Her appearance, behavior & criminal record in front of the judge says it all. She is extremely troubled & that type of work is not for her. She needs help taking care of herself first. 🙏🏿🙌🏾

The problem is, is people who are troubled by SA pasts at young ages tend to end up in the same situations over and over and end up blaming themselves. I actually believe her about the SA claims. Troubled doesn't always equal liar, but it tends to hold people who get trapped in these situations down to where they are never believed and can never get out.

I agree. She's in denial. The whole "I caught the charge of having the coke in the car but it wasn't mine" is so old. Also forgery charges too. Not an honest person.

I’ve worked in the health field for a long time. You’d be surprised how many people with a very non-compassionate non-caring, aggressive, combative personality work as CNA’s, and nurses too.

She was very specific about the harassment incidents. I believe her. Even if she is or was on drugs,no one deserves to be harassed. She was working for him to earn an honest living wage.

I agree. She has those eyes and I wasn't surprised that she was ordered to leave. She's schizo or psychotic, and I believe that she was messed with as a child so the CPTSD has made her bat shit crazy. This was a horrible situation and I don't like that she was exploited for the sake of entertainment. She didn't have a case. She's cracked in the head and doesn't think straight. Her delusional mind convinced her that suing was a good idea. It's cases like this that make me not like this show. This isn't entertainment. It's exploitation. It's a shame that Dr Phil set the bar on such a low life level..... Harvey is the producer and he's the reason the show got cancelled. He has a problem with treating women badly.

She’s definitely lying!!! She can retrieve text messages from her iCloud. Why do you think she was so nonchalant towards the end? She worked until the 11th, than it was the 6th. He harassed her on the 5th, she filed a report on the 11th. Wait, she didn’t work on the 6th, it was the 5th. The wife sided with her…wait, no she didn’t! PUHLEEEEEEEZZZZZZE!!!

Funny his wife couldn't make it to court with him. I think she did tell the plaintiff to go file charges and that she hadn't had sex with him in years. Not saying the plaintiff doesn't have her own issues but I believe he talked and acted inappropriate towards her.

I think she said that because of what she said near the beginning. She kind of got in trouble for what she said at the start. So I think she was saying that maybe as a “You sure I can say this?” type of way. I dk I could be wrong but that’s the vibe I’m getting based on the rest of the video.

I have dealt with home health aides before. They are supposed to help with health issues, not errands. And getting ciggs. Agencies usally have a separate home aide for nonmedical things. And no matter how bad a home aide she is, no one deserves sexual harassment.

@@godfrey7944 Then your doing beyond your job. Home HEALTH aides dont run errands Hime aides might but not home HEALTH aides. I have been through death more then I can count. Your not a HEALTH aide or your doing things not in your job description. I am sorry I know your business better then you. It might be because I dealt with MULTIPLE agencies so know exactly what is part of the job as I have had to learn to navigate the health care system. Do you have a nursing degree? Home HEALTH aides are usally nursing degree and above. Some states actually reqyure that under law.....

@@trekgirl65i don't read that as a bash or looking down on someone. Her demeanor and behavior in court didn't help her. In some sense they took the reflection off of him. Dude was laughing throughout, covering his mouth, and averting his eyes when answering questions.

It didn’t make sense though she said the last day she worked was 01/06 which was a Friday but when the judge told her that’s a Saturday she changed it to she didn’t work that day then kept saying 01/01-01/06

@@lajames4079wives lie for predatory husbands everyday. She has issues and doesn’t know how to speak correctly. I believe something was going on here. There is her story, his story, and the truth. He has missing text. She has zero proof of hours. Nothing from her agency says she was assigned. Ppl like her fall victim to predators every day, bc they’re weak. She is clearly a drug user. Lots of victims of abuse use. Especially, if they never receive the proper care and support to break away and/or rebuild their lives after. Without help, most victims relive the abuse every day.

I unfortunately think many people count on that way of believing so I am opposite. Before you make serious allegations like that, better have proof. Texts, voice mail, email, recording, etc. Especially in court setting. And she stuck around for another 2 months as well . . .

It's very telling that the wife didn't come. It's telling he would delete texts out of his phone. An innocent person would not do that even if he believed that the employee, “texted too much”. The whole thing makes no sense; there would be texts before and after the incriminating one. It's possible that she had a bad work ethic and he engaged in behavior that was outside the boundaries of an employer-employee relationship. Those behaviors don't encourage someone to have a good work ethic. Both can have unclean hands… A home healthcare worker shouldn't be taking kids to get something to eat or buying cigarettes for their client. This is a lot of humiliation to go on television to talk about your trauma and criminal history for $440. Also, she worked for him from September to November with no issues. This all happened in January. She looks and moves like someone who's experienced trauma.

@@ericstewart517 you realize that a lot of drug addicts use drugs because they've experienced trauma right? Or, that a lot of “fine” folks target people who struggle with sobriety because no one would believe them. It's a tale as old as time. I believe her much more than I believe him. And, that's not saying she was totally right. As I said in my original post, both can have unclean hands. Above all, abusing drugs isn't a moral failing. For some people it's just what they did in college or their 20’s.

@@lajames4079, not every one. He knew she had issue with not getting paid and would likely have to refute that charge. It doesn't seem like its news to him that she made those accusations either. It makes no sense to delete evidence of communications with an employee you had conflict with unless your side of the street wasn't clean. There's also tons of ways to save space on a phone. Text messages don't take up THAT much space. It feels like her employment was recent. Like the judge said, she seemed awful angry for some reason. This felt like it was about more than $400.

Yes, there are those who are able to get out of the loop, but that's not everyone. I actually believe her about the SA claims, mainly because of how amused the defendant is. Not in a "wow I've never heard this in my life" but a "I enjoy hearing this story bc they're not gonna believe you" kind of way. Troubled doesn't always equal liar, but it tends to hold people who get trapped in these situations down to where they are never believed and can never get out. The fact she read those text and that was the ONE text he had saved talked about her reporting him if he doesn't pay. Just because she's threatening doesn't mean it's a lie, she more than likely wanted to be done with him. Normally the judge would push harder on where's the other texts, but blows off the plaintiff when the plaintiff says it's because he deleted them due to sending crude things. The plaintiff went and filed a police report, but that seemed to have been forgotten about. The whole "don't look at me, look at her, she's been in trouble before!" is such a common tactic by abusers that it's a shame the judge doesn't recognize it. The outside audience is proof that there is this area where many get trapped bc they assume that they haven't been believed before so they won't be believed again, and when they take it to the civil courts which has a lower threshold of proof, when they're blown off, it just confirms no one would ever believe them in a criminal court.

That's exactly why they prey on people like her. "Nobody else is gonna hire you." She's afraid and convinced if she leaves this job she won't be able to find another one. So they stay and put up with the harassment.. His behavior definitely triggered her.

At the end of the day her case was not about SA it was about wages. Judge ruled properly. All she had to do was prove that she was at work. She didn’t have a supervisor that she had to check in with, not even texts that she was there? Typical excuse of “lost phone” doesn’t fly in the 2010s almost everything can be backed up or recovered by your mobile provider. Especially is she’s going to court.

Even though I do believe that there were inappropriate sexual comments made to the Plaintiff to some extent, she just kept repeating her well rehearsed, filthy mouthed set of lies, and she couldn't even control herself when judge Milian gave her those last warnings to shut up. The Plaintiff is just a common thief.

He didn't just look pissed, he looked completely embarrassed that he was called out on that. And also, he was doing the same thing that the Plaintiff was doing by claiming that there were all sorts of texts between them that he had no proof of, "because it's a new & phone & I don't keep all that $hit!" 😏🤣

Just because she’s a fellow female doesn’t mean anyone should buy her story. It also doesn’t mean ignore the allegations either but to proceed the correct way! Too many women jumped on the “me too” movement bandwagon and made a joke out of actual victims so with that and the reality that all humans lie, don’t buy someone’s story just because it’s a female or vice versa

The judge really blew this one. There is no way on God's earth that she is consistently complaining, banging the car steering wheel, filing police reports, contacting her employer, etc. in order to extort the man for one week's pay. I believe she was being sexually harassed and the creep wouldn't sign her timecard as payback to her complaining.

Well, as you know, you have to come with proof. No police reports, no text messages, not much of anything. JJ and JM say it all the time. Some cases are extremely hard to prove. If you prove it, they will give you every penny you ask for. Even P&S(and they Never give those)! Just gotta prove it. (Personally, I believe that JJ and JM bring these people in the court to embarrass them for being perverts because they've avoided the criminal justice system. And they always entertain the SA cases. M y hope at least.)

@@KAJ53 In small claims court the burden of proof is very low. It's why small claims court doesn't allow lawyers. Often in small claims court a judge will rule on who is more believable. Also keep in mind that the judges in court shows are not state or federal judges, but rather, arbitrators. Arbitrators have much wider discretion that state and federal judges.

@Criminal.Lawyer.2024 I believe we agree. The issue where she went wrong when, in open court, she said, "I want to harm the defendant." She lost credibility. JM didn't like that. The arbitrator, or fact finder as JJ calls herself, found her to be unbelievable or unreliable at best. Sucks cuz he is a creep but our laws aren't always the best

The defendant is a jerk. The plaintiff should’ve asked the agency to remove her the first time she was offended. Why did she continue to put herself in that environment if it upset her this much? Why didn’t she report it? Overall this is sad. I hope she gets the help she needs to heal and move forward. He’s more concerned about his foot than the sexual harassment allegations 🙄. I totally believe he did all she said he did. She messed up when she tried to negotiate her pay instead of reporting him.

I think she may have just wanted to hear what he was going to say . And the reason I say that is because I had a home health assistant who told me she had to start working for me for her own personal reasons. Her friend end up being assigned to work for me next, but I didn't know that they were friends and she also asked me what happened to the last girl. Thankfully I didn't have anything bad to say about her, but later on I found out they were friends on social media. I came across a photo of them together and that's how I found out that they knew each other prior and they were just trying see if I was going to be messy or not. So maybe that's what happened but I'm not sure.

I believe the Plaintiff about the SA (I would never want to discredit someone’s experience). HOWEVER, I do believe the events leading up to everything could’ve went differently. I think they were having an affair. And something happened so he started holding the sign in sheets over her head while still flirting and harassing her. She got mad, started slacking with the work and threatening to tell his wife/family about everything just not the consensual part, only the part when she was done with him. And that’s still SA. No means no. Their communication is beyond a work relationship and too emotional. And the wife isn’t there because of that dynamic and embarrassment.

I absolutely believe her. I was 21 yrs old and my Boss asked me repeatedly what color panties i had on daily and asked to have sex with me daily...he got physical with us as well. I reported him and another coworker did as well. He was fired. If only I knew i could have filled a lawsuit. It was the late 90's. I was young and dumb. He had a stellar reputation in the company and few people believed us because we were young. He was happily married with children and lost everything...his job and his family.

I wasn't sure her alligations were true until the defendant gave his testimony. The phrasing and word choices made it clear he was lying. I don't know exactly what the truth is, but he definitely did something very inappropriate to her. She definitely needs therapy for her history of abuse, her poor emotional regulation skills hurt her here. Hope she finds healing.

This is one of the few times that I disagree with Judge cause SA victims can have all types of demeanors not a scared “shrinking violet” but angry and rude as well. She may not believe anyone will do anything to help her after being violated. She just wanted to be paid and not see him again.
