Maybe you should review the rules and laws that the election officials should have followed. Talking to election officials is almost impossible outside of the early voting / voting activities. Any other communications end up at the County Clerk's office and would be overgeneralized. I've worked many elections in the State of Texas. Officials are just ordinary people that only know what to do from the two-day course they take. Anything broader could cause them alarm. Election judges (other precincts call them otherwise) can be protective and just as blind as an ill-trained officer. This one should have let Mr. Godbout be and explain that a provisional ballot isn't targeted at him. Saying that he has to sign an affidavit was a bit bombastic in my experience. The atmosphere 50 feet from outside an election's location should have a bit of a carnival atmosphere. It should be relaxed and friendly with each candidate's electioneering groups allowed to make a last-minute pitch for their candidate. I've clerked, electioneers, voted and represented my precinct and then county in the party process. More people should understand it so there's less of a mystery about it. Much like not knowing the process of Trespass, I think we've become too lax in how we regard such rules. You let the election judge completely off the hook when she was the one who should have allayed the cops' fears, calmed the voter down and definitely set the tone for behavior. She was completely out of line.

If the government guaranteed you an ID it would be ok. But it’s a lot harder for some groups to get an ID, like Native Tribes, and instead of trying to get them more access to voting, the government makes it impossible to vote, despite being citizens and a majority population in the area.

Every state in the US charges people to get IDs. In my state, Washington, it is $54 every six years to obtain an ID. Arguably, this makes Voter ID laws a violation of the 24th Amendment, in that it is requiring the payment of a tax in order to vote. Historically, states which have practiced voter discrimination have used poll taxes and other fees as a way to keep African-Americans, Native Americans, and poor people in general from voting. While $54 doesn't seem like a lot, (1) it can be if you cannot afford basic living expenses, (2) there are often additional costs involved, such as needing to order a birth certificate or other documents to prove identity, (3) there may be other issues around the documentation issue, such as the lack of a birth certificate if the person was not born in a hospital, which is common among older African-American and impoverished people, and (4) there may be other hoops to jump through causing more problems. For example, Alabama, a state that has a very severe voter discrimination history, closed all their licensing offices in majority African-American counties after passing their Voter ID law, making its residents travel to other counties to obtain IDs, which may be cost-prohibitive if a person does not own a vehicle or have enough money for gas. Public transportation in these areas may be limited, and in the best of areas, it is often difficult to coordinate the use of public transportation across county lines.

For the people without IDs, getting them should be 1. priority for them. Creating more voting places should be the priority for the counties I guess. I am a poll worker and cringe at the idea of getting a voter like this. Fortunately we have procedures to let anyone vote a provisional ballot. Thanks to AtA I believe I am better prepared to deal with disruptive voters. Mostly by not arguing with them or disputing what they say. Just guiding them to the correct way to vote.

The distance from a polling place is determined by each state. In Alaska it was 300 feet, here in Ohio you must be a reasonable distance. At my polling place it is like 25 feet.

There’s this implication that knowing your rights and expressing them, regardless of conduct, is going to lead to a better system. It’s not. The conduct matters. When you go about expressing your rights in such a belligerent manner, you make it harder for everyone, not easier. You make the cops look better and you might even spur along legislation that limits free speech. It’s counter productive at best

How many times are the voting officials required to tell the old man exactly how to cast a ballot? I didn't hear anyone tell him he could not vote without ID. He was directed to the official who could help him proceed with his vote. He didn't want to sign a form to certify his ballot as to his right to vote under the name he gave. He interrupted the process of everyone trying to vote. He was the problem, not the LEOs. The officers did show restraint and patience when dealing with him. The voting officials were patient as well, far longer than was needed. The first officer should have called a supervisor for the old man's complaint, if the supervisor refused to respond, the officer would be cleared.

We can't it doesn't match blah blah blah. There should be a voter ID law in every state. It is the most important thing we do, and it should be closely monitored and tracked. That we don’t have voter ID laws in every state brings the whole process into question and opens the process up to ridiculous lawsuits.

@@elbob1491his point was that it was a 4th amendment violation for the poll officiators to “demand” ID. Protecting against fraud is not a 4th amendment violation. He was also given an alternative form of voting that doesn’t require identification, which he also called illegal. Man doesn’t even understand the laws he’s supposedly trying to fight for, the only exceptions being those against the officer. To be an effective auditor, you will need to know the law as throughly as a lawyer because one wrong move can land you on the wrong side of your own argument

I don’t like law enforcement not doing their duty, and I don’t like law enforcement infringing on people’s rights. That said, I also don’t like “auditors” harassing people or pushing their interpretation of the law incorrectly. If you are going to push your interpretation all the way to the limit, be emotionally prepared for the idea that the court may disagree with YOUR interpretation, and may hold you in violation of the misinterpreted law. Generally, don’t be an annoying jerk. This isn’t a legal requirement. But, if you are being a jerk, wasting peoples time, harassing or annoying others to goad them into testing the limits of the law, I have no support for you.

@ harassment requires repeated contact with a specific individual over a period of time. If you meet someone for the first time in a place your legally allowed to be and you film them in public, as is their right, the fact that they don’t like that doesn’t make it harassment. Now if he comes by their house every single day and yells at them or makes veiled threats or obstructs their movement or something that’s different. But a single contact cannot by definition be harassment.

He was arrested for disorderly conduct, not trying to vote without an ID. In Pennsylvania, we do not allow the sheriff or police officers to be at our polling stations unless the Judge of Elections or three Citizens requests their presence about a specific single issue. We have elected Constables in our Municipalities that are responsible for security and have the ability to arrest citizens that violate the law. An officer may go to the polling station to vote, even in Uniform, but must vote and leave. Most polling places won’t let a Uniformed officer to stand in line, but have them go directly to the head of the line, and leave immediately. We’ve had problems with this several times and have had county voter services send official notices of how the local police officers are supposed to act per Pennsylvania law.

From the ACLU concerning specifically Connecticut: Under Connecticut law, the only people who can be within 75 feet of the entrance of a polling place are: voters while voting and children accompanying them; poll workers performing their duties, including registrars of voters (but not other elected officials, unless they are voting themselves); the Secretary of the State or their designee; a person assisting a voter at the voter’s request (which cannot be a candidate for office on the ballot unless they are an immediate family member); members of the press while reporting the news; registered checkers, as designated on the poll moderator’s list; moderator-approved information runners; police/fire/EMS only as necessary; non-partisan activities approved by the registrar of voters; PTO bakesale participants if the polling place is in a school; and student observers in grades 4-12, with parental or teacher supervision, to learn about the election process. Everyone else, including any self-appointed “watchdog” groups, must be 75 feet away. If someone is disrupting voting within 75 feet of the polling place, the moderator has the right to evict them from the polling place. If that person is eligible to vote at that polling place and has not yet done so, they are allowed to do so only when they are willing to do so without disrupting the polls.

This is the least of East Lymes worries! Their department is dealing with serious corruption, their Police Chief was arrested for domestic violence, another officer is under investigation after a stalking accusation. Then two towns over in Old Saybrook, their Chief is being asked to resign by the people of Old Saybrook at town hall meetings, police officers are quiting his department due to work conditions, aswell as tons of accusations of the chief abusing his power to get friends out of trouble and anyone who questions him into trouble

The officer wasn't approached to file a complaint. I know legal nuance is hard but the bill clearly says "approached to". Not "Whenever requested". Otherwise you could always ask fir a supervisor and severely hinder police ability to do their Job. Nobody lijes a Karen.

The first cop didn’t interfere with Godbout’s 1A rights. All he did was advise the persons he spoke to not to engage. If some random person who wasn’t a cop did the same thing, would they be suppressing someone’s 1A rights? 1A rights are only really suppressed if you prevent a person from speaking or limiting what they can say or where. At no point did he actually try to stop him talking or engaging with others. I’d give the first cop a B and separate him from the other cops in grading since only he failed to follow the letter of the law fully. The others get an A.

"Don't answer" is phrased as a lawful command even if he didn't intend it to be, and he definitely didn't have the authority to issue one in that circumstance. "You don't have to answer that" is phrased as a reminder, and implies that it's made with no authority behind it. That speech likely falls within the allowance of free speech afforded to a uniformed officer, because it does not execute their authority to limit the speech.
