Thank you for this! I’ll be 26 in a month and I finally made the decision that I want to buy a house in 5 years. I started taking my finances more seriously and made a plan to pay down my outstanding debts and clean up my credit. I was out of work for a year and my credit took a big hit. Unfortunately, I was using my credit cards to survive. 😢 I am aware of the decisions that I made and my goal is to hopefully settle with the agreement that it would be removed from my credit report. I plan on taking a day to sit down and talk on the phone with whomever I need in order to get my life back. I feel more confident now that I have a plan! 😊

Thank you for the useful information. I was served papers at my home and was told to contact the lawyer for LVNV. There is no court date on the paperwork and from your experience. What time frame do they give to pay things off because I’m literally living off cents and dollars weekly I have no job I’m afraid that if I tell them I have no job they will automatically send me into court and I am very ill. We don’t have a specific recommendation for Arkansas lawyers, but you should be able to find several options just by searching for a “debt defense“ lawyer or FDCPA lawyer near your town. If you want to send a settlement letter now, I don’t see any problem with that.

I acquired a $6200 debt from some apartments at the end of 2020 ( collection co filed may of 2021) which of course was a tough financial year for most so are there any "leniencies" given for debt from 2020? Very useful information that actually makes sense. I have a hard time trusting “1 size fits all” videos and info out there by dozens of videos about removing debt/dispute letter to debt collector. So thank you Mike Wasylik for these videos ! 🙏🏻 I have a letter from debt collection from a closed account (PayPal account) that shows as “ sold to/ charged off” on my credit report under closed acct. The debt collector claims whole amount (2,700$), but understanding how this works, I am guessing they n’ouït his debt for pennies/$ . I have a few days to respond (based on 30 days ) should I dispute or attempt to negotiate to delete?

I'm glad you're finding these helpful. Generally, we suggest starting with a dispute. That allows you to gather some basic information, and see if the debt collector has been breaking the law. Original creditor was being paid a nice sum of money each month and I had a small past-due balance (120.00) left on a credit card for the month of October. The balance on the CC, was about $4,000.00. Apparently, within the timeframe of making payments in October to just making a payment on Friday. (missed one month-november), the creditor recently charged off and closed the account (didn't realize it until I called a day ago). I think the best plan of action here is to send a debt settlement letter that includes a lower balance and a pay for delete?

Most creditors won't negotiate with you until you miss payments-but we generally don't recommend that. Is there any way you can move your balances to a lower-interest loan or loans to make the payments more manageable?

These people refused to settle and said I have to pay the full amount.I’m trying to buy a house and I don’t want my credit to go down any further should I just set up a payment plan for all 3 bills to prevent them from reporting the 2 big bills or just do a payment plan for the 2 bills that have yet to be reported and worry about the other one that was reported later since it was already reported?

If you'r wages are being garnished, that means they've already gotten a judgment against you (at least in Florida) and that means you've already lost. Garnishment laws vary from state to state so you'd need an expert in your state to figure out your next steps.

They don't "expect" anything but they're applying pressure. If it's a ten-year-old debt, how are they enforcing it? If they already have a judgment, you're going to end up getting garnished or levied in most states.

So, they are suing me for an old debt, which was originally from two prior collections... However, the amount is wrong on my credit report. If your goal is to get it removed from your credit report, you can dispute any part of it it’s inaccurate, obsolete, unverifiable, or incomplete. Your other option for a debt that size is usually to offer the collector a “pay for delete option, which means you pay the debt (usually in fall) and they agree to delete your negative trade line. Some debt collectors will do this, some won’t. If they don’t, don’t give them any money. Check out our other video on how to settle with debt collectors for the nuts and bolts of how this works.

If you know their name, Google will be the best start for your search. Also look in CFPB complaint databases, court records, and BBB complaints. Some states require debt collectors to be licensed, so you can look that up also.

Question: I contacted my original creditor, discuss about the settlement, they agreed to reduce the bal from $1002 to $500 about 50% but when I asked for "Pay to delete" the Original creditor credit card bank said: we are not allowed to delete but If you agreed to the settlement of $500 and paid it, we will report as "Paid as agreed, settlement less than full amount, balance 0" what should I do?, should I go ahead to pay it to settle at 50% but if they do not agree to delete, it will still show up on my credit reports. If they put inaccurate information back on your credit report after a dispute, that opens them up to getting sued under the Fair Credit Reporting Act. A lot of lawyers make a good living suing CRAs for violations like that.

I’m here in Florida , I see a debt collection on my credit report. I email them asking to verify debt, they said they have reached out to the original debtor to obtain that information and will get back to me with the validation however they did send me some letter via email that had an account number my name and the company I allegedly owed . I asked for signatures with original amount that was owed and more . However the rep asked me if I had been contacted by another company & I asked her why ? If you have a dispute with your old landlord, the only way to solve that is to speak with a landlord/tenant lawyer in your state. Federal debt-collection law won't help you much.

Maybe. It depends on the debt collector. Your state law may ban surprise fees like you're describing, so it may be worth your time to do a little research first.

But i called the hospital to make payment arrangements and they told me that they cant except any payments because the collection agency owns my debt now. Of course a letter works. The reason they're trying to keep you on the phone is because it puts you at a huge disadvantage. Demand settlement in writing and refuse to do it any other way. Anything else, you're just begging to get tricked, trapped, or lied to.

Our videos are mostly about second party, debt, collectors, where payday lenders usually are first party (original creditor). There are a lot legal issues that come up with these payday lenders, and they very widely from state to state. so if I were to do videos about those, they would be limited to Florida only.

I have 3 debts #1 CA$ 654 #2 CA$ 2200 #3 CA$ 1400 for debt #3 they are offering me to pay $957 though I left Canada 3 years back & I intend to pay it all off..they won’t go below $957..how do I negotiate??

Goal: pay as little as possible. The company that sent me to collections screwed up my medical insurance BAD, then refused to fix it. They sent me to collections before I got a decision back on my insurance appeal. I’m open to any suggestions for dealing with medical debt collectors specifically…

Start from the premise that they are just debt collectors, and that they still have to obey all those rules. While you have some additional protections for medical debt-for example, the right to get ALL your billing and treatment records from the care provider-medical debt collection is still just debt collection. @@RWlawFL thanks for that! As an update - I requested debt validation from the collectors. Several days later, the original company called me back and decided to eat the loss. I would have negotiated with them to pay like 20% or something but I guess after 6 months they just wanted this case done and gone. Phew.

The “person” contacting me about the debt (been verified) is a law firm, there is an added 300 dollars in “attorney fees”. Any suggestions on getting those fees waived, they seem kind of scammy to me

So what if it is a long term payment plan?. Why couldn't you have a special checking account where those payments are made .an account not associated with your primary account. And if they try to take more than agreed upon in the arrangement then just inform the bank to not honor it. I have such an account where I'm given 24 hour notice of all transactions. I have 24 hours to select pay or return with no fees or ever any overdraft fees. My main account is where my SSA benefits are deposited and federally protected.

A third party reached out this week about a debt, my bf had in 2007, in Massachusetts. It was a Bank of America debt for $635. The woman said that BOA closed the account in 2012, due to inactivity, but the account was delinquent. The woman admitted that BOA last tried to contact him in 2012. Now, 10 years later, they want $1058! She was eager to make a settlement of the $635. My bf said to send the information and he would get back to her. The email she sent has 2 offers: a 1 time payment of $1058, or 6 payments of $176! Neither works for us. I’m confused at what to do. We live in Maine, the third party company is in California, and the debt was in Massachusetts, which has a 6 year statute of limitations. Any advice? 🙏🏻💕

This could be incredibly good news for you. Often, when a debt collector tries to collect a debt past the time limit, you have a right to sue them, and put money in your pocket. In other words, you can turn this on Pleasanton stressful experience into profit. You probably want to talk to a lawyer in your state who handles FDCPA cases.

@@RWlawFL Interestingly, I emailed them back asking for: the original Bank of America contract, signed by Kevin, account statement from the BOA account, debt validation letter with the dates of the account (because there were no dates on the ‘negotiation’ and a document of proof of transfer from BOA to AF Solutions. The email came back as ‘undelivered, because their email box is full right now’. Are you serious?! So Kevin called the woman he spoke to, and got a receptionist, who wouldn’t give him the email “because her box is full”, but she could take a message…. I am documenting all of this. I almost think it’s a scam! No dates of the debt on the ‘settlement offer’? No email? There is no way to contact them in writing, as of this point. The letterhead is a Martin, Miller and Associates out of Ontario, California, and I can’t even find that online with the same address and phone number. sketchy shit, man. Love your videos.🙏🏻💕

I’m late replying back to video but this is really good information… I want to write a letter to have a payday loan that is not mine, removed off my credit report. They already sent a validation of debt and none of it has my signature and the address and phone number on the paperwork is not mine… however I’m not sure how to respond back to it.

If it's not your loan, they don't have a right to report it on your credit report. Dispute directly with the bureaus and let them know it's a case of mistaken identity.

Have they seen what we see, with the cute ears and all? They are not taking you seriously, based on the picture that appears next to your name. You may need to ask for help from a lawyer with long sharp teeth and a serious attitude. Did you tell them what your income was? I am no attorney, but I would NEVER tell them that. There are free attornies who will be glad to help you, also Federal and State help agencies as well. Take your time, don't panic, and do NOT offer them more than what you initially did.

I have a collection! I tried to pull this service on hold, selling house to many realtors coming to to keep paying for a service that is not useable! Sensors kept falling off! Now they sent me T collections! I have perfect credit!

If a company has sold you a service or product, and didn’t deliver what they promised, then you might have other legal remedies. If this is for professional purposes, consumer law won’t be able to help you, but a good lawyer, Ken. Because it’s affecting your personal credit, I’d say it’s extremely urgent that you figure out how to take care of this company, and challenge them for their faulty products and services. Almost every realtor has an attorney on speed dial. I hope you’re able to use yours to at least get some starting information.

I have a credit card debt of $7700. I’m paying it via bill payment on my bank. I don’t make much but I’m being aggressive with the payments to knock it down. The debt collection agency keeps threatening to take further action if I don’t take another loan out to cover this debt. Not sure what to do. Any advice? Ps: trying my best to pay it off, no excuse to slip up a massive credit card debt.

If you are making payments pursuant to some kind of deal, you’ve made, and they are threatening you in order to change the deal, that’s probably a debt collection violation.

I just got a lawsuit from a debt collector In the amount of $2200. I just sent my response letter today by certified mail with receipt. Is it too late to negotiate a settlement? And if the settlement is contingent on them dropping the lawsuit do I pay after I know the lawsuit has been dropped?

If you've been sued, drop everything and contact a lawyer right away. We see lots of lawsuits that violate federal law, and without a lawyer, you're going to miss out on all those possible strategies to get a total victory over your debt collector.

Great information! goal is to beat portfolio recovery assoc. I offered not to sue for harassing phone calls,misinformation on account, no process server,and not showing requested purchase and a few other things, if they delete account. Also can a debt buyer assess you for non- charged-off interest from original creditor?

If you have legitimate ground pursuit, then the best deal you can possibly make us one where they pay you. But to do that, you’ve got to be prepared to actually sue. What’s stopping you from going straight to a lawsuit? Regarding interest, it’s going to depend on the situation, but most of them do not.

Their goal is to make you pay the highest amount possible and to report on your credit if they need to. In the face of these conflicting goals, you need to follow the steps I've outlined in the video. Pick a specific dollar amount that is your upper limit, and work backwards from there.

What percentage out of my debt would your recommend to negotiate? A few years ago I received a loan , but then I couldn’t pay it back . Now a collection company keeps on texting me about it . The debt was for $1500 but now they are showing it as $1900. Ideally I want to pay off all at once the $1500 , but I hear people advising me to reduce it to $1000 since they probably bought my debt for less than that. The main goal is to pay off the original amount and get the report removed .

If you want it off your report, you have two options: First, you can identify any in accuracies or other mistakes they’ve made in the reporting, and dispute those with hope they’ll remove it. Second, you can negotiate directly with the collector for a “pay for delete“. Get it in writing, and don’t give any financial information or pay any money until they give you a written agreement for the pay for delete.
