There were two different times that I got miss identified by the cops they thought I was somebody else that they were looking for, and you know what I did I did everything they said and I stayed calm I didn’t give them attitude and you know what happened they let me go. On my way within 20 to 30 minutes. Plus even if she didn’t kick the cops or anything they have grounds to arrest her anyways because she is interfering with an investigation. I’ve been it is honestly better for her if she was in a dangerous situation with all these guys in her apartment was her getting arrested and taken down to the police station. Let her sleep off whatever she is on and then talk to her people are saying that they can’t do that they shouldn’t be able to do that the cops and it’s like oh would you rather have her go possibly back into dangerous situation and the cops just throwing their hands up OK whatever I mean I feel like there are times where the cops either way do the wrong thingbecause if they do arrest her take her down to the station and possibly take her away from a bad situation they’re still in the wrong, but if they let her go and go back into that apartment and something happened to her, then the cops would still be blamed

They didn’t yell at her lol they asked her question she would not answer how she got that bruise on her arm. They asked her if anybody else was in the apartment and she lied to them and then the guy comes out and are like oh you lied to us. She was also not acting right she was trying to move away from the cops and they don’t want her bolting, so yeah they detained her I mean, I’ve been miss identified by the cops twice one of them was they thought I looked like this runaway that ran away from the pre-release that this person was act and I did everything the cop said, even though he was a dick and I went on my way within 30 minutes because I did everything he said, even though he was rude as hell. Then I got pulled over in my car because my car was the same make model and year and my license plate was two or three letters or numbers off from this car that was involved in a robbery and shot at the police so yeah, the cop was very stern with me. I did everything he said then he ruled out obviously 100% that I am not the same person or I wasn’t hiding the person in my car and that it was not the same car from the robbery and I got to go. On my way within 30 to 40 minutes it’s really not that hard. They have to do a investigation and if she’s gonna act like this, then they can arrest her because she is interfering with a investigation. Cops can’t just throw out their hands and be like oh OK you go on your way we’re not gonna figure out why you were screaming and yelling let you go back possibly to that dangerous situation. More than likely, they would take her down to the station let her sleep off whatever she is on and then ask questions, but they can’t let her just go back into that apartment when answers haven’t been answered because I’m sorry if I am in a dangerous situation, and several men were hurting me, possibly And my neighbors called it in and the cops came and I wouldn’t answer their questions I would rather have them arrest me take me down to let me sleep it off then asked me questions instead of letting me possibly go back into a dangerous situation. Like I said, she is interfering with an investigation that is grounds for somebody getting arrested. Plus, do you not remember that she kicked a cop?

They probably were trying to investigate to see if this woman was OK but she was acting belligerent. I mean that’s why they were asking how she got that bruise that big black bruise was possibly these men were beating her up or hurting her because they said they got a call with somebody yelling and screaming. I am not gonna sit here and say every cop is amazing but nine times out of 10 when you do everything they say, and answer their questions this woman would’ve been able to go on with her day or night whatever.

Right they were probably doing wellness check because I swear they said they got a call from somebody that heard like yelling or screaming or both something like that, so yeah, the police have to investigate and she’s acting belligerent which she is then it’s not gonna end well for her. 2:15 I had to deal with Scientology at my previous employer (I was laid off after 5 years), anyway, those people were the WEIRDEST BUNCH I have EVER had to deal with. They had the stupidest rules like you can’t wear cologne or perfume, you can’t use scented lotions, you have to sign in and out of the location you go to. I worked with field techs and one had to go to Scientology to service a copier, the people there WATCHED him the entire time like over his shoulder, only let him use certain tools, etc. AGAIN IT WAS WEIRD SO IF THEY HAD BLOOD IN VIALS IT WOULDNT SURPRISE ME

this situation seems like a sex trafficking incident. Especially with the way she was trying to hide that there were people in the apartment, and her insistence that she is a "legal dancer" and the bruises that are not natural for pole. It's so incredibly sad. Even the way she seems so high and the fact that they were called for what sounded like a domestic incident? She's a victim in this situation, and even if it seemed like she was acting crazy and is the problem, I highly doubt it with all things considered. Hopefully she somehow got help from this situation even though that seems tragically unlikely.

Well, if she was being abused, she should have complied with the cops. She could have moved away from the door with them, told them what was happening, and then either gone back inside for them to deal with later or went with them for protection while they dealt with it now. Kinda sad that people act crazy when they could simply just not. I have no context for if she was on something willingly, so I can't talk about simply NOT doing drugs, but that's also something to think about.

@Lord_Shadowfang If my ex had ever thought I'd report him to police, which I couldn't because you have to prove any sexual abuse isn't somehow willing at any point to even get past the police to even be considered for a judge.... But if he's even thought it was a possibility he would have killed me. I don't think you're qualified to know what victims can and can't do in situations like this unless you've been terrified for your life. Most serious rape and dv and traffick victims are female, and most perps are male. Consider if you will the fact most don't even serve a solid year straight in jail for the crimes I mentioned. Which are all hard to prove to begin with. Fun fact to further complicate things, even if I can prove beyond a shadow of a doubt, you often can't even get a person removed from the residence until they're fully taken into custody. If they get out on bail, the police can't always legally keep them away from your residence, so women who are violated by fellow cohabitants who don't have family or friends to go to, have nowhere to turn since they can't legally kick the abuser out. There is so much to think about, and as a victim you end up terrified for your life every single time you think maybe you should tell someone, you think you'll end up dead or not believed, and if you don't have solid proof because of the nature of the crime, then you know you're not going to be believed and if you are no one can help you anyways..... Rape especially is almost impossible to prove. Around 55k people every single year go missing and aren't found. Presumably a large majority of them are trafficked, and some are killed without bodies found. Traffick victims rarely become free again and many traffickers dispose of stock once they feel they aren't getting enough out of them any more. some traffickers even force pregnancy and birth, and sell the babies. Meanwhile, many of their victims familys are identified and known, so for trafficking victims many times it's not just your life on the line, but every single family member and friend you've ever had. Kids and husbands too. In general crimes against women by men are incredibly hard to prove, and an insane amount of trafficked victims are missing every single year. Men countlessly refuse to deny themselves sex, and find neverending excuses to use services provided through nefarious means. Countless women often starting under age 12 are trafficked world wide every year, through different countries. And for those of us who are poisoned, beaten, and raped by men we trusted.... We're mostly blamed for this outcome as well, not believed, told we're trying to ruin a mans life, and if you bring forward rape accusations you must undergo an invasive procedure in which they stick fingers and probes into your privates, and often these tests are used but not for firm hardcore evidence unless you're damaged to the point of needing surgery. Here's been a deep dive into the behind the scenes on a lot of the subject matter, hopefully now you can understand why some victims may act completely insane, especially if drugged. Some cases to even further look into are illegal pornography made in the states, many porn stars have requested violent sets to end, and were refused, needing surgery after for extreme damage done to their anus, vagina, and urethra. Many however, we're also signed after drug or alcohol use, and many are suspected to be various levels of trafficked.

In all seriousness if this is a domestic violence call and they are questioning her right outside the door where her partner can hear thats extremely dangerous. And further more arresting the victim happens constantly and she will not call again. I never did. You are stigmatized the rest of your life and teaches victims to never call for help again. I get its funny but this situation at its core is not. She didn't want to step back because if he goes to jail she could be killed and if he doesn't she could be killed. I think its complete bs they arrested her once again cops have mo training on how to handle these victims smfh. This was sad to watch.

There were like 7 people in her apartment. She was arguing with one of her friends and some neighbor decided to call the police. She was very drunk and started to fight the police. At no point was she ever in a situation in which any form of domestic violence was taking place.

DV or not at least a potential battery situation. I’m a nurse and I’m trained in reading red flags for this sort of thing. She meets MANY of them. The locked collar (which yes could be a fashion statement), the bruises AND scratches, being under the influence, trying to HIDE and cover for the men in the apartment….there are just too many for them not to suspect something. I think the cops could have handled this differently because let’s not forget they were there investigating a DOMESTIC INCIDENT and also, they DO need a warrant to enter someone’s apartment to search. SO her behavior makes sense for someone scared and panicking, not saying it’s okay at all

They have to have reasonable, articulable suspicion of a crime, otherwise; yes, they do need either permission or a warrant to search her apartment. If they suspect a crime, they have to say what crime they suspect has been committed. It's 100% within the rights of a citizen to fight any tyrannical government official encroaching on that citizen's rights.

So did you just skip the part where the officer explained there was a report of a man and woman arguing with the woman yelling stop? The officers were there to figure out what was going on. If she wanted to be left alone, literally all she had to do was say "hey, i dont know what that was about, there is nothing going on" give them her id and bam, end of story. ALSO, she could have said that she wont be answering any questions, she'll like an attorney present for any questioning. Would have been a quick trip down to the police station. But NOPE lol

You aren't supposed to lie to the cops who are investigating a potential crime. That is illegal. It's called 'impeding an investigation.' So yes, in this case lying about there being people inside the apartment is illegal. Also, people can steal keys. It happens all the time. If somebody murders a person, they are going to take their keys, and if they know where they live they will likely take everything that person had. You can break into a home without forced entry. Arguing is not a crime, but when asked to identify yourself by the police during the investigation of a crime, you are required to provide ID to prove your identity. You sure did just make up a load of bullshit to pretend that cops are the bad guys, huh? Not all of them are good, but you did a piss poor job of pretending these were bad ones. This actually made me feel quite uncomfortable watching how the police treated her. Maybe there’s a universe where this could’ve been funny, but this wasn’t it. They treated her like a perpetrator and seemingly antagonised her into doing something to get arrested for. But, piecing together the clues as to why they were there and what was going on suggests that they were there as they suspected some sort of domestic dispute where a woman was heard shouting “stop!”. Then they turn up and they find a woman covered in bruises and scratches. They question her rather aggressively about them and suspect she’s lying. So what? Domestic abuse victims often lie to protect their abuser, especially if they could overhear. So, this is again an indication that she’s the victim. Yes, you probably need to get her away from her abuser to have a chance of her being honest about it. But, not by force! Force makes the police the enemy. Not to be trusted. Not there to help. Not safe people to open up to. It requires way more tact. So, why were they treating her like that?? And then, to ask her “daddy” if she kneed him in the walls… that’s a leading question, which he quite happily agreed to. And then to walk out and call the guys in her apartment “nice”. Based on what?? If she even did knee him in the balls, maybe it was in self-defence. All the rest of the clues indicate that. The other possibility is that she’s in a consensual BDSM dynamic with this “daddy”, given that’s what she called him, the collar, lying to protect him as consent doesn’t necessarily make it legal. But, her lying for that reason doesn’t justify them setting her up to get arrested either. It’s one of those things where you’d have to reassure her that if she says it’s consensual, don’t worry, they won’t arrest him. But, if it isn’t, convincing her that they’re on her side and will actually help. That they’ll believe her either way. But, this ordeal has likely scuppered any chance at her trusting them to help her now. And can only have empowered those guys that they can get away with whatever, the police are on their side. And then to have actually charged her with the battery against the officer offences! For like touching his hand when he blocked her getting back in her apartment whilst she got covered in blood during this ordeal herself. Omg. They set out there to achieve that outcome and achieved it, evidently. Just police abusing their power and manipulating a situation against a woman they seemingly suspected was a victim of abuse. Not cool. Not funny.

As someone who was in a da situation ( not trying to argue or say you're wrong just giving a different perspective ) I would lie all the time about my bruises and scraps. I had my eye almost swollen shut. The cops were called by someone who heard me yelling and I told them it was from working in the garden. That I was digging with a small shovel and i pulled to hard and it whacked me in the face. The cops believed it and moved on. Another time I had a cut going down the side of my face from a blade. The cops once again came and I said my niece threw a butter knife at me. That time they demanded to go inside. I fought them and told them just like the girl in the video they needed a search warrant and to get out. If they hadn't forced themselves in I would still be at that house. Getting beat on every other day.

I'd be MORE than happy if they busted into my apartment against my so-called rights, detained me, and wasted several hours of my day. I'm not dumb enough to bite the hand that feeds me. I had a cop knock on my door looking for some man. I hesitated to let the cop in because i smoke a little weed 😅 and I dont trust cops, but since the guy who they were looking for wasnt even there i thought agreeing to them coming in and looking around would be fine. Do NOT ever let a cop search your house without a warrant! That cop's attitude changed completely from being friendly and reasonable to becoming skeptical and questioning everything! My girlfriend was there and she had her hat and chewing Tabacco on the bookshelf, the cop seen it and was 💯% convinced I was hiding a man there 😂 and was upset when he left. He really believed i was hiding some strange man in my home and didnt believe me even after he checked my house!

IT would have been fine if you didn't escalate it and cooperated. As far as the police knew they got a call about a possible 'domestic disturbance' and she wasn't being cooperative (not to mention she kept touching the officers, and then resisting, and then assault with the spitting) so yes it was her fault that she turned the situation into the extreme.

I mean, selling your body for money and protecting your abusers by lying to the police doesn't really paint a victim picture, more like a "I want to live a life with high amounts of cash while doing minimal work." kind of thing. She kept screaming "The government pays for your bills! You don't have to do the things I do!" like there are no other options to live than selling your body. That's a toxic mentality and it is, a lie. There are hundred of thousands of different ways to live your life.

They were there because of a domestic violence call about her apartment. They clearly said that neighbors heard a man and woman yelling and the woman telling the man to stop. She's covered in bruises, lying to them, and being aggressive by kicking them (that's why she was initially detained).

They put you in cuffs to make it more difficult for you to hurt yourself or others in case you get violent. If you cooperate and are honest, they let you go (if you haven't committed a crime). Foot in the door is illegal notwithstanding any other issues. You have a right to stay in your house and not open the door as a solution. Illegal entry is an issue with bad policing, regardless of outcome. Stay inside, don't open the door, call 911 and report that there might be "imposters" or "impersonators" at the door.

Idk it's a weird line when it comes to domestic abuse cases. I totally get they're doing their jobs but there's most definitely a better way to do it.
