It's really weird that this conversation always goes back to "what was the intention of the first amendment? What was the intention of the founders?" The answer should be we don't care. Even if all the founders said "we are a Christian nation. The ten commandments should be posted in all government buildings." Then the correct answer would be they were wrong and we should not do that.

IF this gets upheld, which I doubt it will, it would be interesting to see the rationale the court uses. If they did go with something about it not being coercive, I wonder if teachers could then display ANYTHING they wanted as long as it wasn’t offensive. If I were a teacher and it got upheld, sure, I’ll display the 10 commandments, fine. But I’ll also display the 5 pillars of Islam, the 7 tenets of the satanic temple, and whatever other religious doctrines. I’ll also be sure to have the Jewish, Protestant, and Catholic versions of the commandments and make a big show of the fact that no one can agree which ones are the “right” ones

I’ll give an unbiased explanation, as I am progressive left, anti conservative, anti religion, and definitely anti shabibo. One of the reasons the states agreed to the constitution after the articles of confederation was the protection against acts of congress to establish a religion. These states pretty much universally had their own established religions (there were a bunch of sects of Christianity, even in early America). Catholics didn’t want Protestants and Quakers didn’t want non quakers or so on dictating what their religion should be. So the emphasis was indeed on acts of congress, not acts of the states. However, it has since been expanded to include the states via the incorporation doctrine and the fourteenth amendment, which I agree with. The founders obviously didn’t foresee the incorporation doctrine, so it is silly to bring them up in defense of or in opposition to religious jurisprudence.

As much as I hate Ben… he is actually correct when he says that, at its inception, the Bill of Rights didn’t really apply to individuals but to the federal government. However, I don’t care. The founding fathers aren’t saints that we should worship and continue with their backwards system for no coherent reason. These people also owned slaves, so I don’t really think I need to deep dive into their intentions. People should have rights, not just states. Thankfully, this changed with the Fourteenth Amendment, which extended these protections to individuals at the state level. So, while Ben’s point about the inception is historically accurate, our Constitution and society have evolved significantly since then.
