Dear, thanks for the video..it helps. I wanted to buy a property but seller demands the 50% money before sale deed (which is approx 50L)..will that be okay if i pay this money on the basis of agreement of sale? Will this document be a valid if seller defaults it? He is ready for the sale deed after 2 months time once his sale deed is done. How to handle this situation witha legal documents to give him the money in advance ?

If commencement certificate lapsed and not renewed by builder. What will affect to OC. Builder say 80% work done and OC will come in 3 months. Is it good to invest in such property. Bank also provide loan without checking this document was not renewed by builder. How safe for buyers?

Thanks for such valuable information. I have a query that if the seller have outstanding loan and he wants buyer to pay this loan directly or by taking loan then what to do in such case? How should we proceed in such case.

Great set of videos by assetyogi. Brilliant. One important question - It seems on the day of registry the complete money does not change hands. Generally the registration is done. Then the bank loan actual money from buyer to seller happens around 1 or 2 weeks later once the bank recieves the sale deed registered . What happens if registration done but buyer does not get the final home loan disbursed ? Registered done but payment not completed. How is the seller protected ?

I have taken loan on this property as I'm a salaried person and I'm only paying the EMI of loan and rest of the expenses. Sir, I purchased a flat in Mumbai suburbs last month. I had full payment ready, but the seller had taken loan on that flat. I paid the loan which was 80% cost of the flat. The bank gave the seller no due and noc after I cleared the loan, Because the amount was 80% I wanted sale deed to be made and registered. The lawyer made agreement for sale instead of sale deed and told me to pay stamp duty and registration fees, which was approx about 6.5% property value, so I paid and got registered n signed by seller and me(buyer) at the sub-registrar office. I got the agreement of sale in my hand after 15 days with all the relevant papers. The lawyer says no need for sale deed as this doc (agreement for sale) itself is now considered as sale deed coz the doc is registered and stamp duty paid, so no need for any sale deed as i havnt taken any loan to buy the flat. The bank had released the property papers by post which the seller got it yesterday, my lawyer says once I get those papers from seller I should pay balance 20% after cutting tds and take possession paper and flat keys from the seller. Lawyer says he will write payment completion paper and take sign from seller for no further dues and no objections remaining. I want to know: 1) is the lawyer telling correct or wrong. 2) Which papers to be made after the balance payment done. 3) Is sale deed necessary or not. If necessary then the stamp duty and registration which is already paid how will it get adjusted. 4) The building society secretary confirms agreement of sale is accepted in Mumbai as equal to sale deed, and all rights and flat ownership can be transfered without problem. Sorry for long queries Thanking you in advance for your time and kind help. Please reply as its urgent.

Sir a agreement of sell and purchased is made in 1998 with the seal of notary India but there is no registration number in notary seal . Is the agreement of sell and purchase is valid??

Thank you, sir. I am selling a plot to a builder, by POA and Sale Agreement. On receipt of full consideration, I will execute the POA (to be registered). The builder (Power agent) will later sell the UDS to several buyers by Sale Deeds. When should I hand over the original documents to the builder? Your kind opinion, sir. Like plot is 100meter Govt circle rate (14000 per meter total cost 14.00 lacs) ya fer Jis rate par Maine liya hai market value Jo hai plot ki vo hai ( 30000 per meter total 30.00 Lacs)..kya mentioned Hoga..??.. Agar seller ye condition rakhta hai ki registry ke time poora money buyer seller ko Dede and seller property ko handover 2 months after registry n full payment kare to kya ye buyer ko manna chahiye Isse buyer ki favour mein aur kya clause dal sakte hain

Sir if their is a registered will for a land and according to the will seller is the sole owner of property and mutation is in the process but yet not completed ..should we go for sale agreement? What precautions should we take ??
