Update- Now i do have my pic and fingerprints on file with SS (suppressor purchase last yr thru them) and i submitted my Form 1 to make my 12.5 an SBR on Apr 14, 2023, and received approval today Apr 25, 2023. Thanks for providing this service. For guys like me who have only one of these firearms and are not used to dealing with ATF, $50 is money well spent. Few points to fine tune your instructions....1.) The way you have to pay for a transfer credit was not too clear on the video. 3.) You have to be sure that the Registration type on your Silencer Shop account is correct i.e. individual, undecided, etc... 3.) During the actual submittal process to ATF the user will have to answer questions so don't click the button and walk away.

After I completed the lcertify eform” section, I got an email saying it has been submitted/in progress. However at the very bottom there is a document with a barcode and the body of the document says “Within 10 business days, submit 2 sets of fingerprints to ATF address.”…I want to confirm that this is not needed since I used the SilencerShop kiosk to submit fingerprints.

How long is the estimated wait time, for an E-form 1? You guys said the e-form 4, would only take 30 days! .... 8 - 9 months later, people were finally getting their tax stamps! So, 40 Million e-form 1's should take about 10 years for its completetion.

Hey Chris, the ATF did say eForm 4s would process in 90 days. Currently for eForm 1 ATF estimates 30 days, we have seen 30-40 from our beta, but there is a good chance that the time increases based off of recent rule changes. - Chase

When I log in to eforms account it asks me to update my user information. I update and click save but it throws an error saying "Fax number must be 10 digits." There is not an "*" indicating the fax field is a required field. Is anyone else experiencing this issue?

You are by the ATF's own BS claims, incriminating yourself by taking pictures and filling out documents where you are essentially telling the ATF that you are in possession of an unregistered SBR. Not to mention the legitimate concerns about what happens after 90 days if your application hasn't been processed -- some guys might find out the hard way when the ATF kicks down your front door, shoots your dog or your kids, and seizes the supposed SBR you told them you are in possession of.

You fell for the fear mongering. Yes, this rule is stupid. No, your form is not auto disapproved after 88 days of submission (it is after 88 days of being assigned to an examiner, which is the least step). You do not need to submit photos of the firearm, only the engravings, which you submit regardless. The whole point of the forebearance is that they already know you have an SBR and are giving you a chance to register it before they kick your door in. If you don’t like it don’t do it, but if you were gonna SBR anyway, no reason not to save $200.

Hey SilencerShop, from your video its sound pretty straight forward. I wanted to SBR my MK18 under ATF Tax Exempt Forbearance Period through SilencerShop but was told it's not possible unless I paid the $200 tax stamp. This is the respond I got from your rep down below. Thanks! Use of the Silencer Shop NFA Trust, Single Shot or the Unlimited Single Shot Trust would disqualify you from the forbearance program for the free tax stamp, you would have to submit as an Individual to qualify for forbearance. Neither trust has provisions for a Non-NFA item. You can use a Silencer Shop NFA Gun trust or Single Shot trust for a form 1 if you are not filing under forbearance and will pay the tax stamp fee.

That is correct, due to the ATF Rule 2021R-08F, the trust would have had to have owned the item prior to the publication of the rule (1/31/23). Single Shot trusts or trusts without assignment sheets containing the braced weapon would not qualify for the ATF's forbearance, and would therefore require the tax stamp. - Chase

AFT says it's 40 days for amnesty eforms, but i'm at day 50 on one and day 40 on another. this is after doing both through silencershop with a trust. i called a couple of times just to make sure they had everything they needed, and the rep said it appears everything looked good.

Are we required to engrave our SBR's before we submit a Trust Form 1 if not in possession of a Notarized Assignment letter dated before the ATF ruling? Additionally, can we receive an individual Form 1 stamp and then at a later date pay the $200 fee to legally assign it to a Trust?

Any tax exempt application does not need engravings ( so long as it was engraved by the original manufacturer, Al. You could get approved as an individual, then transfer the item to a trust via Form 4. - Chase

I have SS kiosk prints from last year from SS orders, do I need to go in again? Do you automatically add them to each $50 ATF form 1 Why 4.26.23 deadline when it's may 31st using ATF website So you pay $50 for each SBR form 1 to send Digital prints vs having to Mail 2 paper print cards, is the benefit ??? Hi there, your prints are good forever, you do not need to update them. You may need to submit a new photo if its been more than 12 months. The largest benefit is the compliance check, who verifies all of the submission information and confirms your firearm information prior to submission, our compliance team ahs a much higher accuracy rate compared to standard Form 1 applicants. - Chase

The eform 1 submission is temp “out of stock” until June 1. I was really hoping to get my ak SBR’d before the amnesty period is over. My first sbr got approved in 13 days. Looks like after June 1 im going to have wait longer than 2 months because of the number of submissions, possibly. Still dont know why SS would wait after June 1 to bring back eform 1 submission option when there could be ppl who want to go the sbr route, paid tax stamp and all. I’ll probably get roasted for this post. Oh well. Whats up SilencerShop?!

Yes, you'll have to use the " My item description is not in the list, create new item" option in the eForms menu. Single Shot trust does not apply to amnesty applications, but can be used for standard tax paid applications. - Chase

Hi, SIlencerShop! I just finished this process to the point of certifying my eForm 1 using Full Auto. Upon doing so, the ATF sent me an email with a cover letter requesting fingerprint cards along with a cover letter. If I've already used SilencerShop in the past and my headshot and fingerprints are on file with you, the eForm 1 service will automatically complete this step for me, right? Thank you!

It took about 10-15 minutes. And I never got the "certify now" email, I just kept checking it after signing the documents and not long after, it had the button to certify. If you're still waiting, I would log back in and look, it may already be ready.

So this isn’t trying to be funny or anything, but as I understand it, the ATF is saying we all have SBRs currently and that we have to register them. They’re NOT saying that we have pistols that we must Form 1 INTO SBRs. So the question is, can we go ahead and put a stock and a VFG on them while we wait for our Form 1s to get approved since they’re already SBRs anyway? It wouldn’t change the current classification of them.

Hey D B, you are correct in that ATF has determined braced items to be SBR's, however, this forbearance period recognizes that there must be a period to allow folks to get in compliance. During this window, braced items are considered in compliance, but adding a stock prior to Form 1 approval would be considered manufacturing an NFA item (as we understand the rule) - Chase

I’ve heard mixed things on this. If you do this, does this mean your gun with a stabilizing brace is now classified as an SBR? Meaning I can replace the brace with an actual stock? Someone at a gun store told me this tax exempt form 1 only registers your gun to have a stabilizing brace and that you cannot replace with a stock.

You are correct, Nate. The Form 1 is an application to make an NFA item, so you would be turning your firearm into an SBR, allowing for the use of a stock, grip, etc. after approval. - Chase

Yes the process should be the same, Max. You can only file tax exempt on a trust if your trust was formed and owned the item prior to 1/31/23, tax exempt application do not require additional engraving. - Chase

I saw this question asked/answered a few times, but it wasn't perfectly clear. If I have an Aero lower that came engraved from the factory, once its approved as an SBR does it need the manufacturer/serial engraved a 2nd time on my rifle? Or would I just need my name at that point?

If you file tax-exempt you do not need any new engravings, Tripps. If you file tax-paid, you will need maker (you/your trust) City, and State engraved. - Chase

According to the ATF your overall length measurement process pictured here is wrong. Shouldn't it be to the end of the buffer tube on the pistol AR?

For previous pistol definitions that would eb correct, RC. For SBR's, which is what the Form 1 is intended to create, you should measure in the largest firing configuration. IE, brace/stock fully extended, no muzzle device (unless it is pin/welded) - Chase

So you have to buy the single shot trust, engrave the lower and take a picture before you fill out the e-form?

Not quite, you need the Form 1 credit, Tax Stamp (if applicable) and Trust (if applicable) prior to certifying, you can engrave the lower (for standard tax paid applications) at any time. Tax Exempt applications do not require additional engravings in most cases. - Chase

You are correct, you can file form 1 tax exempt, and convert your pistol to an SBR, you do not need to keep the brace after approval JKLOP. - chase

It will not let me CERTIFY my submission. I have done everything the way I was supposed to, and the 3rd time I thought I was at the end, the whole screen will not show! I can't see anything at the bottom while going through "full auto", therefore can NOT select the right options at the bottom to certify!! I've been trying for days now!! I've paid my processing fee to Silencer Shop, and have used eFile before for silencers. How do I get it to show the bottom of the forms without having to go to a kiosk???

You cannot certify on a kiosk, Dan. There are a few fixes, if you're not using a PC that could be causing the problem, the ATF eForms site is not formatted to scale to mobile so it can be difficult. Try zooming out of the window (hold ctrl tap the Minus (-) button wtise) that should zoom out to reveal more of the screen. - Chase

I did 2 form ones recently. One was went great and the other was submitted but still has a status of certify, maybe because it is pending research. The both are on the eforms website. I had trouble with compliance wanting me to state the importer vs the manufacturer of the firearm. They were confused the importer was the same company just their USA company. Would not let me use the manufacturer template on file with ATF so I had to put in the importer which is pending research. Hopefully it works out. Very nice have your prints and pictures on file.

Hey Chase, when we get the DocuSign Form1 sent to us, how come Silencer Shop is using an older version of the form (revised 2019 vs 2022 that's on the ATF site)? Does it matter? Also, box 1. a. "Tax Paid" is checked. I see guys on KZbin and Reddit saying they chose c. "Tax Exempt" ... which is correct for the waived $200 tax amnesty filing?

The Docusign is just a template, not 100% reflective of the actual form being submitted. All of the Docusigns will show "Tax-Paid" regardless if your filing method, "Tax-Exempt" is the correct option for the waived tax stamp. - Chase

@puma got an email back from their CS, "ATF, has been accepting them with, for a temporary service we confirmed with them vs rewriting all code. -Mike" And they said they would go in as Tax Exempt. I really wish they fixed the forms before we signed them, or better explain this aspect, especially we're paying for a service to have it done right and not play guessing games with it. Some of us like to read carefully before we sign!

Yeah and when the brace rule is thrown out there will be I bet 5-10million more legal by the ATF standard Short barreled Rifles. All the more harder to confiscate them all. So idk which way to look at it. All I know is Biden wants them band and when the rule is tossed there will be 5-10 million maybe more SBRs in America.
