Since the ATF argues SBRs don’t violate the 2A, it makes the NFA’s SBR requirements fair game for constitutional review. It would be poetic justice if the NFA requirements for SBRs are ruled unconstitutional because the ATF promulgated the pistol brace rule.

The ONLY reason sbrs, suppressors, machine guns, ect are "unusual" and "not in common use" to the extent that they are is the NFA. If that went away and along with it the artificial scarcity, the prices for such items would be more affordable. The NFA and similar state laws are the only reason MP5SDs and 7" select fire suppressed .300 black out rifles are not ubiquitous for home defense. The ATF is basically saying "we banned and taxed it so it's not in common use so we can ban and tax it because it's not in common use."

Every administration under the executive branch uses the “Administrative Procedures Act” to effect a rule as though it is law. And every rule is directly initiated by Executive orders! Congress no longer need make a law, but merely make an Act that merely states its goal, and the administration, by executive order, is left to achieve that objective. In this way congress has no culpability, and neither doses the president. The unelected administrator is at blame but can’t be easily removed.

The statutes confine in its language what the agency may do. The ATF changed the law. No. They don’t have the authority to make law. That is the job of congress. They can’t make laws. Any regulation that says something other than the statutes are unconstitutional. There is an injury. The government shall make no law respecting the ownership or gear for an American’s right to bear arms. It is fundamental. They are going to uphold the rights of Americans. I don't get the whole SBR thing. Smaller stature people find shooting the smaller SBR's or braced pistols more comfortable and feel higher levels of confidence and safety with the size appropriate firearms. Think of a smaller framed runner being forced to wear shoes that were much to large for their smaller feet. It makes no sense to force smaller sized shooters to use a full size rifle. They used "boys rifles" many years ago to train younger shooters, and the shooter barrels and stocks aided them by fitting the rifle to the shooter.

Because it’s “easier to hide” a SBR on your person. Before there was pistol braces, you had AR15 pistols with just the buffer tube, never used in mass shootings. Every mass shooting has been with a small handgun, full size shotgun and or rifle. There might be 1 shooting that used a “SBR”, but doesn’t support a ban on them.
