She didn’t even see the impact coming, so there was no adrenaline yet. So if she had something to feel pain for, she would have felt it. But the way she just walked away makes me think she has something wrong between her ears. No normal person would do that. A normal person would either apologise and/or ask if he’s ok, or be angry, depending on the interpretation of the cause of the crash. Maybe she has relations with crime and doesn’t want to be in the spotlight.

Yep that's correct. I got hit by a car once and I jumped up and started walking. You kinda can't think because of the adrenaline and stress. You just keep going and you are only happy that your legs function. I realized that I'm in pain and what happened an hour or so later.

Correct. I came off my bike (entirely my own fault and no-one else involved) but it only took an eyewitness to at least get me some help for me not to just get on my bike and make my own way home before going to hospital. In the end she helped get an ambulance and I needed spinal x-rays and some form of skin surgery. It's very difficult to gauge how we'd react in the immediate aftermath of an incident when you're not thinking entirely logically.

The rider could use the lane away from the pedestrian on approach and observe whether the pedestrian is looking in their direction on approach and use horn speed and positioning accordingly, the van limited the time the pedestrian was in view for otherwise the motorcyclist could have left lane changing till after the crossing.

Saying the motorcyclist should have stayed in the lane blocked by a bus and used their horn in expectation of something that *might* have been ahead is just silly. The pedestrian did not look to their left at all until a fraction of a second before the impact whereas the motorcyclist was traveling at 26 mph through a green light and no amount of spin doctoring will make your suggestions make any sense.

The girl probably checked her left for approaching traffic earlier and saw the car and the white van and nothing behind that van. So she waited for the van to pass and then crossed the street without checking a second time. Because of the motorcyclist's lane positioning (which, from his perspective is of course the best way to do, like stated in the video as well) and the fact that he just changed lanes, the girl didn't see him earlier, so she assumed it's save to go. I had a similar occasion where a pedestrian didn't saw me and my car approaching cause I was in the other lane as the van driving infront of me and was just changing the lane behind the van (just like in the video). The guy luckily checked again when he took the first step and managed to stop, cause I wouldn't have made it. At that time I had a car without anti-lock braking system on a wet road, I came to a stop about a car length past him. People tend to rely on what they see (or don't see) and therefore neglect to check again if things are still the way they assume. That's why these kind of videos are important. When one person sees this and and manages to take it to heart and transfer it to their own actions, the video already was worth it. So keep up the good work!

There was 1.16 seconds(35 frames) from the moment she took her first step into the road(when the back bumper of the white van passes her) to the bike hitting her. At ~26 mph, taking into account the biker had started breaking, that comes out to ~15 meters(~50 feet). Even in optimal conditions, that shouldn't be enough to come to a complete stop. For a motorcycle in dry conditions, good visibility, and in good working order, it should take ~18 meters(~60 feet) to come to a complete stop from ~26 mph. Take into account that the road top looks a bit wet, there wasn't a glimmer of hope he could come to a complete stop safely before he hit her. Realistically, the biker probably didn't see her until she was fully into the road, which would be 930 ms(28 frames) until impact, which is ~11 meters(~35 feet).

And the saddest part is, pedestrians and even cyclist are playing russian roulette by being careless (like this girl stepping out without watching. It could have been a normal car or worse a 7.5 ton or heavier truck) or forcing their "right" like cyclist stopping left or right in the real blind spot of a truck that is indicating left or right to turn on a red light and once it becomes green the cyclist starts moving off and wonders why he gets run over by the truck.

The type of pedestrians that annoy me as both a driver and a part-time cyclist (when they cross the road): 1. Face glued to the phone - No ability to see other road users at all if they're only focused on their mobile phone. 2. Headphones in both ears/covering both ears and as a result they just carry on walking forward, oblivious to whatever is on the road. 3. The ones that despite having no headphones in and no phone to be looking at, they just nonchalantly go out on the crossing and then an incident similar to what the video shows ensues. 4. The one that would fit in with 1, 2 or 3, but have the audacity to blame a driver, motorcyclist or cyclist for hitting them even if it was the pedestrian at fault and the driver/motorcyclist/cyclist literally couldn't do anything to stop for them.

@@xwafflesx wow thanks. I have been in a crash due to ice and snow (I think it was back in 2010) where my late dad's discovery series 2 rolled over and that thing was a write off. Now I still remember how it happened and small details like the speedo but I digress. I remember looking at how messed up the land rover was and how lucky we were to be surrounded by its metal body (even more lucky that the engine didn't catch even though it was diesel). The discovery rolled twice and landed on the driver side and I tell you, THANK GOD for seat belts!! We walked away with only bruises. So yeah, I don't want to know how bad it is for motorcyclists. She was in a hurry to catch that bus that was stopped at the bus stop. The thing in her hand was her bus pass card. Her focus was looking at the bus, and making sure it wasn’t going to pull away, that’s also why she started to run across the road. My guess is she looked at the road, only seen the van coming and couldn’t see the bike behind it (although I’m surprised she didn’t hear it as they aren’t exactly quiet) she was in such a rush to get the bus she just ran as soon as the van cleared the lights. She is totally at fault and I do think the biker done well considering. Hopefully she has learned her lesson and pays more attention in the future.

This is the best analysis I've heard so far. Let's also throw into the mix that the sun was shining in her eyes which may have affected her decision making. Is it possible the motorcycle could have been inaudible due to the noise from the van and his throttle position? I'm sure she will make the same mistake again, it's human nature (aka stupidity). The obvious problem here is that mixing pedestrians with 'fast' moving heavy objects will end in disaster at some point, because the pedestrian is the most vulnerable, same for motorcyclists too; mixing them with cars/vans/buses etc, ends in disaster.

I’m an IAM Advanced rider and car driver, and I have my IAM Masters for the ‘bike. There’s no point in repeating all your observations except to concur that the biker in the clip did nothing wrong. The same thing happened to me while driving my car down the Great Western Road in Glasgow about 20+ years ago. Some bloke just sprinted straight off the pavement without looking. There was no time at all to even attempt an emergency stop... he was that close! Anyway, I hit him, he bounced across my bonnet a few times and then hit the road. Obviously I slammed on my brakes and got out of the car to see if he was okay. He ran off!!! I shouted on him, he finally stopped and partially walked back to me and he apologised for not looking. I tried to insist that he waits as injuries can be of a delayed nature, but he wouldn’t and went on his way. Knowing I should report this to the police (legally, at least 20-odd years ago, it had to be reported within 24hrs), I waited until I arrived back in my home city of Edinburgh to do so. The reason I mention this is that there are lots of issues to consider in these types of circumstances. My scenario with my ‘victim’ relates exactly to that of the biker and the girl in the clip, as follows: i. If not reported by the rider/driver, the pedestrian could easily decide later to report it as a ‘hit-and-run’. ii. The pedestrian may not feel anything at the time of the accident (adrenaline, etc) but may suffer (possible serious) consequences later. iii. It’s illegal - I believe - for either party to leave the scene of the accident if someone is hurt (although the police officer did confirm that there is a 24hr (in fact, I’m pretty sure I was told 48hrs but I could be wrong) grace for reporting accidents. That could just be Scottish law though. In those days, there were no dash-cams and, either way, if that pedestrian had later decided to report me, it may have led to a messy situation. The girl in the clip may also have decided to report the biker, so I hope he reported it first. I recommend everyone to enhance your skills of awareness and observation by taking Advanced Riding or Driving (or both) instruction.

Both the duty to stop and provide details under s.170(2) of the Road Traffic Act and the duty to report under s.170(3) specify the duty as resting upon the "driver of the motor vehicle". As such I am fairly sure that the pedestrian would not be caught by either duty and thus the offence under s.170(4) for failure to comply with either of the above would not apply but I am not a solicitor so I could be wrong here.

Outstanding agility from the biker, I must say. . . Bike stops dead in the road, pedestrian gets lifted and shunted forward, and the biker miraculously and in spite of being launched off the bike, lands on his feet and standing upright - truly amazing! Look at his shadow as he comes off the bike, and you'll see what I mean. To me, mobile phones, media players and headphones are the bane of modern society. Add that to people who, now unable to hear what's going on around them, don't even bother to look. I should still have a few narrow squeaks on my dashcams, and it's not just pedestrians - cyclists are the worst offenders. Somewhere, I have video footage of a bunch of cyclists, and one in particular, who has his headphones totally covering his ears, riding along with no hands on his handlebars, fiddling with his phone/media player, not looking where he's going, and hurtling along amongst road traffic and pedestrians. Time I think, for some mandatory instruction on being safe road users, for all road users - perhaps even mandatory insurance for cyclists, an MOT style annual safety inspection for their bicycles and a mandatory test of their own competence to ride on public roads. It would also serve us all well if there were like for like prosecutions and penalties for offending riders.

I had a very similar accident on my bicycle in Dublin city center, coming up to 4 way junction, the traffic had a green light, meaning that the lights were RED for the pedestrians but someone stepped out in front of me Without looking, I had no time to react and could not avoid hitting her due to the fact I was in the bicycle lane and there’s was a car in the lane to my right and when she stepped out onto the road I was only about 5 meters away from her,she got up without a scratch, I had a broken left collar. The worst part of it was she tried to blame me for the accident saying “did you not see me” but when she saw my helmet cam she changed her tune to “are you ok”. Just a few things before you all blame me 1) I had my bike light on flashing mode 2) I was wearing a high visibility cycling jacket 3) I was going 25kph in a 30kph zone. 4) she crossed the road on a RED pedestrian light.5) This happened during board daylight.

Not suggesting this is the case with this woman at all but it's easy to imagine somebody with say an intellectual or mental disability not able to take appropriate self care all the time, likewise somebody intoxicated or a child or perhaps somebody in some kind of emotional distress. Beyond that I would say every single one of us can be distracted or make errors of judgement at least occasionally. Who is liable for damages? This case involving a cyclist and pedestrian (where it was found both equally to blame after she similarly walked out into the road, but only the cyclist ended up paying) might help out as some form of precedence. This case may differ somewhat as the motorcyclist will almost probably have insurance but then that would come onto insurance company. And as you say, she just walks off without exchanging details - in France especially this would be a crime in terms of leaving the scene. As the motorcyclist I'd have been tempted to ring the police immediately because of that and any damage to his bike. The problem is that modern motorcycles are a lot quieter than they used to be. I ride classic 1970's motorcycles and I don't hear quieter modern bikes that are right next to me in traffic. One of my bikes has the "Pedestrian castrator" mudguard mounted blade front number plate, which were no longer compulsory on motorcycles after 1974 because of the severe injury it could cause to jay walking pedestrians. This is probably that one instance where a loud exhaust system would have prevented the accident even starting. For instance if the biker had been riding a Harley with shotgun pipes, it would have drawn her attention because the sound of an annoying loud farm tractor in a city would have seemed out of place.

So maybe we need to drive very carefully approaching pedestrian crossings. The adult pedestrian appears to be negligent and seems to be a fault but what if it was young child. You can't blame a young child's ignorance. Maybe reducing the speed limit to 20mph in such areas would help?

In my opinion it looks like it's London and she's holding her Oyster card - a credit card sized card that you use on public transport in London. The reason she wasn't looking and is rushing is because that is the bus needs to get on and she's only thinking about that. The likelihood of future accidents like this could be reduced by simply moving the bus stop to the other side of the crossing, meaning anyone crossing to rush for a bus would at least be looking in the direction of the traffic when they see their bus. However, non of that will help people who put their lives at risk by not looking both ways when crossing the road.

Yeah I think that's a brilliant idea to put the stop before the crossing so they're looking that way if they're catching a bus, also the driver cannot help but see the person running for the bus. The common denominators here were the pedestrians were looking at what they were paying attention to, the oyster card or bus and the Macdonalds drive through queue or their phone both certainty weren't looking towards approaching traffic, so take action on approach using your horn if they're not looking at you, a green light means proceed with caution with regard to all other road users, not l have the right of way regardless.

I once had a close call with a pedestrian, who turned out to be very drunk and staggered off the pavement into the side of my car . I had seen him and had slowed and moved further out , but he still staggered into my back door , ending up on the road . No damage to my car , but he could barely stand up ; I stopped to see he was all right , his mates were laughing at him and I asked if they wanted the police involved , but I figured they were all under age drinkers , so I asked them to see him safely home and we parted amicably .

Leaving the scene of an accident is a violation of itself. Who's liable for the scratches, the pedestrian of course. Motorcyclist should have left the bike lying on the road and hold the woman until police arrive and then sue.

Just to point out people (well none motorcycle owners) seem to vastly under estimate the cost of damage. Thankfully the motorcycle in question is an unfaired one so unless the petrol tank was damaged it is likely the cost of the damage was hopefully minimum, but had it had fairing it could have easily put the cost of repair into mid 3 figure - 4 figure sum. A different bike could easily have been written off insurance wise if the owner was made to claim for that.

namtabmai yep, people that don’t own bikes have no clue as to the cost of repairing them, someone was “just moving” my bike over a bit when they dropped of because they not a biker and didn’t know what they was doing and put a massive dent in my tank, a tank that is £1000 to replace before I got to the levers, exhaust, bars ect. They had no clue bikes are expensive

The lady in this clip who got struck by the motorcycle really should take more care when crossing the road. Her actions were nothing short of ignorant/unintelligent, and I especially did not like the way she gave the motorcyclist a disgusted look before walking off in a strop. She should have at least ensured the motorcyclist was ok (clearly, he was not at fault).Here, I thought the motorcyclist showed great care and had a quick, almost cat-like reaction to stopping in an emergency. Well done. I would say to him that, thankfully, as Ashley Neal said, he had this dashcam footage showing he was driving responsibly and that this girl was walking out onto roads without a jot of care in the world. This girl really needs to learn some basic road safety/general manners before going out again. Shes just lucky it was a carefullly driven motorbike and not a bus/reckless driver.

I’d love to know what the deal with insurance is. I mean, as a bike rider myself I’d be mad beyond words at my bike going down in this type of situation, but because the pedestrian wasn’t in a vehicle would an insurance company go after her personally? Does that mean we should all have personal insurance?
@atkin207
@atkin207 5 жыл бұрын
I don't think insurance will help you with this. Only way to do it is a small claims court if they don't want to pay for damages. That's if of course you are able to get their identity.
@DasArab

A lot of people dont know that as a Pedestrian they may already have insurance. If you have Liability insurance through a Home Insurance policy you are probably already covered for the likes of this, but the Courts have already said "‘Even where a motorist or cyclist had the right of way, pedestrians who are established on the road have right of way" so how could someone make a claim against a pedestrian when the courts are saying they are at fault?

The biker would have to claim on his insurance and pay the excess and inevitable increased premium. He could only get the pedestrian to pay if he took her to small claims court, which would cost far more than it would be worth. Plus in civil cases, which all non fatal collisions are, both driver (or rider) and pedestrian are equally responsible, regardless of provable fault. She could get a lawyer to convince the judge she suffered emotional trauma and the biker would have to pay damages, as well as his insurance stuff. You just have to thank whatever deity you believe in that you didn't accidentally kill an utter moron that day and get on with your life.

I had a group of guys literally walk straight out into the middle of the road when it's green light for me, normally on this particular road I be doing 40mph or more, but luckily I was doing 25mph this time around, I didn't have to brake hard, just a simple foot off the accelerator and I managed to scrim pass the last lad of the group, put the car into neutral and revved loudly at em as I drove pass, made them jump 😂 but a part of me couldn't stop thinking what if I was doing 40mph that day, the first lad of the group would've got his foot ran over or worse became my new hood ornament

I work in car insurance. Here is what will happen. Although the pedestrian is clearly at fault the insurer will deal with the motorcyclist's claim as a fault claim. This is because pedestrians do not have insurance and they'll like not able to pay any of the motorcyclist's insurer's costs which are likely to be in the thousands. Most people do not have thousands of pounds available to pay a claim. The insurer will however be able to use the video footage as evidence if the pedestrian tries to claim for injury. They'll likely not pay the pedestrian anything as the motorcyclist had no way to avoid this accident. This is one of the big reasons insurers love video footage as it would practically impossible to avoid paying the pedestrian without the footage.

Wouldn't this be a situation where the motorcyclist loses most if they contact the insurance?
@christopheroliver8762
@christopheroliver8762 5 жыл бұрын
@@Elliot00000 By contacting the insurance they'll still be able get the bike fixed or a settlement for another bike. Also if the pedestrian chances a claim for injury, the motorcyclist will at least be able provide his evidence that he wasn't to blame. This also allows the insurer to build a solid case for not paying for that pedestrian's injuries. Using the insurance even in a "fault" is not going to make your premiums completely unaffordable. Yes they'll go up but they do go back down after a few years and after 5 years you don't even need to declare it. In most cases the won't take all your no claims discount if you have 4 or more. The motorcyclist likely needs thousands of pounds to cover the damage to their motorcycle, leathers and helmet and may even need to take time off work due to injury. Lets hope they have comprehensive cover and took out the additional cover for helmet and leathers. I guess this makes the case for having suitable coverage.

Watching this has made me rethink though.
