This person was fired despite saving the life of their colleague. Not only that, they had also been doing the work of six people due to everyone else in his team being fired and was also owed a substantial bonus.
However his boss refused to pay the bonus and then fired him. Not only did payments that he was owed bounced but he was also subjected to a huge amount of abuse.
The company in question was clearly struggling financially, however the way they acted by pretending to be his friend, using nonsense lines like ‘we are in this together’ and then treating him so badly was completely unacceptable.

Not paying someone's paycheck and even a bonus is illegal. The company owes this guy the money.

Unless he has a contract, bonuses are discretionary. I doubt they would legally owe it to him. It could go either way if he took it to the labor board. However, if you are fired, they legally have to pay you everything they owe you by end of that day, including any unused vacation time. (depending on the local laws).

I once was fired from a job because the boss said I wasn't up to industry standard (entry level and no training for painting) after 1 week of employment. Told me that he would pay me very behind schedule after firing me. It took 2 months and threatening legal action for him to pay me. Wasn't happy about that.

He should get in touch with the labor board, even if they remedied his pay dispute. That HR girl was unprofessional and is going to get the owner sued, if he doesn't fire her before that happens.

Doesn't matter. Every occupation has nitwits like this. Seek out assistance as soon as you get the feeling that something is amiss. Labor Board or equivalent if out of US. Take their guidance. Get an employment attorney. And save every voicemail, text, email and hard copy of anything to support your position. I don't work without a contract. Saves us both and know what is expected on each side. If they want me, they can sign, or not.

HR is a cheap excuse for discouraging labor unions. It was created as an excuse for employers to say we basically have a built in union for you in HR. That's the essential core of where it even comes from.

Seriously! If you're a victim of a crime like this you you have a duty to take them to court to ensure they face consequences for their actions. By not doing so you're not only screwing yourself out of money, you're also ensuring that they keep doing this to more people down the road.

Problem is, if you tip them into insolvency, it may delay any future payment even longer and you might only get cents on the dollar of what they owe.

@omgnsg Sorry, I meant legally....they're already probably technically insolvent, no one has called a meeting of creditors on them yet/appointed an administrator/sued them etc. Or sicc'd the tax office/IRS/ Internal Revenue on them. Like I said, once that happens you're often unlikely to get all that you're due. And yes, this absolves none of the company management from blame. In my country there are legal penalties & jail time for directors/upper management (but seemingly rarely imposed?).

He’s in the US all of your money is due within 5 days of being fired otherwise they get fined for every day they don’t they get fined that goes to you. The DOL is your best friend

The DOL is not your best friend. They have to want to help you. They are government employees and (many) have no interest in doing any work. I had a claim for unpaid holidays the employer did not pay us for for years (they told us we got 5 days a year but I learned the contract said 10). They were a contractor at a federal facility. Their HR dept said "we owe you the money but we are not paying it" and left that message on my answering machine. When I called the DOL said there is nothing they can do. However, by luck, I met a secretary who used to work with someone who eventually became the Federal contracting officer for the region and I spoke with the Officer. She was not surprised by the DOL's response and told me to call the DOL back and just mention her name. I called the DOL again and they said it had nothing to do with them. I mentioned the Officer's name without even saying her position and suddenly they said they said they'd look into it. Apparently they had heard of her. I and my ten co-workers got the missing holiday pay for the last 5 years. If I didn't get help from the Contracting Officer we would not have gotten our money.

Also, *never* work for future promises. When I'm offered a bonus as part of a package, I completely ignore it, especially if it's tied to company performance. I expect it will never arrive, or if it does, it will never be the amount they promised. Definitely never work free over-time with the promise of a future promotion.

Absolutely. I've never seen the bonus I was promised. Not once. Typically what I saw was if it's a non-bonus review period, I'd get a glowing "exceeds". If there was bonus or raises attached, I'd get a glowing "meets". I walk into a job pretty darn certain bonuses and raises are unicorns. So, I make sure whatever compensation I'm offered will make me happy for 3-4 years. When I get to the point my compensation needs upped, I bring it up to my management before the review period with $$ attached, and I get my resume updated. If I don't see $$, I quietly get my resume out and find a new job.

Having been employed in England in Managerial positions I was disappointed and astonished by the Compnies I worked for and their lack of training, lack of HR personnel help and the Higher Management not avaiable. All were just passing ships in the night with no support offered, and if one took one's own initiative you were told NOT Company Policy.! Very pleased when I got to retire.

Someone did this to my bro , stiffed him for a 20k bonus , my brother dumped a ton of fresh cow sh1t right on the offices entrance😂, they lost half a days business as no one coukd get in or access the office , icing on the cake was he got a couple of his old CO's accounts !

I am in the US. As soon as the boss says, all will be OK, I will take care of it, you are in good hands, and don't worry about it; immediately start looking for another job. Start backup any information you can about your work history, any appriasements you got, anything that shows you were a good employee. Because when you hear those words, the company is starting to finalize something like they are going under. To come up with ideas of what can be done to minimize the damage, in other words, what they can do to save money. That way when they do go behind your back and do something stupid as just given in this video, you take it all to an employment lawyer, and you have there asses in a sling. They did not pay the bonus because they were looking to delay the bonus for the termination so they can say it will not be paid because of the termination.

You would think saving someone’s life and staying loyal to a sinking ship of a company would engender some loyalty, but as they say “No good deed goes unpunished.” If I was him I would pursue the bonus through industrial relations, as well as do my utmost to sink their company by joining their fiercest competitor and poach all their clients. I think it would be relatively easy because if a company doesn’t show loyalty to an employee such as old mate, then what loyalty would they show to clients? I’m guessing sweet F.A.

I don't know about the UK, but in the US he'd have a solid case for a lawsuit for the bonus plus possible punitive damages. Perhaps he should speak to an attorney (solicitor there).

Employee-at-will states in the US means anyone's boss will feel like they can get away with murder. They can fire anyone at all without any reason, and will only get into trouble if the worker signed a contract protecting them. The obvious exceptions are stating they fired someone that violates the rights of a protected class (religion, race, gender, disability, etc.) or threatened them while in the work place (sexual harrassment, danger to health, etc.). On the other hand, most states still allow you to be fired if you're a member of the LGBT+ community or reported a crime the employer/ manager committed.

Most companies in the US stipulate you must be hired at the time the performance bonus is to be paid, not when accrued. Further, they always come with “discretionary” rider. His biggest issue is going to be when they block his unemployment claim. He should go to DoL

It's important to note, since he was working for a US based company. Depending on state it is not always legal to record phone/video calls without both parties consent. Some states are single party consent, some are two party consent.

The moment she said don't contact me, he should have said fine. You'll deal with the labor board now. You did say record calls to an american. I will add that you need to make sure you're in a 1 consent state before you record. If not, takes notes on the call and then email them right after with a summary of what was said.

about 7 years ago I left a car sales company in Lincolnshire after the way in which the owner was treating staff, he was a bully, I agreed with my manager to work 2 weeks notice, I had been there 2 years and had never been given an employment contract although I had asked for one many times, The owner withheld my final pay as he said I hadn't worked my full notice, I think he wanted 4 weeks, should have put that in a contract eh, contacted ACAS who after speaking to him once and stating they thought he was the most arrogant person they had ever encountered, advised me to go straight to Tribunal as they were acting illegally, I did that and he paid me a few days before the hearing.

Irt recording calls in the states, make sure you follow your local laws. Some states are single party consent, meaning only one person involved needs to know the call is being recorded, but some states are two party consent, meaning the other person or persons need to know and agree to being recorded for it to be legal and admissible in court as evidence

I have a friend who worked for a company that owns and runs arcades. Friend was the only tech in the region who could fix stuff. The company had a contract with a local casino but the contract ended so my friend was laid off. At the time he was laid off the company owed him over $4k. The last paycheck he got was for $4. He asked them for his $4k and they said they were going to mail it. Over a month went by. No check. Every time he asked they claimed they mailed the check and they wouldn't do direct deposit and all that jazz. He never got the $ and its been over 6 months now. He's given up on ever getting the $ bc he thinks the company went belly up.

IF YOU ARE IN THE UNITED STATES, DO NOT JUST RECORD YOUR CALLS. CHECK YOUR STATE LAW. The US has two standards for call recording, “one-party consent” and “two-party consen,” one party means as long as one person on the call is aware it is being recorded, it’s legal. You can record all your calls. HOWEVER. Some states, those with two party, REQUIRE all party’s knowledge of the recording being taken. To record without consent can get you into legal trouble, and any such recording would be worthless

In the US, you do have to be careful about recording calls. Depending upon the state, some states require permission of both parties for recordings to be made. Check the laws first.

It's funny with a company like the one described here. They can dump on you big time, and you can leave in the worst of circumstances, with no chance of a reference or even a reasonable word from them, and yet their competition always seems to know exactly what and who they are. I've literally walked out on a Thursday and had a new job by lunchtime Friday with companies like this. Pick up the phone Friday morning and ring around, go and see them, sign paperwork, Show up Monday ready to roll. Then when you deal with clients and they ask why you left, you don't completely dump them in it, because people dismiss that out of hand as sour grapes. You make casual hints. People read far more into a casual hint than you truth bombing them. Their imagination goes wild in line with their expectations from poor performers. You just need to steer them in the right direction. I used to crack people up when they asked why I stopped working for one guy. I'd tell them straight...lovely man, seems very genuine, hard working...just keep one hand on your wallet at all times. Customers that knew him would crack up laughing and tell me I was absolutely spot on. He just couldn't help trying to take your whole wallet, not just the cash in it.

I remember I witnessed someone jump in front of a train on my way to work . and I rung work and explained etc and said I'll be in when I can and the manger turned and said if your late in then I would have to make the time up !! . lucky when I got in a women at work sent me home .due to shock ! this was a big well known company aswell

He should have sued them but instead let them get away with this behavior that they will repeat. He was owed the bonus BEFORE being terminated so they can't use termination as an excuse. HR's text messages are an admission that they fired him for being over-50 years old. That's illegal.

Be careful when recording calls, some places require 2-party consent and you can open yourself up to litigation if that is the case.

I could not be mad at someone... even if they were in the wrong... if they had previously saved my life. That gives them a pass in my book for most things. But, to be mad and hateful toward them over something that is not even directed at you... WEIRD!

Wow, that’s an incredibly thoughtless and cruel response. I'm sure your 'advice' speaks volumes about your understanding of empathy and professionalism. HR is about supporting people, not making heartless comments. Maybe you should try stepping into someone else's shoes before spouting off nonsense like that.

Wait, I heard him say something about Americans, the US… I’m wondering he has a case if he is indeed in the US if they had hunted him, and if he had signed a sign on contract, that included a bonus that they kept pushing back, and then reneged on, said bonus, after it was due, he might have a case and he should turn those text into the federal labor board and the EEOC.

Yep, record everything, but I'd also add to keep everything straight-forward. Don't argue, don't get angry, and as soon as they prevaricate at all simply engage a lawyer/the labour board. Don't buy into any of their nonsense.

Americans don't have the same employment rights as most of us in other countries have! Employers have almost all the rights and he would likely only have a small claims case.

I've been burnt for not keeping records of outrageous shit that's gone down. I even constantly thought of recording myself for every call, and somehow it always just skipped my mind when it comes up. To sum it up, I was dealing with a group who were misandrists, and one of them even admitted in front of the group to being a p**dophile. I was contacted by one of the higher ups probably 6 months later. He couldn't apologise, he said my dropping off the face of the planet wasn't because I was too anxious to even get through a verbal conversation with someone who at least pretended to be my mate. It was all extremely disappointing and honestly very disgusting. I wouldn't have gone back there if my salary got tripled. Well, he left an open line and finally my mental health situation wasn't as dire and so I decided to give him another chance, and all he could do was blame me.

It might be illegal in some states to record a conversation without the other persons consent. Confirming conversations by email or making good notes might be what needs to be done if you live in one of those ststes. Of coursr, keep voice mails.

Oh do I have a story on this that is very similar. But it gets better/worse (Australia) and involves: - payslips rescinded - non-payment of entitlements (substantial) and backlog of superannuation (similar to 401k/pension) - character slandering to existing staff - alleged phoenixing of the business - business in administration 12 months later (post-alleged phoenix) - legal discussions by the business used as a way to string out payment

I once had a boss which i reached out to that im close to hitting the wall really bad. I felt it coming. This was in april/may a few years ago. His response was - It's normal when the vacation is closing in, its normal. I said that its not it, it has been creeping up on me for over half a year and the rest of the team was struggling too. I never really got any response on that, more or less a smile then lets go back to work.

Reminds me of my last job I was fired from because I wasn’t happy about an employee essential risking my life for a joke and I was fired for speaking out absurd the second Christmas in a row I have been let go

Absolutely! I worked at a place where we had an amazing profit year but we were told that we hadn’t achieved expected results so no raises. We found out later that the President and VP had split the funds for raises between themselves (mid size company). Someone was friends with a board member and told them. He and his buddy were gone within the week. We got our raises. That was 1982. Today, that board member would want a kickback and whistleblowers would be fired.

In many US states you cannot record if you only have the permission of one side of the conversation. It's illegal in my state anyway. So, look into your state laws before you start recording calls and video calls.

Isn’t paying a bonus voluntary on the company’s part if you’ve done a really good job? I don’t know for sure, I’ve never worked at a job that offered one.
