A similar scenario happened to me in 2007 in Maricopa county AZ. I was a government contractor newly assigned to Luke AFB from out of state. I had only been in town 3 days, and was exploring Phoenix, when I was pulled over for having an out of state license plate on my vehicle. I told the officer the situation and his reply was that since I was new in town and my prints weren’t in the maricopa county system, I would be booked and released to get my prints on file despite having broken NO laws, having no criminal convictions and being well within the 30 days to attain new IDs and plates. The deputy informed me that he was acting under orders from the county sheriff ( Joe Aprio) to stop, search, book, and ticket all persons they pulled over that didn’t have an AZ license plate. After being booked, and printed I was informed that I would be held for 36 hours to ensure that I didn’t have warrants out of state while they searched for me in the NCIC database. After finally being released a day an a half later I was shackled and loaded into a van at 2am and was released with several others in the worst part of town imaginable in the middle of the night. After finally returning to base and telling my superiors what happened, and that I would be pursuing a lawsuit against the sheriffs department, I was told to stay on base and that in a week or so, I would be transferred to Kirkland AFB in NM, Due to the fact that Luke AFB Didnt want bad blood with the county sheriffs department. I absolutely refuse to believe that the citizens of Maricopa county were ignorant of the Sheriffs policy and because they allowed and sanctioned the behavior of this Sheriff by keeping him in office 20+ years.. I swore never, ever, to go back to the state of AZ. Those people are f**king crazy.

@@Dj.MODÆO wow totally illegal. Did you ever file a 1983 lawsuit? I wonder if full time RVers ever run into these issues. I know Arizona is popular with snowbirds who want to escape the weather, people send months in the desert in Quartzite. Phoenix seems like a cool city to check out too, but stuff like that is horrible. I know I heard places like Arizona and Idaho like to profile people based on license plates due to hoping to find drugs and especially race in AZ. There's someone who goes by the bread trucker who converted a old bread truck into a RV and registered it as such as Florida. He has some pull over videos. Not a regular RV but one of the officers was trying to say he was driving a commercial vehicle since converted to a RV, and not a normal looking RV you'd buy at a dealership that thousands of retired people drive around, and depending on your state of license nothing special is required to drive a 26,000 pound RV because they are exempt even if they meet the commercial weights.

@@helenholt1161 I'm not talking about what the officer is obligated to do; I am talking about what he SHOULD have done. A reasonable officer would have recognized the confusions/issue and de-escalated the situation instead of doubling down on their authority. I've had an officer recognize his error in judgement, though he didn't apologize. He moved on, made sure there wasn't anything else he could get me on and told me I was free to go. A major part of this channel's videos is discussing how the police messed up and should have handled the situation.

I had a cop do this to me once. I was taking the bus back from my brothers house in Stanton California. I got off the first bus and was waiting for my second bus. A cop suddenly comes up to me and tells me he wants to search me because "I've never seen you in this neighborhood before." Which I thought was stupid. But I was young and way too nice. So I explain to him that I am never in this neighborhood, except when I am at this bus stop waiting for my bus. He searches me and finds candy wrappers in my pockets and my keys and wallet. Then my bus comes and he won't let me get on it until he is finished. I remember feeling embarrassed because the bus driver and all the riders that are familiar to me around that time were looking at me like I was a criminal. Finally a few minutes later he leaves and states, "Well now I know when I see you that you are just a candy lover." Even back then when I was much nicer than I am now, it made me angry. Whatever he was really doing I will never know.

Hence the man is very well free to leave when he wishes to. Also, why did you assume that I am a cop hater? Have you met me? No. Drawing unnecessary conclusions is a very strong evidence of a lower level of thinking lacking the ability to analyse situations critically. In the same vein, were you there? No. So how can you say there's something that has happened before the video started? Please stop assuming that you are intelligent enough to draw conclusions about people you haven't ever met. As a younger man I was stopped for a traffic violation. I had picked up a friend's little brother who was walking in the rain. I had just passed the Hardee's restaurant when I spotted him walking . He was carrying a moose cup with him and I assumed he was coming from Hardee's . I did not know that was not the case. The officer who pulled me over less than a half a block down the road knew or suspected my passenger was drinking under age. I was ticketed for illegal transportation of alcohol and contributing to the delinquency of a minor and was arrested. When thee officer found out I had a good card he told me he would make sure that it was revoked. He put in his report to the state I was a drug pushing time doing people hurting felon . I had no idea he had done this until many (12 or 13 yrs) later when I was pulled over for not using a signal when I did and was forced to allow my vehicle and person to be searched. I was left standing on the road in freezing weather in a t shirt because he would not allow me to put my coat which he had already searched by turning it inside out back on. It wasn't until another officer arrived did I find out that when thee officer ran my plates it came back with the fictional information. It took a lot of time to get those lies removed from my record. But it explains why I lost my security guard job only a week after picking my friends brother up and why it was so hard for me to find work.

Friend of mine got pulled over at a 'magic checkpoint' no cause to stop, and cops demanded the names of her passengers, she didn't give their names. She kept asking the cop why they were stopped and why her passengers were being harassed. Her brother is a cop in a different division, but we have one national police force using the same computer system, so he was able to see what they wrote. He got it corrected cos it implied she had done something suspicious, when in fact the cops were just dicking around.

Let me put my two cents in. I'm from Europe, Germany, watched many of the videos on your channel and I got quite well educated on the legal aspects. I have never been stopped by police asking for my ID walking on the street in Germany, and only 2-3 times in the last 30 years while driving. I never ever in my life saw a police officer even draw his weapon on anybody. The way I see it, it is quite easy to innocently and unintentionally get into a situation in the USA to be held at gunpoint by a trigger-happy mentally unstable cop. and then I'd definitely put aside what I've learned here about the law and my rights and even lick the asphalt to save my life. Am I wrong or if not what's wrong with you guys across the ocean?

I think a huge difference between Western European countries and the US, is the comparatively unlimited power police officers in the US are afforded. I'm Dutch, and the only time police would be allowed to handcuff me is when they transport me to the police station because I'm being arrested on suspicion of a crime, or if I've been convicted, and in both cases only to prevent me from running while I'm being transported. Even then, in many cases they will not be used if you cooperate. The notion that police could handcuff me "for their safety" while they investigate me during a traffic stop is completely ludicrous to me. I think part of the reason is that in the US it's reasonable to suspect that any person you stop may be armed with a deadly weapon, whereas in Europe this is extremely unlikely for everyday police interactions. Another aspect is the legal system. The US constitution is _incredibly_ vague, and instead relies on courts interpreting what protections certain ammendments do or do not afford. European laws, on the other hand, tend to explicitly make clear their intent. This means that it's much clearer up front whether you're breaking the law, giving less of a mentality of "just get arrested and then fight it in court". Furthermore, most Western European police officers receive a much, _much_ larger amount of training in both the law and how to interact with people. I would be perfectly happy in most situations to answer any questions a police officer might have, because I can reasonably expect to just have a polite conversation with no further consequences. If I could be arrested basically at the whim of the officer I'm talking to, I might think twice about answering any questions whatsoever, which seems to be the way to go in the US in many situations. Finally, I think it's important to be aware of the purpose of this channel. Some people in the US call themselves "constitutional auditors". They may go around filming themselves doing things they know are constitutionally protected, and then record what happens. For instance, they may intentionally curse at police officers (because that's allowed), and then see what their reaction is. Or they might film the operations of an oil company from a public location, and sometimes the cops get called in. When the cops then start asking questions (as they should), these people usually decline to answer any of them (which is their right). This channel then reviews the legality of these interactions. So you inherently get a much larger proportion of interactions where the people seem very argumentative and uncooperative from a European perspective. I don't think it would be correct to extrapolate this to thinking that all, or even most, interactions with the US police are like this.

I've lived all over the USA for 39 years. I've had a 50/50 split between what is seen here and what you would expect from decent law enforcement. I've been falsely accused and arrested without proof of a crime, I've been treated like a guilty person for just trying to keep my rights, I've had my car torn apart at a traffic stop because I kept my windows up and the cops had their dog "hit" on drugs. (I had none, and don't do drugs). The worst part is that my mother was a police officer and after five years couldn't take the corruption and sexual harassment she tried to fight against.

If I knew anything about the law and was randomly held at gunpoint by a controlling, psychotic police officer, I would absolutely forget it all and do as I was told. Once all is said & done, I'd take it to the courts once I've escaped the situation with my life. These cops are so scary. One bad cop on a bad day could murder you in the blink of an eye & most likely get away with it.

A lot more than half of the 30 year olds here also share the same experience i’m 21 and have only had to show my Id to a cop twice when pulled over and that’s it and pretty much everyone I know would give a similar story. While the chances of having run ins with the cops or criminal acts is generally higher than Germany it really depends on where in the country your at. We’re also like 4 times the land size and population and only like 2 other democratic countries are bigger so yeah your gonna see a lot more instances of policing in general here and therefore a lot more instances of bad policing.

@TomJakobW
@TomJakobW 3 жыл бұрын
No. Stop-and-ID doesn’t mean they can ask you to identify at any time under any circumstance. It means a cop can ask you when he suspects you of something. In comparison, in a non-stop-and-ID state you don’t have to identify yourself in these instances, where the police just „investigates“ (I.e. cop thinks you’re shady, asks questions). You would have to be (IANAL, so this is just my understanding) arrested to actually be forced (if at all?) to identify yourself. So it seems to cover the area between „being stopped“ and „being arrested“. There can’t be a law for just asking for ID for no reason, as it seems to be unconstitutional, iiuc. Again: no legal counsel, IANAL; research the specific laws of a specific state in question and/or consult a competent lawyer.

If the cop wants to illegally detain you, let them. It won't end well for the department if you litigate. If you fight them or resist, then it could end badly for everyone and it isn't worth it.

We shouldn't even be having this conversation but at least we live in an era where we CAN. Imagine how different this interaction could have turned out in 1985; before cellphones and the internet. The cop would have never been held accountable for his actions; may have even murdered the guy. He already demonstrated that he's overly aggressive; has a chip on his shoulder and zero respect for the law he's paid to enforce. Apparently he thinks it's still 1985; forgot that everyone on Earth now has a cell phone with a camera; thinks he can still get away with just doing whatever the fuck he wants; thinks he's above the law. Isn't it great how technology levels the playing field? I remember the days before the internet and cell phones.
