If a tenant and a landlord sign a lease and the tenant than says they don’t wanna move in anymore - they have to pay at least one month because of 30 day notice!! But it should be the same if the landlord after signing a lease doesn’t want them to move in! So I think one month should be paid!! Or???

Ion like the way JM handled this. Discrimination should be taken seriously because this woman’s life was disrupted by the disrespectful discrimination of the defendant. She had no business treating this woman this way just because the man showed up to help her move. If she had questions, there was a way to go about it. If the tenant would have done this - tenants always have to pay the 30 day notice (one month) Why does the landlady NOT have to pay here? Sometimes JM does NOT play like the law says!!! The defendant should not have breached, but as far as "measure of damages," the plaintiff had no money taken out of her account from the defendant. The defendant didn't like them, had a change of heart and didn't cash anything. She ripped the check up. The plaintiff's logic is that if she signs a contract to pay rent for a million-dollar-a-month place, and the landlord has a change of heart but doesn't receive the million dollars, that she should magically get a free million bucks out of principle. That's not how the law works.

@@Cubanflowers We weren't talking about fees associated with the move. Can you not read?! We're talking about the amount of the check. If nothing was cashed, you can't get that dollar amount back. If I sign a contract to buy a jersey worn by a famous athlete for $1 million, and that seller breaches the contract and doesn't cash anything, I'm not entitled $1 million. In this case, she would have been returned a DEPOSIT had she made one, but that wasn't even done. This was a very fair judgment. Court is about making you WHOLE. She lost money in reasonable storage fees...certainly shouldn't have received more than one or two months. She had plenty of time to find a new place. Please review contract law before posting something so ridiculous.

I think she should have gotten at least 3 months rent if the shoe was on the other foot and the tenant broke a lease they would ole money. It should work both ways after 3 months you have to mitigate your damages

No, the tenant would simply lose their deposit. They wouldn't have to pay more than that unless the deposit is less than the month's rent. The landlord would not be entitled to 3 months rent. It doesn't work like that. In this case, the plaintiff didn't pay a deposit because the check was not cashed. So, she wasn't out any deposit or rent money. She was out the storage fees for the month though.

Why didn’t the defendant just give the check back when she decided not to rent to the plaintiff? Also, why didn’t the plaintiff just tell the defendant to just drive her own car to Lowe’s? Why make up some story about not having gas money? Doesn’t make any sense if you’re just going to follow her to Lowe’s anyway and perhaps the plaintiff would not have been so judgmental towards the children’s father.

@jaz19000 did you know that there is more than one type of discrimination? If the plaintiff knew the term, she could have cited familial discrimination, which is what she alluded to. The assumption was race, but it was cleared up by the plaintiff.

This case irritated me a little. Simply because it showed how people in the US downplay POC lived experiences. This is not something far removed. 400 years of racism just doesn't disappear b/c of laws on paper.

The judge asks the plaintiff what her real damages are, and immediately said "I'm going to tell you what your real damages are". She never allows litigants to defend themselves.

My first comment was deleted. Here it goes again. Judge Milian simply cannot sympathize with litigants who have claims of discrimination because she to inflicts it. She particularly has a way with choice words when dealing with African Americans. Harvey is a complete joke. I don't like how the judge made it sound like the plaintiffs problem was the current occupant was still there. How is that not clearly the landlord acting prematurely. I think its called warranty of merchantibity. Renter had relied on the contract.

@goblueinga no I do know warranty of habitability. It has absolutely nothing to do with this case. This is a contracts case. There wasn't anything habitability would cover because she never set foot in there. Habitability covers, heat, hot water, water service, mold, things that make the place unlivable. Google merchantability, it has to do with the idea you can sell something that doesn't have the use advertised. Think car that you can't get clear title. The landlord had no way to deliver an apartment because someone was there

Awarding the plaintiff just $110.00 is a slap in the face. The defendant signed the lease, and gave the plaintiff a date when she can move in but another tenant was presently living there could not find a place. The defendant totally inconvenience the plaintiff. Judge Milian’s ruling is arbitrary.

I dont understand why racism was brought up. The plaintiff mentioned discrimination but never asserted it was race-based discrimination and even brushed those assumptions away thrice while agreeing along when the judge spoke on sexism. And then that question about the race card in that segment that has no business getting such little time... yikes. I like this show, but it felt like they wanted a race-based case and chose to spin this one into that for views. At no point did the plaintiff mention racism!

The plaintiff said discrimination, the announcement and Harvey brought up race. It's a good thing the previous tenant was still there. Plaintiff and defendant didn't need any future involvement. The racist look the guy outside was describing happened to me once, I was unbothered lol, when she couldn't get on anyone else schedule she says she'll book with me, no ma'am no you want, when she heard I was the best around she kept trying to get on my schedule. Nope and stop asking

Plaintiff still didn’t seem to understand why she didn’t win big saying essentially “if someone breaches a contract then they should lose” which Defendant DID lose! But like JM said “you can’t turn a $100 case into a $million case!

One thing about me, when I see red flags, I remove myself from the situation. Yeah, i can sue or fight the case if i have one. But alot of stuff isnt worth my time and to be real, I dont have the time for my nerves to wracked up like that. I would have just found somewhere else

Its not the landlord's fault the previous tenant wanted to become a squatter. I think the perspective tenant is a bit of a drama queen. She sounds like it here, just way to much information. I understand both of the ladies issues, both are correct. The lease never should have been signed till the other tenant was out. Shame on both ladies for that.

So, the judge is just going to ignore the fact that the lazy, broke defendant and her broke husband expected the plaintiff/TENANT and her boyfriend to bear the responsibility of getting what was needed to fix up the place???? The defendant only liked her because she thought she could run over her...but when her MAN showed up, she changed her warped mind. That's textbook racism right in front of our eyes.

Well it didn’t seem like that what she was saying she looked at the place on the 28th and was supposed to move in on the 1st like 3 or 4 days later if you saw this I’m sure you would be concerned if the place would be ready because the tenant was still there with all her stuff.. and when she was told more time is needed for the tenant to move out she was ok with it…it turned out she was correct in worrying about this because the landlord needed help from her no less to fix the place up and the tenant still had stuff there at the time of this court hearing and It doesn’t sound like the landlord rented the place out to someone new yet!

@@cm9923 I’m a landlord.. I’m in the business and I’m aware that a turn can take just 1 day… so no… it’s not concerning that home is occupied a few days before lease starts considering how clean the home is and how quickly maintenance and housekeeping can take place
