The plaintiff says he hired the defendant to build him an aboveground pool and paid in full, but he was charged for several things he never received and now wants a partial refund. The defendant claims the pool came in from the manufacturer missing parts, but the plaintiff wanted the pool installed anyway.

I don’t think he is unorganized, he conveniently left incriminating evidence. He absolutely had that invoice and those emails, emails don’t magically disappear. He chose not to bring them because he knew they’d make him look bad.

I think the plaintiff understood that neither the fence nor installation was included in the price, but the defendant is the one who made a slopy contract. And he's the businessman so i think it's a fair ruling.

My problem with that is that the fence was originally $1275 and the defendant decided to throw it in for free. So the plaintiff should not get any money back for it. That would be like a company throwing in a $30 flashlight for free if you purchase $100 or more and then me suing to get the $30 back if I didn't get the flashlight.

​@@ericafoster2589 if the free $30 flashlight (or the free $1275 fence) is part of the bargain and they don't supply it, why would you not be entitled to the stated value of that item? Calling it free makes no difference to the fact that it was an integral part of the deal, unless they have a caveat along the lines of "while stocks last" or "free to the first 10 customers".

2:35 the plaintiff says that the 5200 did not include installation and that it was an extra 1,000. But later on when the judge shows the contract, the plaintiff says that the 5200 included the installation. So he lied. But I do think that the defendant tossed in the fence kit in order to make the sale.

I kinda figured he was lying when he told his story first. And lied about the defendant about the install. But he was in such a big hurry, he could have waited for the install with the defendant. It just cost the Plaintiff more since he was in such a big hurry.

The one thing that baffles me is how one person is blatantly lying. The nerve of people. And this is in general with all cases. If they disagree on what was said, someone is lying.

There is also such a thing as a genuine misunderstanding. You’d be shocked at the comprehension and mental processing/intellect level of many grown adults. It’s the reason people get into conflict many times. So it isn’t always about flat out lying.

Plaintiff is a liar, he knew the fence kit wasn't included just like the installation. At the beginning he said the $5,200 was the full price minus the installation which would be a $1,000 and then at the end was saying the $5,200 included the installation as well. Sucks for the defendant he made the mistake on that invoice.

The 5200 included the fence kit which the defendant didn’t write a price by. The defendant sent him the email 2 weeks before but wrote something else on the final deal. The plaintiff was about to lose and prolly misspoke but he didn’t lie about anything

ha ha , the reason he was so busy was because he was probably falsely advertising that he sold AND installed pools AND included a fence for 5200 dollars . then once he is about to get the money he tells them its a separate charge for the fence and installation .

@@ericafoster2589 he only got paid for it because he bought a fence kit. The defendant was adamant that he needed to pay money for it so he did and contested the charge in court after seeing it was supposed to be free.

@erica foster - you could sue for the flashlight if the add promised a free flashlight with purchase. That's how companies compete against each other and persuade customers. You can't promise a free item to get someone's business and then not do it lol

I’m so grateful that my husband has been able to set up our pools on his own. The only thing we paid for once was a concrete slab to go underneath the pool. That’s our current pool because on the first one he had to build a pad on the ground.

Yes, I think this is the first time ever too and I’m really glad the judge allowed him to speak. Typically, she says, “NO, THATS IT,” but this time she heard him and you could see the way she changed her thinking.

@@msawyer110 I understood that, however if the defendant is turning away business, one would think the installers in the same line of work would be busy as well. My dad owned his own small construction firm, and when he was busy 'Making hay' as the saying goes, so were any subcontractors he would be trying to arrange for jobs. It just sounded off to my ear, as I say given what I witnessed in my dad's business.

Contractors need to pay attention to details. especially because the deal changes before final contract often. especially now when building materials change cost throughout the year. I recently had a contract for windows where this happened. The sales guy forgot to add the upgrade charges to every window on the contract before sending to me (its a 45 page contract). he also neglected to add the cost of renting a boom lift... but everywhere on the contract was written 'including installation'. I ended up settling with the salesman to accept the lift boom charge but they ate the upgrade charges (I was willing to be nice about the lift boom because they honestly thought they didn't need one to get to the top windows on the 3rd floor of the house; and then a contractor reviewed the contract and told them). the total of the contract is about 60k.

I can't get over these so-called business people who have no clear, detailed documentation and itemization of what's included at what price. Proper documentation is not hard - some people are just too lazy, sloppy and undisciplined to do it. If it's properly documented and itemized to clearly delineate what costs what, instead of relying on these casual "conversations", stuff like this should never end up in court.

I gotta say Judge Milian was kinda all over the place on this one. She kept swaying back and forth between making the plaintiff look like he was lying then going to the defendant making it look like he was lying, and she kept moving too fast going back and forth between the paperwork. I've noticed her do this on several other cases where she's so convinced she's got it figured out already before it's over, when she really doesn't know the facts. Judge Judy is the same way. But I think what it is they've spent so many years listening to cases they assume they already have the answers figured out before carefully looking at the facts first.

When I ran my landscape company I had my terms on a separate preprinted page , it states customer is responsible for all job related costs, even if labor and or product are not originally included in contract , including any equipment rental, disposal fees taxes , permits ,additional labor ! As well any changes in job specifications, without prior written order is subject to price increases !!

The installer sounds like he is used to talking down to women often, I can see why the wife was looking at him funny. Even before he made that good judge comment he was trying to explain to the judge how it was while she was trying to explain to him his mistake.

he offered the fence in the deal no cost to get the guy to sign on the bottom line he even said 'i was worried the deal was going to fall through' thats when he 'contracted out' the installation and added the free fence

I think this was the best ruling🤔 it's very possible that they were both right.... It's also possible that one is lying... But the judge wasn't there, doesn't know either of them... And it would be best to give a ruling that agrees with both of them kinda 🤷‍♀️ the businessman was slopy and this should be a perfect lesson in order for him to either be 100% honest with potential clients OR protect himself from lying clients in the future 🤷‍♀️

I don't think judgement should be on his looks as other comments have been. But on in running a business you have to have your paperwork in order an clarity to what is included in cost. Helps when doing taxes an books.

Sucks for the defendant he made the mistake on that invoice." A GOOD judge would have seen through that! A GOOD judge knows a mistake is to be *rectified*, NOT CAPITALIZED OFF OF! Money mistakes are just like bank rectifications: if the bank accidentally records too much money, the customer does NOT get to keep the money! Heck, I may have even AWARDED THE DEFENDANT SOME MONEY for the plaintiff filing this rediculous suit. Only justice for the defendant is that now the public has seen the plaintiff on TV, smart businesses won't do business with him. They will tell him, "We've seen you try to capitalize off others' mistakes. We don't want to do business with you, only to have the same thing happen to us."

Defendant messed up not writing it all out but he had the verbal conversation with lying Plaintiff who took advantage or the fact defendant didn’t write price beside fence kit and strange how plaintiff lied but won the case if u lie once I can’t trust anything else u say but judge see it differently

Written contracts override verbal ones and in business, the person who writes the contract has the responsibility to make sure it's correct. So even if the plaintiff were lying, it's the defendant's responsibility to write proper contracts, thats why she was trying to help him and tell him where he messed up
