I've got news for the vegan protestors..... cars can't be vegan, because gas isn't vegan. Even electric and biodiesel cars contain animal based products. And even Ethanol fueled cars run on fuel that is at least 17% gasoline. A 100% vegan lifestyle just doesn't exist in the 21st century.

That only applies if you've made an "affirmative choice to attend" the event. But if the event you've come to attend is a car show, and you end up witnessing a "street takeover", the police apparently think you also make an affirmative choice to do that too. And it assumes a "street takeover" occurred in the first place, which doesn't seem to have happened anyway according to the legal definition.

And it doesn't even appear that any of the drivers explicitly broke the law, or if they did then it's not clear because 1) we don't know the speed limit of the area, 2) there didn't appear to be any deliberate attempt to perform a burnout, and 3) there were no races happening at the scene. You can't even firmly establish that the drivers were breaking the law, it rules.

When an event turns into an unlawful event, the people who attend that unlawful event can be subject to criminal prosecution. The government has an interest in keeping our streets safe. That means from people who attend street takeovers.

The protestor were completely in the wrong when they "moved" to another spot in the store. I fully respect the right to protest but this was trespassing after being told to leave and not leaving. The chanting they did could have also be considered disorderly conduct as well. If you are going to protest do it on public property not someone else's property. Additionally they set up their protest without bothering to inform themselves of the difference between public and private property (or lying to the officer about their knowledge of that) and they also directly lied to the officer when they stated "Nobody asked us to leave" So in addition to trespassing they potentially could have faced criminal liability for lying to the officer which would hinder their investigation (of if trespassing took place) and, depending on jurisdiction, potentially even criminal or civil consequences for entering a business with the explicit purpose of disrupting their business. Seems like a very clear F to me.

I think he grades officers much more stringently than others since theoretically officers are supposed to be the ones trained for situations like this. And as to your first question wondering what the US would be like without constitutional rights afforded to it's citizenry, I would suggest that it may not look all that different than it already does. Seeing as how, as you said yourself, "there are always cops determined to violate the rights of citizens", it would likely be only slightly more exaggerated than it is already. The US Constitution would be better served used as toilet paper at times considering how often those that are bound by oath to uphold it consistently wipe their own asses with it right before ignoring it. The officer's actions and reasoning in the first video are honestly terrifying. These are exactly the type of officers who’d follow orders to harm or even kill civilians without hesitation or just cause if their masters ordered them to do so. The "C" seems very generous to the protesters given they also expressly lied to the officer when they said "Nobody told us to leave" So they: - Set up a protest despite not even remotely understanding the difference between public and private property - Almost assuredly committed trespassing - Lied to the officers Although they're not auditors, given that they intentionally undertook these actions as a protest, I think they should be graded far more stringently as they should be expected to understand at least the basic of where and when they are allowed to protest.

I've never seen a country that didn't have a surplus of stray/impounded cats and/or dogs, which are, when you get right down to it, just another source of protein. In fact, combining animal shelters, soup kitchens and food banks could kill two or three birds with one stone. Okay, eating obligate carnivores isn't particularly healthy (which is just one reason *why* we tend to 'love' some animals and eat others, though what self respecting vegan would bother to listen?) but it's probably a better alternative to starving.

@BushidoNinja I used to believe that. Now? No. I just can't. Video after video of regular people knowing the laws more than cops. Not only that, but when the "bad" cop acts out and gets violent, the "good" cops will almost never intervene. People are getting falsely arrested and additional charges applied to them to try and cover the cops, which seem to be getting dismissed a lot more since people have started to realize their rights. Complaints get filed on police officers and more often than not, they are found in "no wrong doing" by their superiors. A cop will tell you that ignorance is no excuse for the law. Seems fair enough but cops seem to have double standards because when they get the laws wrong, they love to hide behind good faith and the penalties for them breaking the law seem to be way less than what everyone else would have to face. Let's not even get into how long it takes them to "investigate" themselves when a complaint or allegations come against them. I've seen them arrest people on just the word of a witness but video evidence that shows them doing something illegal takes months to investigate. Then, if you like we can discuss all these bullcrap infractions they love to give people. The window tints (my favorite since they almost always have darker tint) and witness to street racing, and so forth and so on is ridiculous. A real role model.

Technically the law states if the suspect “willingly” observed, and since the guy parked his car and walked to the location to where the cars were driving it would make him a willing observer. Someone standing at the crosswalk before the cars show up did not travel with the intent to watch the cars doing the illegal actions.

@@XDRosenheim Actually, most EU countries have much stronger protections, and virtually ALL of them have far better trained POs than literally anywhere in the US. IIRC, the longest required training for any US PO is 6 months. The shortest training period for any West European Police Officer that I am aware of is in the UK (21 weeks), but the UK is not in the EU. Most EU countries have a much longer Police Officer training scheme. I live in Spain, where any of the "real" POs (ie not Policia Local) are required to complete a 2 year training course.

The law is specifically about being in the place where you know this is going to happen with the intent to watch. I agree that it feels gray constitutionally, but in practice if you have frequent drag races in your vicinity, you would also want the instigators of said drag races to be punished. I don't think what happened in this video is what the statute was made for and don't think those people should have been charged, but I see the merit in the statute existing.

funnily enough, certain plants do actually hold a certain level of awareness/consciousness of their surroundings as well as how they interact with their environment. various trees and mushrooms being a measureable/proven example of this. meat, plants, it's all just food choice and the "circle of life" that humans have evolved with. it's ok to farm livestock, but admittedly the U.S. has a problem with it's coroporations over doing it in an unsafe & unethical manor for both worker, livestock, and damaging the environment in the process. something that drastically impacts the global climate is beef production, because of the methane released by those cows. corpo's over do it by such a large margine, that cow crap is damaging the atmosphere. would be impressive if it wasn't slowly contributing to our deaths.

The protesters get a C when they refuse to leave the store when asked, multiple times, and then attempt to flee while being detained?? How is her action different than if he had pulled he over for a traffic violation and she attempted to leave? I think, while the cop was hyperbolic regarding "being hit", he was within his rights to reach in to attempt to immobilize the vehicle to stop her from fleeing. He deserves way better than an F, especially considering she didnt end up arrested or even removed from the car.

Yes, the C is questionable. The only positive things they did were having the interest to express their opinions with use of the first amendment and not being violent. That does not compare to staying on private property after being told to leave, chanting loudly and being confrontational to law enforcement. This sadly makes them look defiant and untrustworthy. This way, their message will not reach the hearts of all those shoppers. Regarding the officer: He did overreact, but depending on the information he received, he could have had reasonable suspicion or even probable cause. He might not have the temper necessary, but an F? It is important to be fair in grading law enforcement. They are on duty and have to behave flawlessly. But we see Ds or Bs for officers too rarely. As we praise auditors for their good deeds, we should do the same for officers, if they deserve it, of course. + It is crucial to know what behavior of the police is to be expected and praised. I primarily use this channel to learn the constitution, but I also wish to understand and work with the police. Otherwise, we only hate on them, without the chance of a beneficial discussion on both sides.

I see it as more of a law against assembly than a law against viewing or filming. If you weren't intending to be in the place knowing that such illegal driving actions were going to take place, then you didn't break the law. Note that I don't think the people in the video broke the law (unless other things were happening before our video started).

Citing people for WATCHING cars, regardless of from where they are viewing, seems like a 1st and possibly 4th amendment violation to me. What the hell is Florida’s legislature thinking??? This is supposed to be a “conservative” state. Our legislature has abandoned the people they are supposed to serve with this law.

The cops that did this in my neighborhood were "hero's" We had multiple street races every weekend through residential streets in our city blocks. Cops put a stop to it over the course of a year and a half. Its laws like this that actually make a difference.

That's a good thing. You've clearly never been in a suit. Handing down a judgment is one thing, collecting is another. Individuals do not have the kind of income to cover these egregious violations of rights. They do have the time in years of life to be placed into indentured service for the state to pay for the costs they incur to it. At least partially. Make them pay the state after the state pays out is the actual solution.

They should have charged the vegans. Crimes were committed. Trespassing was absolutely done. Threatening the officer. "Watch out I am leaving" is two crimes. "We were never asked to leave" is another crime. ATA got another one wrong. 😊

@@OverDriveahis the other commenter pointed out it's a pretty well-known rule. The reason is when you are defendant you are directly involved and it could be very difficult to look at things objectively which is what is required for a proper defense.

Oh come on, we all know EXACTLY why the police would endeavor to hand out spectating tickets, and pull over everyone they can. 1. tickets generate wealth for the state, which in turn gives PDs more power in arguing over their budgets. 2. tickets get promotions, benefits like preferred treatment for requested days off, and it keeps the officers busy doing easy, almost always safe work, rather than going after more meaningful crime. 3. they then have reason to stop whoever they want, can profile to their heart's content, and fish for more tickets or warrants, which refers back to both 1. and 2. 4. Dopamine. Stopping people, holding them, giving them a ticket all gives tyrants dopamine.

You are obviously uninformed about the myriad of laws in the USA. One easy example is that standing still on a sidewalk can be a violation of law in many jurisdictions. Impeding traffic can be charged. Vagrancy laws have been on the books for decades. If you do not have >$10 on your person, you can be charged. Furthermore, America just proved it is embracing fascism with its latest presidential election so if you are a student of history you may notice similarities with Germany 1925-45 and the USA today going forward. @@Mark-gg6iy No, I'm no expert on law by any means. I'm just astounded that there's such a law that prohibits people from standing in public and simply observing things around them. Without a doubt in my mind this citation can be challenged in court and beaten. And I would go so far as to say that this law should be altered to be more specific than it's currently worded, or just straight-up stricken as being unconstitutional. I've seen many videos of people challenging the constitutionality of various laws throughout the US states and their counties and cities, and these people are making progress. So yeah, while there's many obscure laws (particularly one prohibiting the mere status of being homeless, which I find to be just as wild), I have no doubt that it will eventually be challenged one day and found to be unreasonable.
