Ang abiso ko po ay kumuha kayo ng abogado sa lugar nyo, para hindi kayo gumastos sa mga transpo costs at baka accommodation pa kung manggaling pa sa ibang lugar, kunwari galing Manila yung abogado pero sa probinsya yung kaso. Articles I and II should be declared unconstitutional if we follow the ruling of the US in Obergefell v. Hodges (2015) for violating LGBT people right to marry and equal protection of the law (being a quasi-suspect class.) Besides, I find it weird when Family Code Commission included homosexuality and lesbianism as grounds for annulment (psychological incapacity and fraud) as well as legal separation (discovery after marriage). I mean we LGBT don't have the right to marry other a same-sex person yet if we marry an opposite-sex person, we are still vulnerable to legal attacks. Family Code implies that LGBT people have no right to have a family and protected relationship anymore! This is outright discriminatory and oppressive. At the same time, marital infidelity (concubinage and adultery) is not included as a ground for legal separation and annulment. What does this law really imply? That marital infidelity and disloyalty are way better than homosexuality? I mean, I don't have any control over my sexual orientation yet it is my fault to become that way? The law should prohibit/punish the overt acts, not the orientation intent, or motives. Does it mean a gay person doing nothing is more criminal-like than a husband or wife doing s3x with another person who is not his/her spouse? Consensual homosexual conduct (gay s3x and gay relationship) is not even criminalized in the Revised Penal Code or other penal laws. Yet, the other grounds for annulment and legal separation constitute or are related to criminal or prohibited acts including crimes involving moral turpitude. Yet, these crimes must afford court trials in able to overwhelm reasonable doubt of guilt. Yet, homosexuality and lesbianism, which is beyond your control, are enough reasons to attack your marriage. I, therefore, conclude that the Family Code, as far as its oppressive and discriminatory provisions against LGBT are concerned, is a complete bUllsh!t!
