The bill is HR 82. It is not a raise like many believe, it is based on how much money we put into Social Security and the years worked. I’m a retired LPN that worked in our states Charity Hospital System for 20+ years. I didn’t pay social security because it was mandated by our state retirement system. My starting pay was $6/hr and my ending pay was a little over $12/hr. My pension is based on that alone, no 401k or other savings. My pension is not large as so many others. Custodial and Cafeteria pay was even less. I worked for a private Healthcare system for over 10 years and paid FICA taxes like everyone else. However the amount of social security is cut by 50% due to WEP. With the passage of this bill, I will get around 65% which is a couple hundred dollars. Social security is also based on the years worked, the year you turn 62 and the age you actually retire. A lot goes into the calculation and I had to research it a lot to understand. Not everyone will get 90% of what they put into the system. It can be very confusing.

Spoken like a true lefty educated Dem. 1st of all…. Social Security is supposed to be funded by contibutions from the people that will receive a benefit. If the government would stop stealing money from the SS system as well as having it pay for millions of people that it was never intended or funded for, then it would be much more viable. The Rich pay more than their fair share of taxes, other than using “legal” loopholes given to them by politicians (mostly Dem politicians like the Clintons) to avoid paying what would be “fair”. We don’t need to raise their tax rates…. We need to eliminate most/all of their “legal” tax avoidance programs other than ones that have a direct effect on growth or helping the economy. And only a fool is unaware that taxing corporations more is 100% passed on as a tax on their customers. Any increase in corporate taxes is passed on to consumers with higher prices and INCREASED INFLATION. It is also basic, Economics 101…. That raising taxes leads to less net tax revenue, while lowering taxes leads to more tax revenue. Take a red 💊 and you will understand this 🙄

If you paid FICA the whole time, this isn't about you. WEP was for people inadvertently receiving higher RATE of SS benefits because of NOT paying FICA for part of their career. IOW, WEP corrected what was unfair. It considered employees total earnings in calculating benefits instead of calcalating benefits as if these retirees had earned much less and are poor.

Not all government employees, only those that didn't pay FICA for part of their career. I was federal employee and paid FICA the whole time - part of newer FERS retirement program. And my govt pension is smaller because of that. But the fed employees under older CSRS system who didn't pay FICA, and who also had a FICA job long enough to get SS, will be unfairly over paid because of NOT paying FICA, and will get their big pensions. Let's call it what it is - the Social Security Unfairness Act.

I understand certain aspects of the WEP/GPO, but other parts were inherently unfair. I worked a second job for many years and paid into SS all those years but the WEP would have cut my benefit by over 50%. I’m thankful for this change.

Here's the issue, than wasn't mentioned, with this change. Say you work for 15 years in a job paying SS contributions, and 20 years in a government job, not paying, you will be unfairly rewarded. Your SS payment will be calculated as if you earned ~43% (15/35) of the salary that you actually did during your 15 years of SS contributions. Because of the bend points, which give proportionally more to lower paid workers, you get more SS than is fair, because the calculation assumes that you earnt nothing for the 20 years of government employment. What would be fair would be to calculate your monthly average earnings (which feeds into the bend points) only for months/years when you were not earning a pension (15 years, not 35). You would then also prorate (15/35) the calculated payment.

I was so upset when I found out about this out when I became a teacher. I worked in service and retail for 12 years before teaching… so unfair. This is an amazing relief. It changes my SS benefit at 62 by $700.

Hey, indexed pension is the words you should start with. Might find people have a different sympathy level for the asking. You will be taking from low income people with the proposed SS calc. I am happy you get to get some but your income is artificially lowered so you 40% extra in the calc of your cut. 90-50 your pension or years as teacher should impact just like ours as private employee's. But it will be bust or a mess so I will never get to collect on mine. Enjoy my contributions.

@ my teachers pension is based on age, years of service, and highest salary I earned. I pay thousands into the teachers’ retirement system every year to earn my benefit. It’s still not enough to live comfortably on for most people on a teacher’s salary. I am also invested in real estate and stocks in hopes we’ll be able to do more than just eat and keep the heat on in retirement. I paid into social security from the time I was 14 to 26, and I also contribute now due to my real estate side business. Why is okay for you to get the benefits of my contributions? Social security is not given only to the destitute in this country. It’s a system where people pay in and based on a formula, are paid out. We aren’t asking for more than what we contributed to earn. Just fairness.

@@ItsEverythingElse private pensions are not government pensions. Government pensions are tax payers funded. Only government pensions should be included in this new calc for SS. There is income that is not going to included which will bring up those limited years of income. Making these government retirees that got add to SS. Maybe there is an age the calc needs to change. But go review the ss calc and you can see the limited amount help force the calc to a min level of not high enough. So if the pre government job was small then many years of salary that will not be part of calc. These many years not counted is how us in private industry get pushed to the higher reduction levels. But easier to tell me you don't want to understand how the calc will steal fromthe lower income because you feel entitled. You are to the same income impacted calc as the rest of us.

It's unfair that you get more SS now because of the bend points and how the payments are calculated. Payments are calculated at 90% of the first $1,115 AIME (Average Indexed Monthly Earnings), then 32% from $1,116-$6,721, and finally 15% from $6,722 and up. The bend points are skewed to help out the lower income workers, and higher income earners get hit with the 2nd and 3rd bend points in the calculations. In effect you are getting the maximum Social Security pay out for the 12 years you worked retail because on paper it looks like you are poor because of the limited time you paid into SS. Add the maximum SS payments you will get to your taxpayer funded pensions and you are taking way more than your fair share from the SS trust fund, and more than you deserve from the pittance you paid in. There was a reason they enacted the windfall laws in the early '80s and it's repeal is a kick in the pants for the rest of us who have spent 40 or more years kicking in 12.4% of our earnings to have our payments calculated at 32% and 15% once we earned over the poverty line.

I think those higher numbers are for the GPO. The maximum WEP in 2025 was supposed to be $613 per month. Social Security had an asinine definition of "substantial earnings" designated for each year, and a person who had worked from 21 to 29 years with wages designated as so-called "substantial earnings" had a reduced WEP penalty. For those with 30 or more years of "substantial earnings", the WEP did not reduce the Social Security benefit. Very hard for those working years of low paying jobs and paying into Social Security to overcome the WEP penalty.

If she is affected by WEP or GPO. If she paid SS in a private job and then got a government pension which did not have SS taken off she might have had her SS reduced. GPO will apply to a spouse of a gov retiree who had a reduced benefit. Eliminating these laws will mean she may get those reduced benefits back.

Not true at all. If a retired govt worker has paid in their 40 quarters they’ll get paid exactly like anyone else who paid in that 40 quarters. The only difference now is that they won’t be penalized for having another pension that they also paid into. They won’t be paid more than anyone else who paid in the same amount.

This calc is BS it should have some impact from the income from the government job. They are going to get a 90% share of the low income. But they worked full-time in the government job and got an indexing pension from tax payers. The rest of us get 50% above a level. So double helping for this group. Hope they worked a ton, so they are hit the same as the rest of us suckers that worked and skipped the government job. If SS runs out of funds, we will remember the voting roles. They should pay their income to fund then SS. Hate government people when they make sure they are funded and pay raised as the rest of us get cuts. To summarize they are going to look like a low income worker in the SS calcuation on income. But collect the indexed pension and not have include any of that income. So they will live better and retire early. Yes i am jealous. But also getting taken advantage of. So go fix the calc to include a part of the pension and indexing should be confirmed. I dont want to block what they worked for but they are not the low income that need the boost in their income.

I understand how this appears to many people, but here are a few things to consider. - Most government employees are not the highly paid DC bureaucrats and elected officials that everyone visualizes when they hear about this. - I spent 33 years as a federal civil servant and retired as a supervisory computer specialist. Although I earned a good salary, the pay for an equivalent position in private industry was significantly higher so I gave up a tremendous amount of potential earnings by staying in civil service. - I earned my eligibility for social security through jobs worked prior to and after my civil service career. The calculation of my benefit is based solely on these jobs, not on my civil service time. - Even though my calculated benefit is not based on my civil service earnings the Windfall Elimination Provision that Azul discusses in this video reduced it by almost 50% due to my civil service pension. - If you spend your career in private industry and retire with a pension, your social security benefit is not reduced. There are legitimate arguments to be made about the size of the federal workforce and wasteful government spending, but just as someone shouldn't get special benefits for being a civil servant they also should not be penalized for it.

The calc for those that need to know best 35 years of working. Those are indexed for the year the dollar was made. If you worked 50 years still best 35 years. Sum those 35 years then divide by 420. 420 equals 35 times 12. So again best 35 years. The number is then put thru a 3 level range like taxes. Those are then summed to give the SS payment. If you are not high enough there is minimum payment. So if the government worker is allowed to use their working time paying SS they gain an advantage and get extra slice of the SS. Oh if you take SS early they discount your amount up to 30%. Yes think they should be able to get some money. Not against it just make the calc fair for alll.

If you have been paying into SS then this wouldn't have applied to you. I am a retired GS Fers employee and we paid SS so it wouldn't apply to me either. Federal employees CSRS didn't pay into SS, but get much higher pension. I think some people will benefit too much from these changes, while others have been unfairly penalized. I agree that there should be better calculations so that everyone receives a fair SS payment.

I need some clarification. From what I understand-your SS benefit is based on 35 years of you paying into the system, right? So if I-a retired school teacher, work 15 years outside of education and pay into social security-doesn’t that mean that the other 20 years are basically counted as “zero”, which dramatically (and understandably) reduces what I would receive? I know that the calculation and formula is much more complex than that. But what I’m saying is that my ss benefit with 15 years of paying jnto it-would be substantially less than someone who worked 35 or 40 years, right? I’m not complaining about it. It makes sense that I contributed less and would, therefore, receive less. Before, though, I would’ve received NOTHING for those years paid into social security because I would get my teacher retirement. Am I understanding this correctly?

Let me make sure I and everyone reading this understand this properly. You are eligible to receive SS benefits after working 40 quarters. That’s only 10 years. And, then you become eligible to receive the full benefits entitlement as someone who works 40 years, or 160 quarters? Yet, the individual that works for 40 years doesn’t get the benefit of a pension. Why doesn’t congress scale back the benefit on a sliding scale for the 10 year worker to represent a percentage rather than a full package?

SSI is calculated on your high 35 years so if you only work 10 years they still divide by 420 to get your monthly average income and then they give you the 90 ,,32 and 15 so if you work 35 years you have 420 months of earnings if only 10 years only 120 months of earnings but still treated as if you work the 35.

Only best 35 years are counted then run thru a 3 level like tax ranges then summed and that is bo Summed for those on the Lower end. They get aa minimum value. All I am showing you get all your years and the rest of us only get best 35. I know you worked more and so did I. Most people have 25 or more in their career after they find one. Retirement is not easy to fund as a worker.

got excited for a bit as I was severanced from my 21 year job, I am 64 and wish to retire, I have no pension and a modest 401K, all this HR84 bill does is give more money to people with a golden parachute pension like cops and federal and state employees who also get lifetime medical insurance cheaply and don't have to use Medicare! My sister retired from the state of NV and gets 80% of her salary and medical. These people don't need to get more and leave the rest of us without an increase!!!!

I worked in the private sector for 48 years employed as a coal miner, bus driver, hospital lab and various other jobs, all the while paying in SS. Presently, I receive less than 50% of the SS I paid. Hey the govt. is not giving me anything with HR 84. I paid the money in and would like to have it paid back at 100% .

And with the defined benefit pension plan, you could engage in "pension boosting" and cut a fat hog in the ass for retirement. So it really does depend on where you live. The average income in our area is 62k and these are the taxpayers being forced to pay those salaries.

This is great news about eliminating the WEP that President Reagan signed into law! I just retired and was shocked to learn that even though I'm fully paid into Social Security from previous employment, my public-school teaching pension pushed me into a different Social Security formula that slashed my SS benefit substantially, even though I am fully paid into the SS system. I am grateful that this has been reversed, and President Biden is likely to sign this correction into law!

I agree with giving a raise to low income earners for certain, but not the pension people. They should only get credit for the wages the earned working a W2 job, they exchanged that for a better paying pension job. Its even, now theyre just double dipping.

Also, if they have not done, so, people should consider opening up a my SSA account, and use that information to learn whether they qualify for benefits, or what they might have to do to qualify. Anyone impacted by GPO who has been turned down in the past for survivor benefits should reapply. They will not be automatically qualified based on a previous application. And they should do it as soon as possible, in the next week or two to maximize their benefits.

That makes no sense. They knew when they took these jobs how it worked and now they want to take billions of dollars from the Social Security fund And act like they got cheated. I thought SS recipients get cola raises all the time? On my police pension that is funded primarily by investments in the stock market using contributions from both employees and their cities, I’ve seen one 2% cola raise in 9 YEARS and was always amazed to see the colas that SS retirees receive year after year from a system that functions like a Ponzi scheme with no real investments and relies almost solely on FICA taxes paid by younger workers.

Unfortunately, the result is that due to the bend points being out of whack now, most of the 3% will receive not just equitable benefits, but greater benefits than the 97% will receive. It should be the same. Congress should have fixed the inequity without creating another inequity. Hopefully a second law will be passed to provide the 97% with identical bend points, so that the system is fair.

We literally begged for many years for what you’re describing to happen so that our SS benefits would be properly calculated (and for most there would’ve been an increase) but we were ignored by the politicians in hopes that we would just accept what was being done to us and go away. Retirees then organized on a massive scale to get rid of WEP and the GPO (which is the most egregious of the two as it basically strips away private sector SS benefits of the surviving non govt worker spouse) and here we are. You can thank a long line of politicians before todays politicians for this happening.

This is a payoff to government employees of all kinds , including politicians ,that's why it passed and Mr. Dementia has no clue what he's been signing since Nov 5th. Those of us who didn't work for the government won't get this because we don't get pensions. The reason it was like this before this new law ---->was because you got a PENSION which made up for the difference and more !

Not what this is. People who worked and paid into Social Security over 40 quarters receive benefits based on their contributions. I worked 23 years in the private sector and put tons of money into Social Security. That money was lost until now. I contributed, it's mine, why should my 23 years of contributing be lost to the system? Not fair, now, finally I will get a return based on my contribution, and nothing extra or unfunded.

For Federal jobs, only those under the older CSRS system didn't pay FICA - and now they would not get SS. Nearly all current federal employees pay FICA. Most CSRS folks have retired already.

Nope. WEP as it existed was seriously flawed and denied earned benefits to certain workers for 40 years. It could’ve been adjusted to be more accurate but past congresses ignored retirees who tried to get them to do it right until they finally joined together and pushed for the outright repeal of it. Blame past legislators for being lazy and not doing their jobs.

Negative, this is for people who have put at least 40 quarters of contributions into Social Security. The money they receive was paid into the system, they were denied a return on their contributions until now. It's certainly not a free handout. It's been funded by those people when they worked jobs outside the government system and paid into Social Security. It was earned.

SS is solvent and to keep it solvent all they have to do is raise the cap on the earnings limit. Right now, someone who makes 160,000 a year don't pay anything more in SS tax out of their paychecks. Simply eliminate this cap up to 225,000 dollars and SS will remain solvent. This bill was not under the radar. A Republican senator from Alaska has been introducing this bill every year since 2003. I worked for 17 years in another field before switching to teaching. Without this bill my SS would have been reduced by 600 dollars a month. It is the billionaire class which is stealing from us, not those with pensions.

Many people did not realize the position they took would affect their SS. Some realized at retirement and some realized after starting the jobs and had to reconsider working at it or leaving before the pension period launched. A lot of angst both ways.

@ the Social Security website always told me what I would receive based on my contribution. The website never said anything about my return being capped because I also worked 9 years in Law Enforcement. Finally I will get what I was supposed to, although I lost several years without it. Finally I can enjoy my retirement.

Federal Employees under the older CSRS knew, and they get bigger pensions because of it. I started under the Newer FERS system and paid FICA the entire time. Employees under CS RS were glan option to switch. But, they choose to stick with their big pensions and not paying FICA.

Not true. If anything this will force congress to finally address SS funding and do what they’ve needed to do for a very long time and just ignored. 1. Raise or remove the cap on required SS contributions from high income earners. 2. Means test the wealthy as to whether or not they need SS or if it’s just toy money for them. 3. Increase the age when a person is eligible to receive SS. It’s a very easy fix if congress has the courage to ignore their wealthy donors and just do it. You’re not going to be out on the street and will still receive your SS as long as there’s still a United States.

Very disappointed in your one-sided coverage of this horrible bill. You completely failed to mention this bill will cost $190B and cause the SS trust fund to run out of money 6 months earlier. So now government workers with fat government pensions also get a much higher SS benefit. But everyone else gets their SS benefits cut six months earlier.

It passed the Senate vote on 12/21/24, President hasn’t signed it into law yet, but he promised to do it. It is a major relief for many people who deserve it.

Something has to give. To fix SS one or a mix of: (1) the FRA needs to increase (2) Payroll taxes need to increase or (3) benefits need to decrease. I'll be claiming benefits soon and I don't want young taxpayers to pay more nor do I want benefits to decrease, so the best option is to increase the FRA to 69 in steps over the next few years. People are living almost 5 years longer than when the age was last adjusted in the mid '80's.

Agree on raising the cap on wealthy earners. Before increasing fica taxes on current workers, means testing should be done on the rich and then a gradual increase of the minimum age to receive SS. Younger workers (I’m not one of them) are getting absolutely slammed in this economy and it’s a bad idea to increase taxes on a group that is not even able to afford a home in our current conditions.

Neither change will effect me, but it doesn't make sense that Social Security for government employees and spouses were reduced by other benefits any differently from the taxability that existed for everyone else. Unfortunately, it is going to put additional burden the already over-burdened Social Security system, so it's eventually going to cost everyone a little more.
