Complaint forms against police should not be in the possession of, nor issued by the police. They should be available at city hall, and reviewed by a board of citizens. The board should then schedule an appointment with the person filing the complaint. Then the complaint filed with police, being overseen by the board. It should all be publicly accessible.

Problem many states are doing what they can to eliminate citizen review boards. The state of Iowa change the law where they limited citizen review boards are only allowed with cities/towns with a citizen cap. If I remember right the capped it at 5k people.

These cops need prison, not lawsuits. They don't pay lawsuits themselves, and they don't learn anything from lawsuits. Maybe they'll learn something from prison. Or 2a, whichever. p.s. Before people start saying Abolish Qualified Immunity! that's largely irrelevant. First, QI only applies to civil lawsuits, not criminal prosecution, And, Even without QI they're usually indemnified, which means they still pay nothing themselves. Also, for example, Colorado officially abolished QI but also set a very low cap: $25k as I recall. But they're not indemnified for prison. Nobody is going to get locked up for them.

But at least she spoke a few words. If she had remained completely silent, not only would an arrest be justified, she would have almost certainly been convicted of wiretapping; a felony.

Well that comes up a lot on here. You can be trespassed for anything the operator of the building deems inappropriate. You can complain in the correct venue later, but disputing it in the moment is a bad idea, because you can be legally trespassed.

Over and over again we see people trying to put in a complaint by requesting a complaint form and the cops refused to hand over any sort of complaint form and say that you must talk verbally to the people and they will decide whether you're complaint is valid or not... Here we see guy do exactly that by trying to file the complaint verbally and get a resolution and we see how well that goes for him.

It’s to keep you scared of them. Not everyone will stand up for themselves in these situations. Those that do stand up may not due anyway for whatever gets done to them. When someone asks to file a complaint against an officer or any other civilian, he or she is well within their rights to do so. That officer saying “I’m not going to do that because I didn’t see what happened and it wasn’t my shift” that’s not gonna hold up. Either way you have to take down the complaint so it’s on file. Refusing to do so just means you’re covering up for your boss

He is literally following the law in regards to how that complaint would be upheld. Certain offenses have to be committed in the presence of the officer in order to be valid for citations or arrest, such as disorderly conduct offenses, which was the violation being discussed. The officer wasn't refusing to take the complaint, he was refusing to issue an unlawful citation for an offense he didn't witness.

This may not be entirely true or wise.... that's why the next right is the right to bear arms... You may offend someone with your speech. That offended person might take issue... Don't call the police now. Stand up for what you said. Words have consequences as well. Your words are not harmless. The government shouldn't be able to control your tongue, but you definitely can be held accountable by someone who doesn't like your words.

I mostly agree that with words causing harm or inciting fighting, it seems, at first, ridiculous. Adults should be able to control themselves and not be swayed so strongly by simple words. I struggled at first to think of ways words would bring me to get physical with someone until I thought of someone claiming they were going to harm, or worse, myself or a loved one, and if I have every reason to belive they will follow through with their words. That's far beyond mere name calling or profanity and most likely overlaps with terroristic threats.

The classic example would be yelling "Fire!" in a crowded movie theatre when there is no fire present. This is an example of how words alone can cause legitimate physical harm. Fighting words are determined by the context as much as what is actually said.

What this shows is that a good cop can be reasonable, defuse the situation, and be professional.. Compare that to a cop who wants to jack up the temperature, not listen, and is always "right".

There was a news station in Florida that sent an undercover reporter into several police departments to ask for a complaint form. He was beat up and arrested in over five police departments.

I think the point was to show the hypocrisy of the police arresting citizens for swearing and filming under disorderly conduct statutes but not bending the law at all when it comes to their fellow officers. The point was to show them if you don't arrest your coworkers then you can't arrest citizens for the same thing.

A lot of times they do, some of them just don’t care because there are generally no consequences for them and the city/citizens have to pay out for the settlement, then there’s the whole qualified immunity “I didn’t know I couldn’t do that” argument when it’s something that should be pretty common sense

The Captain told them to go to the NYS Attorney General and file a complaint. Sounds like a good piece of advice and they should also look at contacting the FBI / US Justice Department "Public Corruption and Civil Rights Section" if he feels his rights were violated. I'm guessing that they will not pursue an investigation based on the allegations as presented in the video.

The Jerseyville, IL PD refuses to accept misconduct complaints completely. This is where the police killed a child for holding a Bible on a public sidewalk and lied on their reports. Google Roger Holyfield. All police got qualified immunity and no prison time. Illinois is the only state that allows this, I hope.

Document the complaints, investigate, and report the results to the complainant. If the complaints become a chain of causation for the next complaint, ask a judge for restraining order.

This rights and police auditor didn't quite fully grasp all of the potentially pertinent laws and/or court rulings. He also did not choose the best way to go about holding the police accountable for their actions. He should have kept his voice down, kept calm and thought his approach through better. Instead of him MAKING ALL OF HIS PROMISES AND THREATS IN ONE SITTING LIKE HE DID, he should have simply kept coming back often, in different ways, at random times to file legal things and request things legally, as is his right. He also should have left when he got the OFFICIAL WARNING that he was trespassed and he would be arrested if he did not leave the police lobby. While the police WERE wrong legally, and while they WERE violating the law AND violating their policy, all he needed to do was CAPTURE ON CAMERA all of what they had done and were doing, post it online and SHARE all of it with Long Island Audit, Auditing Erie County, Accountability For All, Tyrant Terminator Audits, TOO APREE, Honor Your Oath Investigations, I.A.M. Free Inland Auditing and a few other big-following KZbin auditor channels to GENERATE MASS PRESSURE on these idiot tyrant cops. Auditors acting, sounding and conducting themselves calmly, respectfully and reasonably are FAR MORE effective and FAR MORE likeable to judges and juries later during lawsuits, period.
