Being Reckless With a Sledgehammer

The plaintiffs, a father and son, say the defendant damaged their truck with a metal pipe while they were both scrapping metal. The defendant agreed to pay for the damage, but he hasn’t yet, so they’re suing. The defendant says the co-plaintiff showed him a tiny little scratch on his vehicle, and he denies he’s responsible.

The defendant’s defense was that the piece of metal would’ve had to fly over his truck, then hit the plaintiff’s driver door. Looking at the photos, I see what he’s saying and agree. JMM could’ve looked more closely. 2:53 - The position of the trucks. 2:33, 2:47 - Where the defendant was using the sledgehammer. Even though the defendant apologized and offered to cover the damages, he still might’ve won if he’d more assertively argued his case, and shown a photo of a scratch on the drivers side of his truck (since he’d thought the metal hit his).

I’m not a forensics professional… but comparing the placement of the cars, the location of where the defendant was hitting the pipe and where the scratch was, something DOESNT ADD UP. Whether he admitted to it or not. The presence of the plaintiff and cops could’ve easily made the defendant scared and admitted guilt. JM should’ve done a little more investigating like she does on other cases.

I'm confused, if the plaintiff parked to the right of the defendant and the defendant was breaking the pipe to the back and left end of his own car, then how did the metal hit the defendant's driver's side door? And why was the plaintiff parking so close to someone breaking up a pipe. AND as we have heard in previous episodes, the judge has stated that it's not because someone says they will do something (pay for damage) that they have to follow through with what they have said. And here he may have apologised and said if he caused damage he would pay for it, but I'm not sure that he actually did cause that damage. (Luckily it's the show that pays out)...

Personally i could easily see the old cast iron pipe breaking and flying as it was hit with a sledge hammer. just like wood does when you take an ax to it, never know where a piece might fly.

Definitely on the fence with this one...the plaintiff took a picture of the defendant hammering BEFORE his truck was hit? That's a little weird. 🧐 Unless pieces were flying all around who would anticipate that..and if pieces were flying all around you wouldn't park near that...just sayin

they should have found a piece of metal there if it hit his truck, but i don't think it magically curved around the truck and hit the other truck. but it probably went up in the air and then came down and then it would be right there

Why do people do this? Something happens it's not on purpose it's an accident, you know you're responsible, you admit fault, and then after you've had time to think about it you try to think of every excuse as to why you're not responsible and the person back pedals and tries to get out of paying for what they know they're responsible for, somebody wouldn't admit fault if all they heard was a loud bang but didn't see what actually happened or know that it was their fault give me a break.

This plaintiff is FOS. I could see if the metal hit his tire from below the defendant's truck or something, but no way that thing curved around and angled up to his driver's side door. The picture actually proves the defense, but the defendant fell for the old okey-doke on this one and admitted to something before thinking.
