As a drummer and son of a lifelong drummer, sticks do fly. Whoever setup the orchestra seating has to account for this. We do not know if the drummer complained about positioning, but he should have recognized the threat and protested.

I was thinking the same thing. As a stage technician, he does not have enough space. It can be really hard to fit everyone in sometimes, but that's why you test out the positions carefully and then make sure they are kept.

A big part of that is also teaching the right grip. Having taught high school percussion, this is incredibly common since they hit the bass (which is much more of a loose head than any other drum) and not expect the rebound growing based on how hard they hit, and that its delayed like the swell before a wave. Thats also why I always tell kids to strike the head with the elbow fixed outward so if it does fly out of their hand itll just go straight up or into the players face (which is always hilarious.) There will ALWAYS be two things that happen: 1 - Some kid gets hit in the face with a bass mallet, and 2 - Some kid gets hit in the balls with a stick.

5:23, I've ridden this ride at the Mall of America. You control the wings on the edge to make yourself roll. Being able to spin all the way around does take some skill, but is also pretty fun. Stopping upside down is extremely hard.

Fun fact about the people carrying equipment at the side of games: A lot of times, they are untrained volunteers getting 'paid' in a free view of their favorite team's game. And, there are definitely waivers signed before you are allowed to be on the sidelines. (Source: I was once invited to hold equipment on the sidelines for a Chiefs away game and had the process explained before I had to regretfully decline.)

I've never made it onto the field but I sold souvenir stuff for at a couple jets home games. I wanted to be on the field, but I didn't realize they didn't get paid. Glad I stuck with the souvenirs because I made a killing both times I did it.

The drummer one: I Take a different stance than Tom. I think a reasonable person should expect that the nature of drums could result in sticks flying, breaking, or otherwise not staying directly with the drummer. While band is not an contact activity generally, percussion aren't typical instruments and by their nature are impact activities so working. jn proximity to them could result in flying sticks.

I would agree. You can also see that the drum is angled so that if the stick would slip, it would have a trajectory towards the person standing there, so she should either have moved or made someone aware of the possibility of that happening

@@bazzakrak It's usually the conductor who decides seating so it's not so easy to just move. But when deciding on the seating they should definitely have made sure that sticks wouldn't fly directly at her.

Agreed, if you think about it, bass drums are basically musical trampolines you hit really hard with a special hammer. In fact most drummers keep spare mallets on the side of the drum for such occasions where something goes flying or breaks.

So my job sometimes lands me on the side of the field and the pass has a basic disclaimer that basically says there is a chance of you becoming more involved in the game than you wanted to be and to take due caution. So with that language on the pass, I’d say ability to sue is minimal as you are forewarned.

Its still grey area. I deal with the same stuff, if its not unreasonable, and you are meant to be aware of the field etc, but there are also duty of care laws that you cant just sign away. I dont think that cameraman would have much more than a workers comp claim though.

@@cammywammy420 People do dumb shit that is 'unforeseeable' sometimes; and it might be the only recourse. Its usually not big events to be fair, and usually not players. But imagine staff A leaves something out of place, staff B gets hurt. They might be at different companies, responsibilities get confusing and it goes to court. Players for example may throw equipment in a rage or celebration, and its not really something people are looking out for. This is my understanding of how it works here though. You still have to perform your duty of care to those around you, you cant sign that away. You are still expected to have reasonable awareness though.

No small feat but that is literally their only job, to keep the camera safe. Sure good pictures keep you hired but losing or breaking a 10k camera setup will get you fired on the spot. If anything he was preserving his job especially if it was his personal equipment. That rig had to be 10-15k at least.

So. Fun story. When my mom was still living at home (relevant because it was in the country and animals are generally loose and for farm use out there), when she was driving home one afternoon, a dog ran out of the trees and rammed into her car while she was driving. I don’t know the exact speed she was going, but I don’t think it was super fast. Anyway, she stopped the car, but the dog had just stopped, literally shook it off, and kept running. When she looked at the side of her car, the dog had left a giant, like massive, dent in her car door. She said it was so much damage she had no idea how the dog just kept running down the road. Apparently she saw the dog a few times after that and it never looked or acted injured. The "fun" part comes in with her trying to explain this to the insurance company. They did not believe a dog could hit a car and not the other way around, and accused her of trying to cover up an accident, so they refused to cover it and raised her rates. Gotta love insurance companies. The real mvp is that farm dog though. This was a little over 30 years ago and I have no doubt in my mind that dog is still out there running, hitting cars, wreaking havoc upon the world, fully ready to outlive us all.

My friend in highschool had a border collie that would try to herd EVERYTHING! This dog regularly body checked cars until the car started to behave the way the dog wanted. Was a terror to the neighborhood when that sucker snuck out, which it wanted to do all the time because those cars weren't behaving.

Legal eagle actually did a break down of this. A quick summary: the orginal recordings of her songs belonged to the producing company. Taylor Swift still had ownership of the song's composition (the notes and lyrics). She tried to purchase or negotiate the orginal recordings, but it did not happen and the recordings were sold to a private equity group. So Taylor Swift make new recordings using her own money. As was her right, she owns the composition. She is very popular, so fans and companies interested in licensing her music would rather her newer version, rather than the older version which is controlled by a Private equity firm. And many people believe her new recordings are superior, as she has matured as a singer.

@@tomasxfranco I suppose the recordings and music videos are very expensive and difficult to reproduce. It's the industry standard for a reason, and presumably economical feasible. Also, an artist losing access to their compositions would not be able to perform their music live. You can also imagine the original recordings to be immensely valuable, even more than their composition, for artists who have passed. For example, Elvis, or the Beatles.

@@tomasxfrancoIt’s a big undertaking to re-record, mix, and master a whole album. You need a studio space, session musicians, producers, and time to get it done. It’s not a cheap or easy endeavor that swift undertook to re-record her albums. Because she owned the composition rights and had the resources (money + connections) as well as fan support, she was able to do it. In from an economics perspective, I’d consider this a market correction. Swift judged that the original recordings were overvalued and had the resources to create a product of higher quality at a lower cost. Because she negotiated her ownership of the composition, she was able to create this product. Not every artist can do this, but she could.

Years ago my Dads friends car got hit my a house.... They were moving a house a few blocks, and part of the porch fell off and crushed his hood. This was in the 50's but the cars insurance and the homeowners insurance paid off. (Mostly because he ran out and kept the pillar that did the damage) the movers didn't stop.... ALWAYS keep the "instrument of damage"!

So mechanic here the run away tire thing is a multi level head ache because It comes all the way back to the shops insurance and if you work in a questionable shop you can be personally liable. Well at least as far as I know lol correct if I'm wrong

It depends on the situation...it could come back to the shop if the issue was the nuts being loose. But, it could be a manufacturing defect, too...which is 100% not a shop's fault. Or, it could be the driver's fault, if they removed the tire for maintenance. And, regardless of the situation, multiple insurance agencies will be 'investigating' and pointing the finger at anyone but their client...meaning the whole thing might need to be resolved in court before anyone is found liable. (Source: I took a Business Law class in college, and one of the case studies was a case of a truck whose tire went wild. Everyone involved got blamed at one point...the truck's owner, the owner's employee/driver, the maintenance shop, the manufacturer...it was a great example of how unclear a particular case can be during the course of investigation.)

She was not seriously injured, no one was sued 😅 Another fact, it was a Saskatchewan, Canada based orchestra, and I actually know the conductor! The kid hiding in the trash can triggered the memory of a tv episode that's forever burned into the irrational fear side of my brain: 1000 ways to die, pretty much the exact same premises. A guy running from the police jumped into a dumpster to escape/hide, but didn't have time to get out before the trash truck arrived and started emptying the dumpster. Trash trucks compress garbage. Repeatedly. I'll never forget that one of the guys on the show said that by the time it was over, there wasn't even enough left of the victim to mop up with a kitchen sponge. It was probably more likely a freak accident than a common risk of jumping into trash cans or dumpsters, but, like, it's probably better to be safe than compressed into human paste. Don't hide in trash cans of dumpsters. Only ever saw a few episodes of that show, but man did it do some trauma lmao.

The cow thing wouldn't be something new in my home town 🤣. My mom and I once got caught at the train tracks because a cow was standing in the middle of the tracks. A train was waiting and the cops couldn't get the cow to move. I think it took them 15 or 20 minutes. I really wish we had smart phones back then!

I have a buddy who is a cameraman for sports events. I can confirm they cannot sue, those cameraman all sign waivers knowing the potential risk of injury being on the field. However, from what he tells me the job pays very well, with lots of benefits, so it’s not like any medical injuries that happened won’t be covered by their medical insurance.

As a family, we don't drive next to semitrucks; we only pass them. I see too many people driving alongside a semitruck. Look on the side of any freeway or highway, and you will find so many tires or strips of tires.
