I work side gigs as security. Event security supervising. By law, all relevant event staff can be held responsible for the safety of event attendees after they consumed alcohol, until they sober up. Even after leaving the event. Within reason! If event staff cut you off from drinking, or eject you from an event for disorderly conduct, because you want to keep drinking after being cut off or make a scene, and it's documented that staff did what they could to best control the situation, the chances of punishment start to shift back onto any patrons in question, for anything that happens after they leave an event. This is just plain slobbish behaviour. If you can't handle yourself after drinking, you shouldn't drink. If you can't handle the accountability and responsibility and shift blame so that you can't blame yourself or your drinking as the problem, then you're an alcoholic, and an addict. At the very least, you possess the psychology of one.

As a bartender in the US, depending on what state you're slinging drinks in, you can be held liable if you keep serving someone who's pass the limit (as in they're showing blatant signs of being wasted) if they get behind the wheel, we are suppose to call them a taxi. However a restaurant is WAY DIFFERENT then a concert venue. There's no way they can keep track of every customer who orders a drink let alone baby sit them the whole night. You have way less control when it comes to keeping an eye on drunk customers in a venue like that then in a bar/restaurant. It's definitely not the venues fault or responsibility. She's s.o.l on that one. Watch her turn it around on her dad next. 🙄 EDIT: Thanks to the nice people who work in venues and sporting arenas for informing myself and others, that they are held to the same rules and regulations as bartenders in bars and restaurants. That being said, depending on where in Canada she was and the laws they have, the establishment could definitely be held liable. Now that being said, they'd have to prove that she didn't sneak her own alcohol in and/or that no other person got drinks for her if the bartenders cut her off. As well as making sure she didn't take any narcotics that would have amplified her intoxication levels. So hopefully Atozy comes back to update us on what happens because I'll be very interested to see what the courts do. Make sure you stay respectful to others in the comments below. Nobody knows everything, there are ways to share your opinions or knowledge on the situation in a respectful way. ✌️💜

I live in East London and my dad has a shop just around the block from the house that got hit. We were at the Manson concert that night and we felt the explosion there, even through the concert chaos. It was absolutely insane. The power went out all over the city, even at my house which is not near downtown where it happened. This incident set our city into a frenzy because of the drunk driving. Actually, at least in BC canada, because the venue sold her alcohol, they can be held legally responsible. The amount they can be held responsible for can vary based on situations. Section 29 of the Ontario Liquor License Act prohibits the sale or supply of liquor to any person who or appears to be intoxicated. Section 39 of the Act imposes a duty of care on commercial entities (this can include concerts) to any person who suffers injury or damages as a result of harm caused by an intoxicated patron. A “duty of care” is owed by the server to ensure that alcohol is not served to an intoxicated guest, or that a guest is not served to the point of intoxication. So basically, this company can be held legally responsible and have legal actions taken against them for this.

Can confirm, in most communities that I know of in Canada, when tragedy strikes, the whole community steps in to help. We had several floods in my city and they never had to ask for more volunteers. putting her claim in the best possible light, she showed clear signs of being drunk when ordering, including slurred speech and the like and the bartender just didnt notice or care, served and took money. in which case she has a claim believe it or not (note, in my country she wouldnt have a claim against the catering service, the state would sue the catering service and likely revoke their alcohol license). in the worst possible light she had friends or other people order for her after she was cut off, got caught, kicked out by the bouncers, drove off causing the crash and ensuing explosion and then tries to sue the venue and otherwise blast them on social media if they dont give in.

It's almost impossible at a concert venue, one that holds Manson concerts, so thousands of people, to monitor everyone's alcohol consumption. Especially when some people consume way too much but aren't the person buying it, or going to the concessions to purchase it. The big venues have insurance, so it's not enforced as heavily unless it's blatant Small venues have to be diligent or would face closures and shut downs or bankruptcy from not being able to afford the fines. Even Alcohol commercials have to have a portion reminding you to consume responsibly in Canada, not sure about the states

There's waaay too many preventative measures for drunk driving for it to even make sense to sue a venue for overserving customers. Ubers, busses, etc... It should be entirely put on customers now for not taking preventative actions. Sure, bartenders should still cut customers off when they get too drunk but it's not their responsibility for how the customer chose to get home. The customer chose to drive there, drink, and the customer CHOSE to drive home. That's her own damn fault, not the venues.

A few years ago, on a quiet winter evening, I was eating dinner with my dad who was visiting, when we heard a LOUD boom. We rushed outside to find my neighbors how had literally exploded- gas leak. 3 people were inside, all escaped. One was uninjured but a teen girl and the father were severely injured- TBI, hearing loss, burns, etc. It fucking destroyed a few of us who witnessed it. I rushed out and helped the kids- the injured dad was so upset we couldn’t calm him. I didn’t sleep for the next week, so I funneled my energy into crocheting blankets for the family. Family and friends helped me buy needed things for the kids, like pens that work well with injured hands and new toys. I honestly don’t think I’ll ever get that out if my brain. Any of it.

As a bartender in Canada...if you over serve someone to visible intoxication and they drive and something happens...myself and the establishment all can be held liable. Huge fines and I can lose my license to serve alcohol. That's by the law tho. Liquor inspectors come in, check cameras and tils. If you remove someone for being drunk you have to call a cab and make sure they get in. After that you are no longer responsible

By this reasoning, the sale or offer of any alcoholic beverage should not be permitted to any person in any public setting or venue? Just because of what might happen in the future after consuming alcohol? That's like me suing a car dealer for selling me a car that I might end up crashing in the future just because I chose to drive it on a public road with other people around, and saying I would have not crashed if I was not sold the vehicle to drive in the first place. If a person buys alcohol at a venue and chooses to down 3 or 4 drinks in a three minute period, there would not be an indicator of intoxication present because it takes time to take effect after consuming. Or the possibility a person has built up a tolerance to alcohol making it difficult to spot impairment.

I'm from this town and this shook our city so much. It happened in our downtown core. She can blame budwieser gardens but they have great security and staff. She's so irresponsible and needs to take blame. Our communities really came together quickly to help out all families involved

I remember hearing about this back when it happened (I live in southern ontario). Never followed the news on it though. Yikes. Good lord, she's even from my city. Why am I not surprised. I'm pretty sure no Canadian judge will even bother with this. We do have safe serve laws, but this is not one of those cases. What I do hope comes out of this, is that she's never allowed to have a license again.

It's sad but true here in Ontario we have a certificate called smart serve that you need to pass to be able to sell alcohol like be a bartender and basically you are responsible to make sure that you're not overserving anyone and letting anyone become intoxicated in proximity becomes your responsibility if someone gets drunk And drives in my town somebody overserved someone at a bar and they drove into a fish and chip shop and the drunk driver sued the bar that he left and won unfortunately

While I can see the logic behind the law, I can't help but still see so many flaws in it, especially if it extends to venues (I think it does in some places). I promotes healthy bartending habits to stop serving your patrons when they've obviously had too much, but I feel there's too many ways to get around it for the patrons

Actually some people do not know they are not in condition to drive. It is called being in a blackout. My husband was drinking at home and after being super drunk he thought he needed to pick up our 10 year old daughter. Well it was 2 am and she was asleep in bed. I was able to hide the car keys and finally get him bed. The next morning my husband remember nothing and did not even believe me. However we have a video camera at the front door and so that pick some of what happen. My husband was so appalled knowing that he was going to get in the car and drive somewhere even though he didn't even know what he was doing. He stopped drinking and that was over 20 years ago. There can be a very fine line where you feel okay with alcohol and then the next thing is you're drunk and then you don't remember squat. Most young people do not learn to drink in this country reaponsibly and to stop as soon as you start to feel it. They basically are learning to just get drunk. How many American first experience is a glass of wine with dinner. Nope instead it is to hide it from adults and get as drunk as possible. What makes alcohol so dangerous is people think they're fine until they're not.

This is in Canada. And May get thrown out. I was corralled into a lawsuit (along with 12 others) when a single guy was sued ….who worked in the same BUILDING as I did. I had nothing to do with his business and only knew him as “a dude who worked in my building”. They knew he didn’t have deep pockets. They wrangled as many “businesses” (who had insurance policies) as possible so they could force mediation. It costs me 25,000 and three years for my attorney just to answer all the bulls@*t letters/hearing/discovery. At mediation my business insurance was forced to pay $50,000 just to settle. I was faced with spending more than 25,000 to prove this is ridiculous and risk getting a judgement against me some how. The insurance company would NOT help pay for the trial and ONLY would pay a settlement. Me and 12 others had to pay $50,000 to settle and remove ourselves from possibly getting a large judgement against us. That attorney knew how to manipulate the system. If this is a US case……don’t ever think a lawsuit is too egregious. I am $75,000 proof it is about settling the money grab…..and never about truth or responsibility.

I live in Ontario Canada. And you have to be 18 or 19 (19 is when you can drink here) to serve alcohol. You need to pay for a license to become certified to be able to serve alcohol. Even so much as handing a guest a drink or just ringing it thru. In the training I went thru, there’s a big emphasis on over serving and it states that if you over serve someone here and they drive drunk you can be legally responsible.

@@jessiec2220 it's not always easy to tell, especially at a concert and such. Heck, my brother lives with me at the moment, and he's a major alcoholic. Sometimes I can tell he's drunk, but that only after spending a couple minutes around him. It's hard to tell sometimes because he's always a angry idiot whose inconsiderate of other people and their feelings, and laughs at the stupidest things and mumbles to himself. He acts literally the same when he's drunk. Plus, he does his best to stay as high as a kite all the time so it doesn't help to identify if he walks weird or speaks a certain way because he's high or drunk. This is with a guy I live with every damn day, I commend those who can tell when one random stranger they see for at least a minute has rea he'd their limit

I live in Ontario, and there was a case of drunk driving teens near me. They went to a bar with fake IDs, and drank in the parking lot as well as in the bar. They hit a rock cut driving home, and two of the four kids in the car died. The bar ended up losing their liquor license and the bartender actually got charged with criminal negligence causing death.

Similar things can happen here when I was taking my liquor license to become a bartender and they told us about a story where a woman was served too much alcohol, went out and drove,and killed somebody. And the bartender was also charged too. So it's not rare, but it's very fair.

I was actually on my way home from a concert in Toronto when this happened but was talking to friends in a group chat (we all did theatre together) that lived in this neighbourhood right after it went down. People that were blocks away felt it and one of the people I know was just down the street from it. It was crazy driving by there days after it happened. The community really stepped up.

Okay, here's the thing. I go hard at concerts sometimes. But I ALWAYS go with my sister, who's my DD. we take turns being the DD, depending on who got drunk last time, who's a bigger fan of the group (sometimes I drag her to concerts and she'll drag me). It's safer knowing you're there with someone who would be able to go home, because those people see so many people that they can't keep track of those who seem more intoxicated, especially at bigger venues. It's so easy not to drive drunk. They have no responsibility after she leaves the venue.

This is waaaaaay too common in the Kitchener, Waterloo area. It’s well known that one of the restaurants here served someone alcohol, they drove drunk, and the person came back at the restaurant for serving them and allowing them to drive. The restaurant now has a two per person serving limit.

There was a past situation where a Woman working for a Realty company in Barrie Ontario sued her employer for allowing her to drive home drunk after the company Christmas party. Her boss told her not to drive after the party and tried to arrange a ride for her, but she chose to drive home through a snowstorm. The case was settled out of court.

It’s crazy seeing lil old London (Ontario) being discussed in my recommended KZbin videos haha. I cannot describe properly how crazy loud that explosion was. A brick from one of the houses that blew up wound up flying through the window of a Tim Hortons 5 blocks away. My friend lived a block or two away from the explosion and I was calling her all night worried and she never answered. Turns out she slept thru it. Daniella Leis will forever be a myth in London. Crazy how one bad decision can screw up so many lives. She was pretty young at the time though, I hope she learned some things out of this situation. We all do stupid shit before our 25th birthday. But driving the wrong way on a one way street going Mach speed and slamming into the house at the end of a T intersection really tops it. 😂

Hey Atozy, I work in hospitality and this is 100% a thing I live in California they have the strictest laws for driving under the influence. When we hire servers they have to take classes to educate them on when to cut people off most venues are suppose to be a two drink limit especially if its cocktail. Most companies make employees sign waivers releasing them of liability. I am saying all of this to say that she can sue them and she may win depending on the circumstances they wont be responsible for 100% of liability but they can be at risk at holding some liability but suing them will not devolve her 100%.

I was charged with a DUI. I hit another car and totaled my own and permanently injured myself. Nobody else was hurt and even their car had only very minor cosmetic damage. It was my fault completely. I'm TABC certified. And in the US you have to be certified and trained to serve drink and food at any type of venue or bar. The case might make it to trial at the very least. The first thing they drill into you is not to over serve. If I over serve and they die or kill someone else I can get a fine and up to a year in jail. I've managed big events. All servers are certified and trained to pull a manager if someone looks too intoxicated so they can monitor them and/or cut them off. You know give them water or food. Call them a cab if needed. It's a coordinated effort. Yes. You are responsible for your own actions. She definitely deserved prison. This may set a precedent and actually change regulations in the UK if they already don't train and certify servers. At the very least acknowledge that both sides share some sort of accountability. If I invite you to my house party and you die, don't you think your family is coming after me for justice and compensation?? You may lose but you'll be pissed enough to try.
